In addition to the general collection regulations established in Articles II and III of this chapter, collection of yard waste shall be subject to the following:
A.Â
Collection standards.
(1)Â
Designated yard waste shall be placed entirely within a yard waste
container and shall not be placed in the street. If yard waste is
placed within the street and is not placed inside the yard waste container,
the responsible party must remove the yard waste from the street or
said party will be deemed in violation of this article.
(2)Â
Yard waste must be placed within and not exceed 50 pounds and the
height of the yard waste container. No bags shall be placed within
the yard waste container.
(3)Â
Yard waste which is designated for placement inside the yard waste
container but is placed along the curb and outside of the container
in a bag or in any receptacle other than the yard waste container
will not be collected by the Township.
B.Â
Bulk leaf collection.
(1)Â
Bulk leaves shall only be placed curbside and no more than 10 feet in depth during the collection periods established pursuant to § 235-14.
(2)Â
Bulk leaves shall be placed curbside and at least 10 feet from any
storm drain inlet. Leaves shall not be placed within the street. Leaves
shall be placed behind the curb no earlier than seven days before
the announced collection date. It is recommended that the leaves be
placed in the required location within a temporary fence corral which
is able to be easily disassembled by the collection crew for access
to the leaves.
(3)Â
Placement of leaves within the street at any time, or in any manner
other than specified herein, is a violation of this article. If leaves
are placed within the street, the responsible party must remove the
leaves from the street immediately upon notice from the Township or
said party shall be deemed in violation of this chapter.
C.Â
Township PIT. Only Township residents may drop off yard waste at
the Township PIT during normal operating hours. Yard waste which is
dropped off to the Public Works Department cannot contain grass clippings.
Prior to dropoff, the resident must have the yard waste inspected
and approved for dropoff by the Public Works staff.
In addition to the general collection regulations established in Articles II and III of this chapter, collection of bulky waste shall be subject to the following additional collection standards:
A.Â
Bulky waste shall be placed curbside for collection and shall not
be placed in the street. If bulky waste is placed within the street
and is not placed curbside, the responsible party must remove the
bulky waste from the street or said party will be deemed to be in
violation of this article.
B.Â
No bulky items placed for collection shall be of any weight and/or
size which is greater than can be conveniently and safely handled
by two persons.
C.Â
Bulky waste shall be placed in a neat and orderly manner and no closer
than three feet to any cart, container or receptacle.
A.Â
The owner, agent, lessee, tenant or occupant of any property listed below shall arrange for the removal of the substance and/or materials herein referred to in § 235-18A and B from such premises each and every business day, unless sufficient and suitable facilities are provided and used for the storage thereof or until removal from the premises. Collection and disposal as well as any and all tipping fees are to be the sole responsibility of the property owner, lessee, tenant or occupant. Receptacles shall be conveniently located on the premises for the storage of the substances and/or materials referred to in this article and shall be maintained in such manner as to prevent the creation of a nuisance or menace to health. In all instances of combination use where the commercial entity is in a separate building, the two shall be treated as separate uses, with the commercial entity being treated as Subsection A(1) below.

All nonresidential commercial properties.
(2)Â
Combination residential/commercial properties shall only have the
residential nonrecyclable solid waste and recyclable solid waste removed
in accordance with the requirements of this article. Commercial solid
waste shall not in any manner be comingled with the residential solid
waste being removed.
(3)Â
All religious and nonreligious places of worship and associated buildings.
(4)Â
All other tax-exempt properties.
B.Â
Each aforesaid generator shall bear responsibility for the proper
disposition of recyclables, even though said generator may contract
with another party for disposition. Each generator shall submit to
the Waterford Township Recycling Coordinator, by the first of February
of each year, documentation verifying the previous year's total recycling,
expressed in either weight or cubic yardage.
C.Â
Documentation shall take the form of letters verifying weight of
volumes issued by the receptor to the generator of the recycled materials.
Weight slips or volume receipts or paid invoices must be maintained
by the generator and/or receptor for inspection of requested by this
municipality, county or state.
A.Â
The Mayor and Township Committee shall have the right and power by resolution to grant the exclusive privilege of collecting and transporting recyclable and nonrecyclable solid waste from those property classifications not specifically excluded in § 235-20 within the corporate limits of the Township of Waterford, in the County of Camden, State of New Jersey, or otherwise provide therefor.
B.Â
All nonrecyclable solid waste collected within the Township of Waterford
and disposed of by the Township or its representative shall be done
in accordance with the sanitary landfill or incinerator method in
accordance with the standards for the design, operation and maintenance
of sanitary landfills and incinerators contained in Chapter VII of
the State Sanitary Code. Three copies of said Chapter VII of the State
Sanitary Code shall be kept on file with the Township Clerk.
It shall be unlawful for any person, resident or nonresident,
to dump any matter, other than that which is permitted, in any location
of the Township other than where approved by the appropriate sections
of the Code or otherwise approved by the Township Committee.
A.Â
Any person who owns, leases or otherwise uses a refuse container
or dumpster shall ensure that such container or dumpster is covered
at all times and shall prevent refuse from spilling out or overflowing
onto the ground.
B.Â
Any person who owns, leases or otherwise uses a refuse container
or dumpster shall ensure that such container or dumpster does not
leak or otherwise discharge liquids, semi-liquids or solids on the
ground or into the municipal storm sewer system(s) operated by the
Township of Waterford.
The collection and removal thereof shall be under the general
supervision of the Public Works Manager and shall be performed in
a proper and orderly fashion for the safety, health and welfare of
its residents. It is anticipated that occasional and minor breaches
or violations may occur. Since these are incapable of prompt and reasonable
calculations, the following stipulated penalties and damages, whose
determination and certification shall be final unless reversed by
the Township Committee, shall apply. The Public Works Manager and/or
the Township Administrator shall notify the collector of such violations
when convenient and susceptible of immediate correction otherwise;
the Township shall deduct the same from the next payment to the solid
waste contractor.
A.Â
Failure of truck and a crew to operate and finish a regular route:
$250 per day in which noncollection takes place, plus the sum of $200
per day for each vehicle hired or used by the Township for the purpose
of performing the collections service which the solid waste contractor
has failed to perform, and plus the sum of $85 per day for each person
used or employed, including Township employees assigned to the performance
of this service.
B.Â
Failure to make any collection on any one collection day: The solid
waste contractor shall pay the Township $250 for each day in which
noncollection takes place, plus the sum of $200 per day for each vehicle
hired or used by the Township for the purpose of performing the collection
service which the solid waste contractor has failed to perform, and
also plus the sum of $125 per day for each person used or employed,
including Township employees assigned to the performance of this service.
C.Â
Trucks in leaking or unsanitary conditions: $200 for each offense.
D.Â
Permanent containers or receptacle damaged or carried away, failure
to replace within three days: $30 for each.
E.Â
Failure of truck and crew to follow prescribed route: $100 for each
violation.
F.Â
Failure to clean spilled materials, such as fallen glass, cans, debris,
etc.: $100 for each occasion.
G.Â
Failure to operate stated equipment or vehicles as specified in the
section titled "Equipment and personnel": $200 for each violation.
H.Â
Failure to replace cans as specified in the section titled "Replacement
of trash containers": $50 for each violation.
I.Â
For transferring solid waste from vehicle to vehicle: $25 for each
occurrence.
J.Â
For failure to maintain radio communication between supervisors and
employees during the required hours: $25 for each truck for each such
violation.
K.Â
For failure to answer a complaint pertaining to problems concerning
collection of solid waste within four hours of receipt of the complaint:
$50.
