This book shall be known and may be cited as the "Revised General
Ordinances of the Township of Roxbury (1978)" and is herein referred
to as the "revision" .
For the purpose of this revision, and in the interpretation
and application of all other ordinances heretofore or hereafter adopted.
except as the context may otherwise require:
Whenever the term "administrator" is used in the Revised
General Ordinances of the Township of Roxbury, such term shall mean
the township manager.
shall mean the municipal clerk duly appointed pursuant to
law.
shall mean the County of Morris.
shall mean an organization unit of the township government
established or designated by ordinance or this revision as a department,
together with any agency or instrumentality of the township government
assigned to such organization unit by the township council.
shall mean licensed in accordance with the appropriate section
or chapter of this revision.
shall mean the township manager, deputy manager or acting
manager appointed and serving pursuant to the charter or code.
shall mean a calendar month unless otherwise specifically
provided.
shall mean the Township of Roxbury in the County of Morris.
shall mean any act of local legislation heretofore or hereafter
adopted, and including this revision, so long as it shall have been
adopted by the procedure required for the adoption of an ordinance
and so long as it shall remain in force and effect pursuant to law.
shall mean any individual, natural persons, partnerships,
joint ventures, societies, associations, clubs, trustees, trusts,
corporations or unincorporated groups, or any officers, agents, employees,
servants, factors or any kind of personal representatives of any thereof
in any capacity, acting either for himself or for any other person,
under either personal appointment or pursuant to law.
shall mean the State of New Jersey.
shall include a street, avenue, road, alley, lane, highway,
boulevard, concourse, driveway, culvert, sidewalk, and crosswalk,
and every class of road, square, place or municipal parking field
used by the general public.
shall mean the Township of Roxbury in the County of Morris
and State of New Jersey.
Whenever the term "township committee" or "committee" is
used in the Revised General Ordinances of the Township of Roxbury,
such term shall mean the township council of the Township of Roxbury.
shall mean the governing body of the Township of Roxbury.
shall mean a calendar year unless otherwise specifically
provided.
For the purpose of this revision and any other ordinances heretofore
or hereafter adopted, except as the context may otherwise require:
The present tense includes the past and future tenses and
the future, the present.
The masculine gender includes the feminine and neuter.
The singular number includes the plural and the plural. the
singular.
"Shall" is mandatory and "may" is permissive.
The time within which an act is to be done shall be computed
by excluding the first. and including the last. day and if the last
day be a Sunday or a legal holiday. that day shall be excluded.

"Writing" and "written" includes printing. typewriting. and
any other mode of communication using paper or similar material which
is in general use. as well as legible handwriting.
Whenever a specific time is used in this revision. it shall
mean the prevailing and established time in effect in the State of
New Jersey during any day in any year.
Any citation of a statute. law or ordinance contained in this
revision shall be deemed to refer to such statute. law or ordinance
as amended. whether or not such designation is included in the citation.
"Chapter" shall mean a major division of the revision. identified
by a Roman Numeral. and divided by subject matter.
"Section" shall mean a major subdivision of a chapter.
"Subsection" shall mean a subdivision of a section. identified
by a decimal number.
"Paragraph" shall mean a subdivision under a subsection. identified
by an alphabetical letter or Arabic number.
If any chapter, section or paragraph of this revision shall
be declared to be unconstitutional, invalid or inoperative, in whole
or in part. by a court of competent jurisdiction. such chapter, section.
or subsection paragraph shall to the extent that it is not unconstitutional.
invalid or inoperative, remain in full force and effect, and no such
determination shall be deemed to invalidate the remaining chapters,
sections or paragraphs of this revision.
All ordinances heretofore adopted by the Township Committee
of the Township of Roxbury, of a general nature and relating to the
subject matter herein contained, are repealed. The provisions of this
code, as far as they are the same in substance as those heretofore
existing ordinances shall be considered continuations of such ordinances
and not new enactments. Any act done. offense committed or right accruing,
accrued or acquired or liability, penalty, forfeiture or punishment
incurred prior to the time of such appeal are not affected by such
repeal, but may be enjoyed, asserted, enforced, prosecuted or inflicted
as fully and to the same extent as if such repeal had not been effected.
No ordinance or part of any ordinance heretofore repealed shall
be considered reordained or reenacted by virtue of this code, unless
specifically reenacted. The repeal of any curative or validating ordinances
does not impair or affect any cure or validation already effected
thereby.
Unless otherwise provided in this code, this code shall apply
to all acts performed within the corporate limits of the Township
of Roxbury. Provisions of this code shall also apply to acts performed
outside the corporate limits and up to the limits provided by law,
where the law confers power on the township to regulate such particular
acts outside the corporate limits.
a.Â
Refund
of required fees. If an application for a license or permit is withdrawn
by an applicant, or is not processed for any reason by a township
official, or if the application is processed and rejected/denied by
the township, the prepaid fee less a ten (10%) percent administrative
handling charge shall be returned to the applicant provided that this
such charge shall not be less than ten ($10.00) dollars. For fees
required by the land use ordinances the cost of publication shall
also be deducted from the amount to be refunded provided that the
application has not been given any consideration by the appropriate
reviewing board.

Refund
of service charge, An administrative handling fee of ten ($10.00)
dollars shall be retained by the township when an applicant withdraws
or cancels a request for special services, participation in a township
recreation program, or similar town ship operation.
c.Â
No
refund will be given if the application has been processed to conclusion
and the applicant has received any part of the services or benefit
for which the application was made.
d.Â
This
reimbursement shall not apply to fees established in the building
construction codes. Any fees not governed by this section can only
be refunded upon specific application to the township council.
