No person shall throw or deposit any commercial or noncommercial handbill in or upon any sidewalk, street or other public place in the City of Orange Township. It shall, however, not be unlawful for any person to hand out or distribute any noncommercial or commercial handbill on any sidewalk or street without charge to receiver if that person is willing to accept same.
No person shall throw, deposit or distribute any commercial or noncommercial handbill in or upon private premises except by handing or transmitting any such handbill directly to the owner, occupant or other person then present in or upon such private premises. In the case of an inhabited premises, the owner thereof shall have the authority to consent to the placement or deposit of a handbill in or upon his/her premises only if such was placed or deposited as to recuse or prevent such material from being blown or drifted about on the premises, sidewalks or streets. Mailboxes may not be used when so prohibited by federal law.
Any violation of this Article shall subject the violator to a fine not to exceed five hundred dollars ($500.). Such fine may be imposed for each separate day of the violation.
The Chief of Police is hereby authorized and empowered to abate or cause to be abated any nuisance as described in § 43-4 by the removal, destruction or confiscation of any such poster, reading matter, print, picture, illustration or sign so designated and determined to be a nuisance.
