It is the purpose and intent of this chapter to protect and preserve the property and facilities owned by the Township and provided by the Township for the use and enjoyment of the residents of the Township and the public in general.
A. 
Property and facilities of the Township not clearly marked or identified as open to residents and/or the public in general, or specifically marked or identified as restricted from general use or access by unauthorized persons shall be restricted in use and access to only those persons specifically authorized by the Township.
B. 
Such restricted property and facilities shall be accessed and used only in accordance with the written authorization of the Township.
The following rules and regulations shall apply to property and facilities of the Township which are not restricted as set forth in § 239-2 above.
A. 
Property and facilities of the Township, and areas thereof of which are open to the use and access of residents and/or the public in general shall be limited to those areas marked and identified for such use and access.
B. 
Except as posted otherwise, such property and facilities are open daily from sunrise to sunset and closed to all uses from sunset to sunrise.
C. 
Pets, when specifically permitted, must be kept leashed at all times and under the control of a responsible pet handler. Pet handlers are required to clean up after their pets. In no case may pets be allowed on playground areas.
D. 
Operation of motor vehicles shall be limited to driveways and parking areas. Parking is restricted to the designated parking areas only.
E. 
Assemblies or public demonstrations are permissible except where such an activity will disrupt or interfere with scheduled events or prevent or be inconsistent with the intended use of the property or facilities at the proposed site of assembly. Organizers intending to conduct assemblies or demonstrations must first apply to the Township for a special event permit.
F. 
The following activities are strictly prohibited:
(1) 
Barbecues, cookouts, grilling and open fires.
(2) 
Discharge of firearms (except as part of a Township- or state-approved wildlife management program or as otherwise allowed by state or federal law), including slingshots, air-soft and paintball guns, BB and pellet guns, air rifles, archery equipment and other projectile devices.
(3) 
Hunting (except as part of a Township- or state-approved wildlife management program).
(4) 
Fireworks, rockets, explosives or other dangerous materials.
(5) 
All types of golfing.
(6) 
Skateboarding and roller-skating/blading.
(7) 
Use or operation of mopeds, minibikes, all-terrain vehicles, utility vehicles, snowmobiles, or other motorized forms of human propulsion, except for official Township vehicles, emergency vehicles or other official vehicles authorized by the Township. This provision shall not prohibit the use of power-driven mobility devices for use by persons who have mobility impairments.
(8) 
Using radio-controlled vehicles, including but not limited to cars, trucks, airplanes, drones and helicopters.
(9) 
Smoking.
(10) 
Possessing or consuming alcoholic beverages or nonprescription drugs.
(11) 
Loitering or disorderly conduct, including the use of indecent language, excessive noise or sound amplification or remaining on or at the property or facilities for a period of time or for any purpose not reasonably related to the property or facility.
(12) 
Bottles, containers or other items made of glass are prohibited. All other trash shall be placed in trash receptacles (if provided) or removed by the person(s) generating the trash. Recycling is required. Recycling bins shall be used where provided or, where not provided, recyclable material shall be removed and disposed of off the property or facilities.
(13) 
Vandalism to the property or facilities, including defacing, damaging, digging or otherwise altering any property or facility, equipment, structures or natural features.
(14) 
Disturbing wildlife, unless part of an organized wildlife management program authorized by Edgmont Township or the Commonwealth of Pennsylvania.
(15) 
Overnight parking and camping.
(16) 
Solicitation, vending, advertising or sign posting.
(17) 
Disposition of cremated remains.
The rules and regulations described above shall be conspicuously posted at all Township nonrestricted property and facilities.
A. 
Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.

B. 
Nothing in this chapter shall act to prohibit the Township from proceeding simultaneously to enforce this chapter, at law or in equity, under any other state law, rule, regulation or ordinance or code of the Township.
