1. 
On the following bridges and streets or parts of streets, by authority granted by Section 4902(a) of the Vehicle Code, 75 Pa.C.S.A. § 4902(a), it shall be unlawful for any person or persons to drive any vehicle or combination having a gross weight in excess of the maximum prescribed below for that bridge or street or part of street, as the case may be:

Any person who violates any provision of this section shall be prosecuted under Sections 4902(a) and 4902(g-1) of the Vehicle Code, 75 Pa.C.S.A. §§ 4902(a), 4902(g-1) and, upon conviction, shall be sentenced to pay a fine of $150 plus $150 for each 500 pounds, or part thereof, in excess of 3,000 pounds over the maximum allowable weight, and costs.

Any person who violates any provision of this section shall be prosecuted under Sections 4902(a) and 4902(g)(1) of the Vehicle Code, 75 Pa.C.S.A. §§ 4902(a), 4902(g)(1) and, upon conviction, shall be sentenced to pay a fine of $75 and costs.

By reason of hazardous traffic conditions and other safety factors, by authority granted by Section 4902(b) of the Vehicle Code 75 Pa.C.S.A. § 4902(b), it shall be unlawful for any person to drive any vehicle or combination in violation of the restriction prescribed below for that bridge or street or part of street.

Any person who violates any provision of this section shall be prosecuted under Sections 4902(b) and 4902(g)(2) of the Vehicle Code, 75 Pa.C.S.A. §§ 4902(b), 4902(g)(2), and, upon conviction, shall be sentenced to pay a fine of not more than $500 and costs.

It shall be unlawful for any person to drive a vehicle other than a passenger car on any of the following streets or parts of streets, provided, nothing in this section shall prohibit any person from driving an emergency vehicle on any of those streets or parts of streets, or from driving on any of those streets or parts of streets a truck or other commercial vehicle making local deliveries to or pickups from premises located along that street or part of a street.

Any person who violates any provision of this section, upon conviction, shall be sentenced to pay a fine of $25 and costs.

1. 
Title. This section shall be known and may be cited as the "Northampton Township Engine Brake Retarder Section of 2016."
2. 
Authority. This section is established pursuant to the policy established by the Pennsylvania Department of Transportation (PennDOT) regarding engine brake retarder prohibitions. A study has been performed pursuant to said procedure for each location where the use of engine brake retarders is prohibited.
3. 
Findings. The Board of Supervisors of the Township of Northampton finds it a fact that the operation of an engine brake retarder on a gasoline-powered or diesel-powered motor vehicle creates an excessive noise that adversely affects the public health, safety, and welfare of the residents of the Township and is a nuisance in fact.
4. 
Engine Brake Retarders Prohibited on Certain Streets. No person shall operate, or allow to be operated, a vehicle powered by an internal combustion engine, on the public ways, as defined in this section, within the Township of Northampton while utilizing in said operation an engine brake retarder on any of the following streets or parts of streets:

5. 
Emergency Situations. This section shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of the residents of the Township of Northampton, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situations.
6. 
Posting of Signs. Pursuant to the procedures of the Commonwealth of Pennsylvania, Department of Transportation, and pursuant to regulations of the Department with respect to signs on highways, the Township of Northampton shall cause to be erected upon the roadways herein specified signs regarding the prohibition of the use of said engine brake retarders on the designated highways.
7. 
Penalties. Any person, firm, corporation or organization violating any of the provisions of this section shall pay a fine of $100 for the first offense, $200 for the second offense, and $300 for the third and subsequent offenses.
