A.
From and after the effective date of this chapter, it shall be unlawful, except as specifically permitted in § 162-6, for any person to cause, or allow, an earth change within the Township without a permit from the Township secured pursuant to, and in accordance with, this chapter.
B.
The Township Board of Trustees shall determine whether to issue a
major excavation project permit, based upon the factors set forth
above.
No permit shall be required, pursuant to this chapter, if:
A.
The earth
change is confined to a residential building construction site of
one acre or less and is performed in conjunction with the immediate
use or development of the land upon which the earth change occurs;
B.
The earth
change is confined to a commercial or industrial building construction
site of one acre or less and is necessitated by the immediate use
or development of the land upon which the earth change occurs;
C.
The earth
change does not exceed a maximum volume of 600 cubic yards and is
not intended to become, and does not become, part of a larger earth
change project.
