The use of vending machines to sell or dispense tobacco products
is prohibited in the town-ship. No person owning or having control
over any premises in the township may possess, own or exercise control
over or permit, suffer or allow another to possess, own or exercise
control over any tobacco product vending machine on those premises
for the purpose of selling or dispensing of tobacco products. No person
owning, possessing or exercising control over a tobacco product vending
machine may place or maintain such tobacco product vending machine
on premises in the township for the purpose of selling or dispensing
tobacco products.
The health officer or his or her designee is charged with the
responsibility of enforcing this section. Complaints filed for violation
of this section shall be filed with the municipal court of the township.
Any law enforcement officer or any citizen may sign a complaint alleging
a violation of this section.
Any person convicted of violation of any subsection of this section shall be subject to the penalty provisions described in section 3-1 of Chapter III of these Revised General Ordinances of the Township of Roxbury. Each day that a violation continues shall constitute a separate and distinct violation.
This law shall not be enforced until June 1, 1996 in order to
give an appropriate opportunity for removal of tobacco product vending
machines from premises in the township.
