Any apparatus or structure which is designed for the purpose
of receiving television, radio, microwave, satellite or similar signals,
in connection with what is commonly referred to as a dish-type antenna.
The provisions of this chapter shall be administered and enforced
by the zoning officer of the Borough of Point Pleasant Beach.
a.Â
Any property owner or person or entity in possession of property
shall submit to the zoning officer, prior to the placement of a satellite
earth station, a plan showing the size of the satellite earth station,
the proposed location of the same on the subject premises and such
other information as may be required herein.
b.Â
The zoning officer shall review said plan and render a decision within
20 days of the submission of said plan or within such further time
as may be consented to by the property owners or person in possession
of property.
c.Â
The restrictions and design standards required under the within section
shall not be applicable to satellite earth stations to be located
within the following zoning districts - GC General Commercial, HC
Highway Commercial, RC Resort Commercial and MC Marine Commercial.
The plan shall be drawn on a map to a scale not smaller than
one inch equals 40 feet and not larger than one inch equals ten feet
and shall include and show the following information:
a.Â
The name and address of the applicant and the owner and the name,
address and the title of the person or entity preparing the plan and
accompanying data, the date of preparation and the dates of each revision,
where applicable.
b.Â
An appropriate place for the signature of the zoning officer.
c.Â
The lot(s) and block number of the lot(s) from the Borough Tax Map,
and the length and bearings of the lot lines of the proposed project.
d.Â
The location, names and pavement and right-of-way widths of all existing
and proposed streets abutting the lot or lots in question, the property
lines of all abutting properties together with the names and addresses
as disclosed on the Borough Tax Map and the tax rolls as of the date
of the application, and the location of existing buildings within
200 feet of the site in question.
e.Â
All existing buildings and structures and all accessory buildings
or structures on the lot, if any, with dimensions showing present
and finished grade elevations at all corners.
f.Â
All existing and proposed setback dimensions and landscape areas,
trees of six inch caliper on the site affected by the proposed apparatus.
g.Â
Existing and proposed plantings to provide screening for noise, glare
and aesthetics.
h.Â
Any and all other information necessary to meet any of the requirements
of this chapter not listed above.
a.Â
The diameter of satellite earth station antennas (parabolic dish)
shall not be greater than eight feet.
b.Â
The maximum height of antennas and mounting structure measured vertically
from the highest point of the antennas when positions for operation
shall not be greater than eight feet above the ground.
c.Â
In all zoning districts, satellite earth stations shall be installed
only on the ground level.
d.Â
No ground level satellite earth station shall be closer than ten
feet from any side property line and no closer than ten feet from
any rear property line.
e.Â
Ground level satellite earth stations shall be located in the rear
yard only.
f.Â
Every satellite earth station shall be effectively screened by a
special planting screen or fence in accordance with the fence regulations
of the Borough Code. Said screening may consist of trellis, lattice
work, decorative block, basket-weave fencing, open artistic block
or other similar material by a height of at least four feet as approved
by the Borough Zoning Officer. It also may consist of approved plantings
of at least four feet of a height of such kind of proximity and density
of growth as shall effectively screen the antenna and mount in all
seasons of the year. All screening shall be maintained as originally
approved. If the screening is not so maintained, any permit granted
in connection with a satellite earth station antenna is subject to
revocation by the Borough Zoning Officer or his inspectors.
The application for a permit to install a satellite earth station
shall be twenty-five ($25.00) dollars.
Any person who violates any one or more of the provisions of
this chapter shall be subject to a fine of not more than five hundred
($500.00) dollars for each separate offense and/or confinement in
the Ocean County Jail for a period of not more than 90 days. In the
case of a continuing violation or violations, a fine of not more than
five hundred ($500.00) dollars may be assessed for each day that said
violation or violations are not corrected. A separate offense shall
be deemed committed on each day during or on which a violation occurs
or continues.
