In addition to the definition and word usage provided for in § 41-4, the following words and phrases shall have the specific definitions provided throughout this chapter:
An application for examination by the Commission as eligible
for appointment to the Police Force, as eligible for reinstatement
to the Police Force, or as eligible for promotion or commission.
The list submitted to the Board by the Commission of the
names of the three highest qualified candidates taken from an eligible
list.
The elected Chairman of the Pine Grove Civil Service Commission.
A person whose name is recorded on a current eligible list,
furlough list, or promotion list.
A list of names of persons who have passed the required Commission
examination, the physical examination, and has the other basic qualifications
for a position on the Police Force.
The list of names of persons temporarily laid off from positions
on the Police Force because of a reduction in the number of policemen.
A salary, wage rate, or range of salary or wage rate established
within ranks or differential of salary assigned to special duty categories.
A policeman on the Police Force who has been appointed from
an eligible list, but who has not yet completed his work-test, or
probationary, period.
A list of names of policemen on the Police Force who have
passed the required Commission examination and have fulfilled the
other basic requirements for promotion or commission.
The classification of a policeman which establishes his position
within the Police Force.
The combination of years of service, duty category, and special
duty categories which establishes a policeman's position among
policemen of the same rank.
A change to a different position within the Police Force
which may, or may not, result in a decrease in pay classification.
The permanent suspension of a policeman, a dismissal from
the Police Force.
The temporary separation of a policeman from his position
in the Police Force.
A shift or tour of duty; the time period, including any overtime,
established for a policeman to be on patrol or other duty assignment.
A.
All persons appointed, on the effective date of this chapter, to the Police Force, including part-time policemen, the Chief of Police, and regular or full-time policemen, shall continue to hold such appointment and position (consistent with the positions herein provided) and shall not be required to take any examination; except, such examination be required for promotion; and provided, however, that this section shall not be construed to persons employed other than as a policeman as defined in § 41-4E.
B.
The current Chief of Police shall hold the office of Police Chief,
be ranked as Sergeant, with appropriate rating, until otherwise qualified
for promotion; the current regular police officers shall be ranked
consistent with the provisions of this chapter according to their
time of service and training, with appropriate rating, until otherwise
qualified for promotion; and the current adjunct police officers shall
all be ranked as Adjunct First Class Officer, with appropriate ratings,
until otherwise qualified for promotion.

A.
No person shall be eligible to apply for examination unless he is
at least 18 years of age on the date of the examination. An applicant
need not be a resident of the Borough prior to appointment.
B.
All original appointments to any position on the Police Force, including
the Chief of Police and full-time police officers shall be:
(1)
For a probationary period of six months, at the conclusion of which
period the person appointed shall be permanently appointed; and
(2)
On the condition that, not later than the 30th day following the
effective date of permanent appointment, the person appointed shall
take up permanent residence within the Borough or within 25 air miles
from the Borough boundary line.
C.
No policeman shall continue to serve in a regular or commissional
position after reaching the age of 62 years; except, a person who
is over 62 years but less than 65 years may continue to so serve upon
application to the Commission and finding by the Commission based
on clear and convincing evidence, including annual medical reports
provided at the applicant's expense by the physician appointed
by the Commission to examine applicants, that such person is mentally
and physically capable of meeting the full responsibilities of his
regular or commissional position on a full-time bases.
D.
No policeman shall continue to serve in a part-time position as an auxiliary policeman after reaching the age of 70 years; provided, however, this shall only apply to service as a policeman as defined in § 41-4E.
F.
An adjunct police officer shall be exempt from the requirements of § 41-26B(2) of this chapter, which provision provides that a police officer within 30 days following the effective date of permanent appointment, which permanent appointment is to take place after a probationary period of six months following original appointment, shall take up permanent residence within the Borough or within five miles from the Borough borderline. By this exemption from the residency requirement sent out in § 41-26B(2) of this chapter, there is no intent to exempt an adjunct police officer from the requirements of serving a probationary period six months following original appointment as provided for in § 41-26B(1) of this chapter.

A.
To be eligible to have his name placed on the eligible list, a person
shall undergo a physical examination conducted under the supervision
of a physician appointed by the Commission and be certified by such
physician according to the provisions of § 1189 of the Borough
Code, as amended (8 Pa.C.S.A. § 1189).

B.
To be eligible to have his name placed on the eligible list, a person
shall be a citizen of the United States, shall have graduated from
an accredited high school or have an equivalent education, and shall
be licensed to operate a motor vehicle in the Commonwealth of Pennsylvania.
C.
To be eligible to have his name placed on the eligible list or the
promotion list, a person shall first file with the Commission the
appropriate formal application prescribed by the rules, regulations,
and standards promulgated by the Commission in which application the
applicant shall state under oath or affirmation:
(1)
His full name;
(2)
His residence or post office address;
(3)
His citizenship;
(4)
His place of birth;
(5)
His date of birth;
(6)
The condition of his health and physical capacity for public service;
(7)
His business or employment and residence for the past five years;
(8)
His record of military or naval service, including any such service
in the military police or shore patrol;
(9)
His prior service as a full-time or part-time employment as a policeman,
including any such service as a special policeman;
(10)
His education, including any police training; and
(11)
Such additional information as may be required by the Commission.
D.
To be eligible to have his name placed on the eligible list or the
promotion list, a person shall pass such examinations under the direction
of the Commission as may be provided in the rules, regulations, and
standards promulgated by the Commission consistent with § 1181
of the Borough Code, as amended (8 Pa.C.S.A. § 1181).

E.
In ranking persons who have passed such examinations as are provided for in Subsections A and C of this section the Commission shall assign weight to and consider each of the following in positioning the names of persons on the eligible list and the promotion list:
(1)
The grade above passing on the examinations herein above provided
for;
(2)
The progress made toward or beyond the course of study prescribed
for Police Training pursuant to Act of June 18, 1974, P.L. 359, No.
120, as amended (53 Pa.C.S.A. §§ 2161 through 2171
and 53 P.S. § 744);

(3)
Years of military or naval service;
(4)
Years of service in the military police or shore patrol while in
military or naval service;
(5)
Years of full-time service as a policeman and the positions in which
such service was performed;
(6)
Years of part-time service as a policeman;
(7)
Years of full-time or part-time service in law enforcement other
than as a full-time or part-time policeman;
(8)
Years of education, including particularly courses in police work,
law-enforcement, and related fields;
(9)
Applicable degrees from any reputable college or university; and
(10)
Special training in police or police related areas.
A.
Before any person appointed to the Police Force shall assume the
duties of the position of his appointment, he shall take an oath,
in writing, before a person authorized to administer oaths in the
Commonwealth as is required.
B.
While on duty, each member of the Police Force shall wear a shield
or badge with the word "Police" of such additional design and style
as may be required and shall wear such uniform as prescribed with
such insignia, patches, and markings as may be prescribed, including
appropriate insignia designating rank.
C.
Within one year from his initial appointment as a member of the Police
Force, a policeman shall complete the required course of police training
required under the Act of December 19, 1996, P.L. 1158, No. 177, as
amended (53 Pa.C.S.A. §§ 2161 through 2171 and 53 P.S.
§ 744). No person shall be permitted to receive a wage or
salary as a policeman after the date one year next following their
appointment until such time as the requirements of this subsection
are fulfilled.

D.
All members of the Police Force shall annually qualify with their
duty weapon. No person shall be permitted to receive a wage or salary
as a policeman after the date and time set by a qualified firearms
officer until such time as such person is qualified as required by
this subsection.
A.
The supervisor in charge of the Police Force, under the direction
of the Mayor, appointed by the elected Borough Council as Police Chief,
shall be the highest rated and ranked policeman in the Department
independent of such policeman pay classification, rank, or years of
service. In addition to the appointed rank of Police Chief, a person
holding such position shall be assigned a rank and pay classification
consistent with the overall design for the Police Force. Such supervisor
shall hold the rank of Chief of Police independent of the rank assigned
him, the pay classification he holds, his years of service, or the
fact that there are other members of the Police Force who hold a higher
position either by rank assigned, pay classification, or years of
service.
B.
In the temporary absence or incapacity of the appointed Police Chief
the member of the Police Force with the next highest rank and rating
shall be the acting Chief of Police. The officer in charge of a tour,
who shall be the highest rank and rating assigned to that tour, shall
for the duration of that tour, in the absence of the Police Chief,
be vested with all the authority, power, and duties of the Chief of
Police.
A.
The ranks of Captain and Lieutenant are established as commissioned
positions within the Police Force which may be held only by regular
policeman, or retired regular policeman serving as auxiliary policemen,
who have completed the required police training.
B.
In addition to such other requirements as may be established by rules,
regulations and standards hereafter established by the Commission,
these ranks shall have as a minimum qualification the following:
(1)
For Lieutenant, an associate degree from an accredited college or
university in police administration or equivalent education in police
administration, law, criminology, sociology, or psychology with a
minimum of three years progressive experience as a local, state or
federal law enforcement officer; or, a minimum of 15 years of service
as a regular policeman with at least five years as a Senior Sergeant.
(2)
For captain, a bachelors degree from an accredited college or university
in policy administration or equivalent education in police administration,
law, or criminology with a minimum of five years progressive experience
as a local, state or federal law enforcement officer.
C.
Within each commissioned rank pay classification may be established
by rules, regulations and standards promulgated by the Commission.
A.
The rank of Senior Sergeant, Sergeant, Auxiliary Sergeant, Corporal,
and Auxiliary Corporal are established as noncommissioned positions
within the Police Force. The ranks of Senior Sergeant, Sergeant, and
Corporal may be held only be regular policemen, or retired regular
policemen serving as auxiliary policemen, who have completed the required
police training. The rank of Auxiliary Sergeant may be held by an
auxiliary policeman who has completed the required police training;
and the rank of Auxiliary Corporal may be held by an auxiliary policeman
who qualifies as a policeman by having been appointed to the Police
Force prior to the effective date of Act of December 19, 1996, P.L.
1158, No. 177, as amended (53 Pa.C.S.A. §§ 2161 through
2171 and 53 P.S. § 744).

B.
In addition to such other requirements as may be established by rules,
regulations, and standards hereafter established by the Commission,
these ranks shall have as a minimum qualification the following:
(1)
For Auxiliary Corporal, a minimum of five years of service as an
auxiliary policeman with regular tours taken during each of those
years of service.
(2)
For Corporal, a minimum of one year of service as a regular policeman
or five years of service as an auxiliary policeman with regular tours
taken during the years of service as an auxiliary policeman, satisfactory
performance on an examination prescribed by the Commission or special
training, and completion of the required course of police training.
(3)
For Auxiliary Sergeant, a minimum of 15 years of service as an auxiliary
policeman with regular tours taken during each of these years of service,
or five years of service as a regular policeman, or an appropriate
combination of such service, satisfactory performance on an examination
prescribed by the Commission for Sergeant, and completion of the required
course of police training.
(4)
For Sergeant, a minimum of five years of service as a regular policeman
with at least one year of such service as a Corporal and satisfactory
performance on an examination prescribed by the Commission for Sergeant.
(5)
For Senior Sergeant, a minimum of 10 years of service as a regular
policeman with at least five years as a Sergeant and satisfactory
performance on an examination prescribed by the Commission for Senior
Sergeant.
C.
Within each noncommissioned rank pay classification may be established
by rules, regulations and standards promulgated by the Commission.
D.
Notwithstanding the differentials between auxiliary and regular policemen,
a retired or former regular policeman who continues on the Police
Force as an auxiliary policeman may hold his rank, or advance in rank
according to the established rules, regulations, and standards, holding
such rank as a brevet rank.
A.
The ranks of First Class Officer, Auxiliary First Class Officer,
Officer, Auxiliary Officer, and Probationer are established within
the Police Force. The rank of First Class Officer and Officer may
be held only by regular policemen; the rank of Auxiliary First Class
Officer and Auxiliary Officer may be held by an auxiliary policeman;
and the rank of Probationer shall be held by any policeman during
his period of probation.
(1)
A regular policeman shall automatically advance to the rank of First
Class Officer after one full year of service provided he has completed
the required police training course.
(2)
All adjunct police officers who have regularly taken tours of duty
for five years, and any adjunct police officer who has taken regular
tours of duty for two years and has completed the required police
training course, shall automatically advance to the rank of Adjunct
First Class Officer.

(3)
A regular policeman shall automatically advance to the rank of Officer,
for which there will be no distinctive insignia, upon satisfactorily
completing his probationary period of six months.
(4)
An adjunct police officer shall automatically advance to the rank
of Adjunct Officer, for which there will be no distinctive insignia,
upon satisfactory completion of his probationary period of six months.

(5)
All regular policeman and all auxiliary policeman during their probationary
period shall hold the rank of Probationer, for which there will be
no distinctive insignia.
B.
Within the ranks of First Class Officer and Auxiliary First Class
Officer pay classification may be established by rules, regulations
and standards promulgated by the Commission; in addition, two pay
classifications may be established for the ranking Auxiliary Officer/Probationer
and the ranking Officer/Probationer to distinguish policemen who have
completed the required police training from those who have not yet
completed such training.
A.
The Commission may devise a system of points for years of service
in the military or naval service, military police or shore patrol,
other local law enforcement service, state law enforcement service,
federal law enforcement service, years of service with regular tours
of duty as an auxiliary policeman, and years of service as a regular
policeman to distinguish policemen of the same rank by rating. Until
some alternate system is devised, the sum of the years of service
on the Police Force plus years of service as a regular policeman in
military or naval service, federal service, state service, or other
local service, shall determine rating; with each five years, with
regular tour of duty, of part-time service equal to one year of regular
service.
B.
A regular policeman of a given rank shall be deemed to hold a higher
rank than an auxiliary policeman with the same auxiliary rank as the
regular policeman independent of their respective ratings of each
policeman, except in the case of Probationer. (i.e., The order of
rank from highest to lowest is: Sergeant, Auxiliary Sergeant, Corporal,
Auxiliary Corporal, First Class Officer, Auxiliary First Class Officer,
Officer, Auxiliary Officer, Probationer.)

A.
Establishing of rules, regulations, and standards by the Borough
Council for such items as holidays, vacations, sick leave, other benefits,
and related items shall be as consistent with those applicable to
other Borough employees as is possible within the limits of law and
the particular circumstances, conditions, and duties under which members
of the Police Force perform.
B.
In the absence of any specific rules, regulations, and standards
on any specific matter for the Police Department, the relevant rules,
regulations, and standards applicable to other Borough employees shall
apply to members of the Police Force. Further, unless specifically
provided for in the Pine Grove Police Department Ordinance, as amended,
all currently applicable and effective ordinances, resolutions, and
policy shall continue to apply to the Police Force.
C.
The Mayor shall, from time to time, recommend to the Borough Council such rules, regulations, and standards for the Police Department for the Council's approval as he may deem appropriate. By written order, the Mayor shall provide for the rules, regulations, and standards related to designation of uniform, insignia, patches, and markings, including insignia designating rank, provided for in § 41-28B; and the Mayor shall have the authority, by written order, to modify same from time to time as appears appropriate in his sole discretion.
