Editor's Note: Pursuant to the provisions of N.J.S.A. 52:27D-142
et seq., a State Uniform Fire Safety Code is applicable in the Borough
of Roseland. The Borough has the authority to adopt more stringent
requirements and to elect to enforce the provisions of the State Code
locally or through State Inspectors.

Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c. 383) the New Jersey Uniform Fire Code shall be locally enforced
in the Borough of Roseland.

The local enforcing agency shall be the Bureau of Fire Prevention
of the Borough of Roseland.

The Bureau of Fire Prevention shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the Borough,
other than owner-occupied one- and two-family dwellings, and shall
faithfully comply with the requirements of the Uniform Fire Safety
Act and the Uniform Fire Code.

The periodic inspections of the life hazard uses required by
the Uniform Fire Code shall be carried out by the Borough of Roseland
Fire Prevention Bureau.

a.
Appointment of Fire Official. The Bureau of Fire Prevention shall
be under the supervision of a Fire Official who shall be appointed
by the Mayor, with the advice and consent of the Borough Council.
b.
Duties. The Fire Official shall perform such duties assigned to him
by any resolution or ordinance of the Borough Council. The Fire Official
shall be primarily responsible for enforcing the Uniform Fire Safety
Act and the Fire Prevention Code as set forth herein.
The Fire Official shall make an annual report to the Mayor and
Borough Council and to the Borough Administrator. The report shall
contain all the proceedings under this section with any statistics
which the Fire Official may wish to include. The Fire Official shall
also recommend any amendments to the Fire Prevention Code which in
his judgment shall be desirable.
c.
Term of Office. The Fire Official shall serve for a term of one (1)
year. Any vacancy shall be filled by the Mayor with the advice and
consent of the Borough Council for the unexpired term.
d.
Inspectors and Employees. Such inspectors and other employees as
may be necessary in the Bureau of Fire Prevention shall be appointed
by the Mayor with the advice and consent of the Borough Council upon
the recommendation of the Fire Official.
e.
Removal from Office. Inspectors and other employees of the Bureau
of Fire Prevention shall be subject to removal by the Fire Official
for inefficiency or misconduct. Each inspector or employee to be so
removed shall be afforded an opportunity to be heard by the appointing
authority or a designated hearing officer.

Pursuant to Sections 15 and 17 of the Uniform Safety Act, any
person aggrieved by any order of the Bureau of Fire Prevention shall
have the right to appeal to the Construction Board of Appeals of Essex
County.

Permits are further required to be obtained from the Bureau
of Fire Prevention for the following activities at the amount specified
for each herein:
a.
A Type 1 permit is required for a tent or air-supported structure
nine hundred (900) square feet or larger which is intended to be used
by ten (10) or more persons. The permit application shall be accompanied
by a fee of fifty-two ($52.00) dollars and such plans and specifications
as outlined in the "Specifications for Tents and Air Supported Structures,"
adopted by the Bureau of Fire Prevention and on file in the Bureau
of Fire Prevention Office.
b.
A permit is required for all stationary tanks, aboveground or underground
for the storage of flammable or combustible liquids or for placing
any flammable or combustible liquid stationary tank temporarily or
permanently out of service and to place the tank back into service.
The permit application shall be accompanied by a fee of fifty-two
($52.00) dollars.
c.
The owner of all businesses, occupancies, buildings, structures or
premises required to be inspected under the Uniform Fire Code shall
apply annually to the local enforcement agency for a certificate of
Non-Life Hazard Business Registration upon forms provided by the Fire
Marshal/Fire Official. It shall be a violation of this chapter for
an owner to fail to return such forms to the local enforcement agency
and/or Fire Marshal/Fire Official within thirty (30) days of receipt.
If ownership is transferred, whether by sale, assignment, gift, intestate
succession, devise, reorganization, receivership, foreclosure, execution
process or any other method, the new owner shall file with the local
enforcement agency an application for a certificate of registration,
pursuant to this subsection, after notification by the local enforcement
agency and/or Fire Marshall/Fire Official.
d.
The non-life hazard registration fees established by the Fire Prevention
Bureau shall be as follows:
1.
Business occupancies, buildings or structures up to two hundred fifty
(250) square feet of occupied space: thirty ($30.00) dollars.
2.
Business occupancies, buildings or structures between two hundred
fifty-one (251) square feet and nine hundred ninety-nine (999) square
feet of occupied space: fifty ($50.00) dollars.
3.
Business occupancies, buildings or structures between one thousand
(1,000) square feet and four thousand nine hundred ninety-nine (4,999)
square feet of occupied space: eighty ($80.00) dollars.
4.
Business occupancies, buildings or structures between five thousand
(5,000) square feet and nine thousand nine hundred ninety-nine (9,999)
square feet of occupied space: one hundred thirty ($130.00) dollars.
5.
Business occupancies, buildings or structures between ten thousand
(10,000) square feet and fourteen thousand nine hundred ninety-nine
(14,999) square feet of occupied space: two hundred fifty ($250.00)
dollars.
6.
Business occupancies, buildings or structures between fifteen thousand
(15,000) square feet and twenty-nine thousand nine hundred ninety-nine
(29,999) square feet of occupied space: three hundred seventy ($370.00)
dollars.
7.
Business occupancies, buildings or structures between thirty thousand
(30,000) square feet and seventy-four thousand nine hundred ninety-nine
(74,999) square feet of occupied space: five hundred ($500.00) dollars.
8.
Business occupancies, buildings or structures between seventy-five
thousand (75,000) square feet and ninety-nine thousand nine hundred
ninety-nine (99,999) square feet of occupied space: seven hundred
fifty ($750.00) dollars.
9.
Business occupancies, buildings or structures between one hundred
thousand (100,000) square feet and two hundred fifty thousand (250,000)
square feet of occupied space: one thousand ($1,000.00) dollars.
10.
Business occupancies, buildings or structures over two hundred fifty
thousand (250,000) square feet will be charged eighty ($80.00) dollars
for each five thousand (5,000) square feet or part thereof over initial
two hundred fifty thousand (250,000) square foot fees.
This subsection shall take effect January 1, 2011.

Pursuant to the authority of N.J.S.A. 40:48-2.46, the areas
designated below are hereby designated as no stopping or standing
fire zones. No person shall stop or stand a vehicle within such designated
fire zone. The fine for a person stopping or standing a vehicle in
a designated fire zone is eighty ($80.00) dollars.

The Governing Body of the Borough of Roseland finds that in
order to better protect the property and welfare of certain businesses,
business patrons and Fire Department members, a uniform system for
rapid entry into certain buildings in the event of a report of a fire
emergency is required. Such rapid entry will be made via key boxes
as set forth in this section.

shall mean a steel box which is treated to be both fire and
weather-resistant, installed on the outside of the building and contains
all necessary keys which are updated and labeled and which provide
access to the building as required by this section.
shall mean the owner, occupant and/or tenant of the building
structure responsible for compliance with the provisions of this section.

All structures or buildings other than residential properties,
which are connected to a central station alarm monitoring system shall
be required to have a key box installed unless specifically exempted
by this section.

This section shall not apply to the following buildings or structures:
a.
Buildings or structures over which the Federal government has jurisdiction
including but not limited to the United States Post Office and banks.
b.
Residential homes and storage sheds.
c.
Facilities containing an inventory of prescription medications.
d.
Any building or structure that is staffed twenty-four (24) hours
for every day of the week.
e.
Any building or structure staffed with a security person on the premises
twenty-four (24) hours for every day of the week.
f.
Mausoleums.
g.
Property owned by the Borough.

a.
Type. The key box will be purchased and installed by, and at the
expense of the owner or occupant of the building and will be of a
type approved by the Borough Fire Official. Each key box shall be
of sufficient size and configuration to allow the required contents
set forth in paragraph c. to be conveniently stored therein. In order
to assure acceptability of the key box chosen, the responsible party
of each nonexempt building or structure shall receive approval from
the Borough Fire Official as to the size, configuration and location
of the proposed key box.
b.
Location. Each key box shall be permanently mounted into the structure
or building and shall be accessible from outside the structure or
building.
c.
Contents. The key box will contain updated keys which provide access
to the building or structure and each locked area within the building
or structure. Sprinkler and elevator keys will also be provided. Each
key shall be separated and clearly labeled for each locked area (for
example, boiler rooms, etc.). Any change in key shall be provided
to the key box within thirty-six (36) hours of such change. Additionally,
information concerning any hazardous materials contained within the
building or structure, and a designation as to which part of the building
or structure contains such substances, shall also be maintained in
the key box.

a.
If the provisions of this section become applicable to a building
or structure due to a change in ownership, occupant, or otherwise,
the responsible party shall notify the Fire Prevention Bureau within
thirty-six (36) hours by certified mail from the date the provision
of this section became applicable.
