A. 
There is hereby created for the Town of Fabius the office of Constable for the sole and exclusive purpose of enforcing both Article 26 and Article 7 of the Agricultural Markets Law of the State of New York relative to the control of animals and dogs within the Town of Fabius.
B. 
The office of Town Constable as described herein shall be filled by appointment of the Town Board of the Town of Fabius. Any appointee to the office shall serve at the pleasure of the Town Board of the Town of Fabius and at a salary to be established by the Town Board from time to time.
Pursuant to the authority of the Municipal Home Rule Law § 10(a)(d)(3), the provisions of Town Law § 39 are modified and superseded in its application to the Town of Fabius so as to limit the office of Constable to the performance of only those duties herein defined.
This chapter shall take effect immediately.

Section 23 of the Town Law and § 3 of the Public Officers Law are hereby amended and superseded in their application to the Town of Fabius to provide that, notwithstanding the provisions of any general or special law of the State of New York, the Building Inspector for the Town of Fabius may reside in the County of Onondaga or in a county adjoining Onondaga County.
