The Township of Winslow hereby establishes a Dedicated By Rider
Trust Fund for the receipt of fees collected from private parties
or entities to reimburse the township for payment of wages to police
officers for performing dedicated police overtime services for these
private parties or entities.
A.
A private party or entity requiring dedicated police overtime services
from the Winslow Township Police Department shall be required to prepay
an estimated deposit into an interest bearing Dedicated By Rider Trust
Fund. The Trust Fund shall be administered by the Township Chief Financial
Officer.
B.
The private party or entity requiring these police services from
the Township Police Department shall be required to sign an agreement
with the township in the form approved and attached thereto.[1]

C.
The private party or entity shall provide the date(s), location(s),
and the estimated time period for these police services to be rendered.
D.
The Township Police Department will then advise the private party
or entity of the estimated deposit to be placed into the Trust Fund.
No services will be performed without the initial deposit being placed
into the Trust Fund. The initial deposit shall be based on the hourly
rate established by the township for providing these police services.
E.
If the initial estimated deposit for these police services exceeds
two thousand five hundred dollars ($2,500.), a minimum deposit of
two thousand five hundred dollars ($2,500.) is required.
F.
The Township Police Department shall submit a statement to the Township
Chief Financial Officer that it has paid the police officers for performing
these services by identifying the services performed, the police officers
who performed the services, the date the services were performed and
the hours spent performing said services. A copy of this statement
shall also be provided to the private party or entity utilizing said
service.
G.
Upon receipt of a statement from the Township Police Department,
the Township Chief Financial Officer will then release monies from
the Trust Fund to reimburse the township for payment made by the Township
Police Department to the police officers who performed these services.
H.
The Township Chief Financial Officer shall prepare and submit statements
to the private party or entity which is an accounting of these funds
indicating any interest earnings on same, the disbursements made the
balance remaining. These statements will be provided on a quarterly
basis if the charges are one thousand five hundred dollars ($1,500.)
or less, and on a monthly basis if the charges exceed one thousand
five hundred dollars ($1,500.) per month.

If there are insufficient monies in the Trust Fund to continue to
reimburse the township for these services, the Township Chief Financial
Officer will provide written notice to the private party or entity
to replenish the account by an additional deposit. No additional services
will be provided until the Trust Fund is replenished unless the township
determines these services are necessary for "immediate safety or welfare
reason".
J.
At the completion of these police services, the Township Chief Financial
Officer will provide to the private party or entity a final accounting
within thirty (30) days of that completion date. If a balance remains
in the Trust Fund, those monies will be refunded to the private party
or entity.
K.
If the private party or entity disputes the billing and payment by
the Winslow Township Police Department for these services, that private
party or entity has a right to file a written statement with the Township
Chief Financial Officer within ten (10) days of when said issue occurs.
The township shall make all reasonable efforts to resolve the dispute
within ten (10) days of said written notice, unless both parties agree
to extend the time. If the dispute is unable to be resolved through
that process, the private party or entity has a right to seek legal
redress within forty-five (45) days of written notice from the township
that the dispute is unable to be resolved through the informal procedure.
L.
If a private party or entity requests these overtime police services
on notice to the township of twenty-four (24) hours or less, and it
is deemed an emergency by the Winslow Township Police Department,
the township will undertake the performance of these services only
if the private party or entity signs a contract guaranteeing payment
to the Trust Fund.
