Editor's Note: This ordinance also repealed former Ch. 62,
Department of Public Works, adopted 7-8-1976 as Section 2-12 of the
Revised General Ordinances of 1975, as amended.
The Department of Public Works for the Borough of Palisades
Park shall include the following divisions:
A.
Director of Public Works.
(1)
Position. The position of Director of Public Works is hereby established,
who shall be appointed by the Mayor and Council. The Director of the
Department of Public Works shall serve as the Borough's Principal
Public Works Manager pursuant to N.J.S.A. 40A:9-154.6(a)(e).
(2)
Duties. The Director of Public Works shall be in administrative control
of the Department of Public Works and shall direct and supervise Superintendents,
Deputy Superintendents, and all other personnel as the department
may employ. He/she shall perform administrative duties and planning
relating to the installation, maintenance, and repair of public works
facilities, planning, organizing and directing all programs related
to Borough public works activity, and shall direct the subordinate
employees of the Department for the purpose of carrying on and performing
the work of the Department. It shall be the duty of the Director to
establish and maintain a budget for the Department of Public Works.
(3)
Qualifications. No person shall be appointed as Director of the Department
of Public Works unless:
(a)
They are a citizen of the United States and of the State of
New Jersey.
(b)
They shall possess a valid New Jersey driver's license.
(c)
They shall possess a Certified Public Works Manager certificate
in accordance with the requirements of N.J.S.A. 40A:9-154.6a(g).
(d)
The Director of the Department of Public Works shall be a person
qualified by education, training, and experience to perform the duties
of office hereinafter set forth. No person having less than 10n years
of direct experience in the field of municipal public works, including
at least five years of supervisory experience in the same field, shall
be eligible to hold this office.
(4)
Compensation. Compensation for the Director of the Department of
Public Works shall be set forth in the Annual Salary Ordinance.
(5)
The term of this office shall be five years.
(6)
Tenure eligibility. The Director of Public Works serving the Borough
of Palisades Park in the capacity as the officer or employee of a
municipality whose duties include supervising the care and maintenance
of streets, roads, avenues, public buildings, public places, sewers
and motor vehicles of the municipality, notwithstanding the job title
given, shall be eligible for the right of tenure as specifically described
in N.J.S.A. 40A:9-l 54.6.B. This provision shall be applied retroactively
for present employees.
(a)
Has held a public works management position within the Borough
for a period of five years; and

Satisfy the criteria to be Principal Public Works Manager and
meet the requirements of N.J.S.A. 40A:9-154.6a.
(b)
Hold and maintain a public works manager's certificate
as defined by N.J.S.A. 40A:9-154.6(c); and

Said person shall acquire the right of tenure as Director of
Public Works and shall, upon meeting the requirements above, retain
that right until he attains the age of 70, after which should he continue
to serve the Borough of Palisades Park he or she shall resume employment
as an employee-at-will and may be removed from the position of Director
of Public Works at the discretion of the Mayor and Council.

Said person shall remain as the tenured Director of Public Works
so long as he serves the Borough of Palisades Park as the Director/Principal
Public Works Manager, or is otherwise removed from the position of
Director of Public Works, for good cause, based upon written charges
filed with the Borough Clerk and after a public, fair and impartial
hearing before the Mayor and Council, until he or she attains the
age of 70 years.
B.
All other employees.
(1)
Position. The Department of Public Works shall employ such personnel
as deemed necessary to effectively operate said department in the
Annual Salary Ordinance.
(2)
Qualifications. Drivers shall, at all times during their employment,
possess a valid New Jersey motor vehicle operator's license entitling
them to operate motor trucks of the size and capacity which may be
used in the operation of the Department.
(3)
Duties. It shall be the duty of all operational personnel to perform
such duties as may be assigned to them by the Director of Public Works
or the Superintendent of the division to which they are assigned.
(4)
Snow operations and any other natural events or disasters. All Department
of Public Works employees are required and expected to report for
snow, natural events or disasters operations.
(5)
Compensation. Compensation shall be in accordance with the Annual
Salary Ordinance and in accordance with the employees' labor
union contract.
The employees of the Department of Public Works shall be subject
to such rules and regulations as may be established by the Director
of Public Works, with the approval of the Mayor and Council and the
Borough's Policy and Procedure Manual.
