A.
Statement of purpose. The Borough finds and declares that the operation
of motor vehicles upon public streets and roadways during flooding
conditions can create a wake which carries beyond the street or curbline
causing damage to adjacent properties. The purpose of this chapter
is to protect the property of the Borough and its citizens by regulating
the manner of operation of motor vehicles driven upon the public streets
and roadways of the Borough during flooding conditions.
B.
Prohibited operation. No motor vehicle shall be operated on any public
street or roadway within the Borough where flooding exists in a manner
as to cast or discharge a wave which carries beyond the edge of the
street or curbline. For the purpose of this chapter flooding shall
mean the existence of water on the surface of the center line of the
roadway which exceeds six inches in depth.
Any person violating or failing to comply with any other provision
of this article shall, upon conviction thereof, be punishable by a
fine of no less than $100 and no more than $1,000, by imprisonment
not to exceed 90 days or by community service of not more than 90
days, or any combination of fine, imprisonment and community service,
as determined in the discretion of the Municipal Court Judge. The
continuation of such violation for each successive day shall constitute
a separate offense, and the person or persons allowing or permitting
the continuation of the violation may be punished as provided above
for each separate offense.
