The Mayor, with the consent and approval of a majority of the members elected to the Board of Aldermen, shall appoint an attorney licensed to practice law in the State of Missouri as City Attorney. The City Attorney shall serve at the pleasure of the Mayor and the Board of Aldermen. The City Attorney may be, but is not required to be, the same attorney as appointed as City Prosecutor. The City Attorney may be an individual or a law firm; however, if a law firm is appointed, such firm shall designate, to the satisfaction of the Mayor and Board of Aldermen, one attorney to be the primary attorney. The City Attorney shall be compensated in accordance with a contract for professional services entered into between the City and such individual or law firm adopted by resolution.

A. 
It shall be the duty of the City Attorney to prosecute and defend all actions originating or pending in any court in this State to which the City is a party, or in which the interests of the City are involved. The City Attorney shall also perform all general legal services required on behalf of the City.
B. 
When the City Attorney shall deem it proper to take an appeal or to take any legal action in any case to which the City is a part or in which its interests are involved, he or she shall for that purpose for and on behalf of the City, make the necessary affidavits and execute all necessary papers. He or she shall report to the Mayor the action in each case, which shall be laid before the Council at the next regular meeting thereafter.
C. 
It shall be the duty of the City Attorney to attend all meetings of the Board of Aldermen unless excused by the Mayor.
D. 
It shall be the duty of the City Attorney to report to the Board of Aldermen any legal defects in City ordinances, and to give a written legal opinion upon any and all matters submitted to him or her by the Council upon matters pertaining to the City or the enforcement of its ordinances.

The City Prosecutor shall prosecute all persons charged with violating ordinances of the City; and, to that end, he or she shall attend the Circuit Court, Municipal Division, and prosecute all complaints and information that may be brought by the City therein; he or she shall also handle all appeals in which the City is a party arising from the Circuit Court, Municipal Division. The City Prosecutor shall perform such other duties as prescribed by State law.

In any suit or action at law or in equity brought by or against the City, except in prosecutions for violations of municipal ordinances, or for assistance with voluminous or complex legal matters affecting the City, the City Council may, by resolution, employ an attorney, other than the City Attorney, and pay him or her a reasonable fee for those services.
