Section 520.110 Definition.

For the purposes of this Article, the word "Board" shall mean the Electrical Wiring Board created herein.

Section 520.120 Created.

There is hereby created a board for the examination of electricians within the City, which board shall be known as the Electrical Wiring Board.

Section 520.130 Composition of Board.

A. The Board shall be composed of five (5) members. Two (2) members shall be licensed master electricians; one member shall be an electrical engineer; one member shall be a representative of the Electric Department selected by the City Manager; and one member shall be a member of the interested general public.

B. In addition to the five (5) regular members, an alternate member shall be appointed to serve only if a quorum cannot be established for any meeting of the Board. Said alternate shall be a member of the interested general public.

C. The residential requirements for membership for said board, including any alternate, shall be identical to those for employees of the City of Poplar Bluff.

Section 520.140 Appointment of Members.

The members of the Board shall be appointed by the City Manager.

Section 520.150 Terms of Members.

The members of the Board shall serve for terms of three (3) years each. Members shall be expected to attend all meetings of the Board and any Board member who shall fail to attend three (3) or more meetings in one (1) year shall be subject to immediate removal by the City Manager.

Section 520.160 Filling of Vacancies on the Board.

If for any reason a vacancy occurs on said Board, the City Manager shall appoint a new member for the unexpired term.

Section 520.170 Approval of Electricians.

It shall be the duty of the Board to approve all persons engaged in the electrical business as master electricians and journeyman electricians in the City.

Section 520.180 Examination Dates.

The Board shall work with the independent testing agency to provide testing dates for those desiring to take the licensing exams.

Part 2 Licenses [1]

Section 520.190 Required.

It shall be unlawful for any person to engage in business or work as a master electrician or journeyman electrician within the City without first having obtained a license therefore. Failure to obtain a proper license may result in penalties as stated in Section 100.150 of the City Code.

Section 520.200 When License Not Required.

Any individual desiring to perform his/her own electrical work personally on residential property owned and occupied by him/her shall not be required to make the required bond or to obtain the required license, but shall be required to obtain the regular electrical work permit for that particular job. Such work on by an individual must be done by him/her personally on his/her own particular job and not be a way of performing a service to the public generally.

Section 520.210 Application.

A. Any person desiring the master or journeyman electrician's license shall make application in writing to the City Electrical Wiring Board requesting an examination covering said certificate.

B. Any person desiring a journeyman license shall present documented proof of experience as an apprentice electrician under the supervision of a master electrician for a period of four (4) years as a prerequisite for taking the examination.

C. Any person desiring a master electrician's license shall have four (4) years' documented experience under the supervision of a master electrician while maintaining a license as a journeyman electrician as a prerequisite for taking the examination.

D. Any master electrician desiring to hire people as apprentice electricians shall obtain an apprentice card from the Electrical Inspector's office. Said apprentice cards are to be kept current by the master electrician as a means to document electrical work experience.

E. Documented military experience, trade school courses in education, and undergraduate and graduate degrees may be taken in lieu of the period of experience referenced to hereinabove, if, in the opinion of the City Electrical Board, such experience, education or degree is equivalent to the period of years experience required hereunder. The application shall be accompanied by fees as hereinafter provided.

Section 520.220 Examination Required.

Written examination shall be given the applicant for a license by this Part 2 of Article III of Chapter 520 of this Code, within thirty (30) days after filing application or as soon thereafter as possible. A grade of seventy percent (70%) shall be the lowest passing grade. Examination scores shall be reviewed by the Electrical Board and the applicant shall be notified of the results of same within ten (10) days after the Board reviews the scores at their next regularly scheduled meeting. Applicants failing in the first (1st) examination shall not be re-examined until the next available testing date. Applicants will be allowed to take the test three (3) times in a twelve (12) month period of time.

Section 520.230 Fees.

A. The following fees shall be charged for the examination of applicants and the issuance of licenses under the provisions of this Part 2 of Article III of Chapter 520 of this Code:

Section 520.240 Time Lapse Between Examination and Issuance.

After a person has passed the electrician's examination and the Electrical Wiring Board has verified the score as meeting its requirements, the person must be notified in writing of this fact. The applicant then must obtain a license within sixty (60) days from the date the Board verified the passing score or take the examination over.

Section 520.250 Issuance.

Whenever a person shall successfully pass the examination prescribed by the Board for an electrician's license and the Board verifies the score, the Building Inspector's office shall issue to such person the appropriate electrician's license.

Section 520.260 Bond Required.

Every person doing electrical business in the City shall execute and deliver to the City a bond with a surety bonding company in the sum of three thousand dollars ($3,000.00) to indemnify the City or any citizen for any damage caused by the failure of such person doing the electrical work to comply strictly with the provisions of this Chapter.

Section 520.265 Electrical Licensing Continuing Education Requirements.

A. Continuing Education.

1. No journeyman electrician license or master electrician license shall be renewed unless the licensee completes at least two (2) hours of continuing education for a one-year license renewal, and six (6) hours for a three-year license renewal from the date of the licensee's last renewal.

2. Three-year licensees whose license expires in less than three (3) years from the effective date of these requirements shall be required to complete two (2) hours of continuing education with one (1) year remaining prior to license renewal, and four (4) hours with two (2) years remaining prior to license renewal.

3. A one-year licensee may carry over a maximum of four (4) hours for a period of two (2) years.

4. Continuing education shall consist of classroom or online instruction relating specifically to the edition of the National Electrical Code currently adopted by the City of Poplar Bluff or a more recent edition.

5. The same course shall not be repeated for a period of three (3) years.

B. Approved Continuing Education Hours.

1. Continuing education programs and courses shall be subject to approval by the City of Poplar Bluff Electrical Board to determine whether it provides appropriate and adequate NEC instruction.

2. Continuing education programs and courses relating to the NEC that are approved by other governmental jurisdictions, that require continuing education for electrical licensing renewal, shall be accepted by the City of Poplar Bluff Electrical Board.

C. Documentation.

1. Upon completion of an approved course, the course provider shall provide the student a certificate of completion indicating the following:

a. Name of course provider.

b. Title of course.

c. Name of student.

d. Date of course.

2. The certificate of completion(s) shall be submitted to the City of Poplar Bluff Building Inspections Office at time of renewal request for journeyman or master electrician license.

D. Failure To Complete Continuing Education Hours.

1. If any licensee fails to complete the required continuing education hours, as approved by the City of Poplar Bluff Electrical Board, prior to expiration of the current license, the licensee may obtain the required continuing education hours within ninety (90) days without being subject to examination requirements or civil penalties for performing unlicensed electrical work.

2. If the licensee fails to obtain the required hours within this ninety-day period, the licensee shall be required to pass the electrical examination required for a current license within one (1) year from the date of the license renewal.

3. The licensee shall be required to submit an application to the City of Poplar Bluff Electrical Board requesting approval to test for an electrical license if the licensee fails to complete the required continuing education hours as described above, and fails to pass the electrical examination as required above in said time period.

E. Effective Date. The effective date for these requirements shall be January 1, 2020.

Section 520.270 Suspension, Revocation.

A. The Electrical Inspector and/or the Board shall have the right and authority to suspend the license of any master or journeyman electrician upon the violation of any portion of this Chapter and the Electrical Inspector shall, upon suspension, file with the Electrical Board a statement setting forth the reasons for such suspension. A copy of such report shall be given the suspended electrician upon his/her request.

B. If the electrician feels aggrieved by such suspension, then he/she may notify the Electrical Board in writing of his/her feelings and may appear and be heard by the Electrical Board.

C. If, upon a full hearing by the Electrical Board, it is determined by the Board that such suspension is well founded, then the electrician's license will be revoked and the City Attorney shall be directed to take such action as may be necessary to forfeit the bond of such electrician.

D. In the event the suspended electrician fails or refuses to appeal to the Electrical Board within ten (10) days, the City Clerk shall place before the City Council the Electrical Inspector's report. It shall then be the duty of said City Council to revoke the suspension order or revoke the license and forfeit the bonds as aforesaid.

E. The City Clerk shall not issue a master or journeyman electrician's license to any previous holder or a revoked license, except upon a new application approved by the Board after a three (3) month waiting period.

Section 520.280 Inactive Status.

A person who has successfully passed the electrician's examination referred to in Section 520.220 and who presently holds a valid master electrician's license or journeyman electrician's license may apply to the Electrical Wiring Board for inactive status. In the event that the Electrical Wiring Board grants to said person such status, said person may, within a period not to exceed five (5) years from the date such status is granted, reapply to the Electrical Wiring Board, in writing, for a master electrician's license or journeyman electrician's license without being re-examined as provided in Section 520.220. At such time as the Board terminates the inactive status and the master electrician's license or journeyman electrician's license is renewed, said person shall pay the license fee and provide the bond and meet all other requirements referred to in this Chapter.

Section 520.290 Expiration — Penalties.

Every license issued under the provisions of this Chapter shall expire on the thirty-first (31st) day of December of the expiration year. Each license shall be delinquent on the following January first (1st) and failure to renew said license shall result in the imposition of a penalty of ten percent (10%) of the license fee for each month thereafter that the license is not renewed. Said penalty shall accrue for a period of three (3) months; provided that if the license has not been renewed after such period, the written examination must be retaken. No electrical permits may be obtained by a master electrician with an expired license.
