The Township of Muhlenberg has determined that it is in the best interest of the health, safety and welfare of the public to promote the connection to and use of public water distribution systems.

Any person or entity owning land accessible to and whose principal building is within 150 feet from the water system shall connect his/her improved property with and shall use the public water distribution system.

Any person or entity required under this article to connect to or attach to any public water distribution system any structure shall cause said connection or attachment to be made within 90 days of sending of notice to connect to the public water distribution system by the Township.
All costs, fees and charges imposable under law by the Township or any other municipal body or other governmental agency having jurisdiction shall be due and payable by the person or entity owning the land at the earlier of:
A. 
Connection of the system;
B. 
Ninety days after sending of notice by Township; or

C. 
Obtaining permit to install the connection to the public water system.
The Township Code Enforcement Officer shall determine in any instance whether a violation has occurred under this article. Upon such determination, the Code Enforcement Officer shall impose a penalty upon the violation as set forth in § 340-28 hereof. The notice of violation and imposition of fine shall be sent by certified mail, return receipt requested, or may be served personally by the Code Enforcement Officer.

This article shall be enforced by action brought before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person, partnership, corporation or other entity who or which violates or permits a violation of the provisions of this article shall, upon conviction in a summary proceeding, pay a fine of not more than $1,000 plus the costs of prosecution and, in default of the payment of the fine and costs of prosecution, shall be imprisoned for a period not exceeding 30 days.
Nothing contained herein shall limit, restrict or impair the Township from seeking any other civil remedy at law or in equity against any person or entity violating this article.
