This article shall be known and cited as the "Village of New Haven Recreational Marijuana Establishment Prohibition Ordinance."
This article is adopted pursuant to Public Act 3 of 1895,[1] as amended, and the Michigan Regulation and Taxation of Marihuana Act[2] (the "Act"), for the health, safety, and welfare of Village residents by prohibiting recreational marijuana establishments within the Village as provided for in the Act.

Pursuant to Section 6.1 of the Act,[1] the Village prohibits the establishment or operation of any and all categories of recreational marijuana establishments within its boundaries.

If any part of this article is held invalid or unconstitutional for any reason, the remaining parts of this article shall remain unaffected.
This article shall take effect 20 days after adoption by the Village Council, or immediately upon publication, whichever date occurs first.
