This article establishes the term for the appointed offices of Clerk-Treasurer and Deputy Clerk in the Village.

This article is adopted pursuant to Municipal Home Rule Law § 10, Subdivision 1(ii)a(1), that grants to local governments the authority to enact local laws regarding the qualifications of local officers, and the provisions of Municipal Home Rule Law § 10, Subdivision 1(ii)e(3) that grants to Villages the power to enact local laws which may override the provisions of Village Law with regard to governance matters.
The position of Village Clerk-Treasurer, when vacant, shall be filled by the appointment of the Mayor, subject to the approval of the Board of Trustees. The Village Clerk-Treasurer shall hold office for an indefinite term and may be removed for just cause upon recommendation of the Mayor and by a majority vote of the Board of Trustees.
The position of Deputy Clerk, when vacant, shall be filled by the appointment of the Mayor, subject to the approval of the Board of Trustees. The Deputy Clerk shall hold office for an indefinite term and may be removed for just cause upon recommendation of the Mayor and by a majority vote of the Board of Trustees.
If any clause, sentence, paragraph, word, section or part of this article shall be adjudged by any court of competent jurisdiction to be unconstitutional, illegal or invalid, such judgment shall not affect, impair or invalidate the remainder, thereof, but shall be confined in its operation of the clause, sentence, paragraph, worked section or part thereof directly involved in the controversy in which such judgment shall have been rendered.
This article shall take effect upon filing in the office of the Secretary of State.
