A.
The Township officers elected by the Upper Providence electorate
are:

The Board of Supervisors shall select the following as principal
Township officers:

The terms of office, duties and powers of the various officers referred
to in this section are provided for in the Second Class Township Code
or by the Upper Providence Township Code.
C.
The Township Engineer and the Township Solicitor shall be appointed
by the Board of Supervisors at its organizational meeting or as soon
thereafter as practical. The terms of office of these two officers
shall be one year, but serve at the pleasure of the Board of Supervisors
and can be removed at any time by majority vote.
D.
All officers referred to in Subsection A of this section shall be independently accountable to the Board of Supervisors for the performance of their respective duties, except that the Board may, in its discretion, direct by public vote that the Township Secretary, Township Engineer and/or Township Treasurer report to and be accountable to the Township Manager for the performance of their duties, as part thereof.
E.
In the event of the temporary absence or disability of any officer,
the Chairperson shall nominate, upon the advice and consent of the
full Board, an acting incumbent, who shall have ad interim power and
authority to perform the duties of that office.
F.
In the event of a vacancy in any such office during the term of any
such officer, the Board shall elect and appoint an officer to fill
the unexpired term for such office.
The compensation of the officers referred to in §§ 2-11 and 2-12 of the chapter shall be provided for in the annual Township budget and adopted by resolution, and any amendments to such resolution, and as otherwise provided by law. Compensation shall not exceed the maximum set forth in the Second Class Township Code.
A.
Persons elected or appointed to any of the following Township offices,
before entering upon the duties of their office, shall take and subscribe
an oath or affirmation to perform the duties of their respective offices
with fidelity:
(1)
Members of the Board of Supervisors.
(2)
Township Treasurer, and Board of Auditors.
(3)
Township Tax Collector.
(4)
Township Manager.
(5)
Township Secretary.
(6)
Township Solicitor.
(7)
Township Engineer.
(8)
Police officers. Every member of the Police Department.
(9)
Any employee assigned the responsibility for the enforcement of laws,
statutes or ordinances that affect the rights and privileges of people
or property including the Fire Marshal and Zoning and Code Officers.
B.
The form of oath of office may be prescribed by the Township Solicitor,
and the oath shall be taken and signed before a Judge, District Justice
or notary public of the Commonwealth of Pennsylvania. A copy of such
oath shall be filed with the Township Secretary within 10 days thereafter.
A.
In addition to all other powers and prerogative conferred on policemen
by law, policemen shall be ex officio constables of the Township and
may, without warrant and on view, arrest and commit for hearing any
and all persons guilty of a breach of the peace, vagrancy, riotous
or disorderly conduct or drunkenness, or who may be engaged in the
commission of any unlawful act tending to imperil the personal security
or endanger the property of the citizens or violating any of the ordinances
of the Township for the violation of which a fine or penalty is imposed.

Policemen shall have the authority to serve and execute all criminal
processes for the violation of the Township ordinances, which may
be issued by any District Justice of the Township, and shall charge
the same fees and costs as pertain by law to constables for similar
services, but such fees and costs shall be paid to the Township Treasurer
for the use of the Township.
A.
The Township Manager shall nominate, and the Board shall appoint,
the Fire Marshal, the Zoning Officer and the Chief of Police. These
personnel shall be under the control of and shall be accountable to
the Township Manager.
B.
During the temporary absence or disability of any of said officers,
the Manager, subject to ratification by the Board, may designate,
by letter filed with the Township Secretary, a qualified administrative
officer of the Township to perform such officer's duties during
his temporary absence or disability.
C.
The Board of Supervisors will act by majority vote (majority of the
full Board) in appointing citizens to fill vacancies in all Boards
where such authority is provided by law, including the Planning Commission,
Vacancy Board, Municipal Authority, and Zoning Hearing Board.
