All exterior property and premises shall be maintained in a
clean, safe and sanitary condition. The occupant shall keep that part
of the exterior property which such occupant occupies or controls
in a clean and sanitary condition. The exterior premises shall be
kept free of litter and all areas of the premises shall be kept free
of nuisances and hazards to the safety of tenants, occupants, pedestrians
and other persons having access to the premises and free of unsanitary
conditions, and any of the foregoing shall be promptly removed and
abated. The word "hazards" shall include, but not be limited to, the
following:
A.
Refuse or accumulation of rubbish/garbage;
B.
Dead and dying trees and other natural growth which, by reason of
rotting or deteriorating conditions or storm damage, are or may be
dangerous to persons in the vicinity thereof;
C.
Loose overhanging and projecting objects which, by reason of location
above ground level, constitute dangers to persons in the vicinity
thereof; and
D.
Holes, mounds, excavations, breaks, projections, obstructions and
excretions of pets and other animal on paths, sidewalks, walks, driveways,
parking lots and parking areas and other parts of the exterior of
the premises which are accessible to and used by persons having access
to such premises.
No person shall, within the limits of the township, keep or
maintain on any public or private property any open cistern, open
hole, dilapidated vehicle or other type of junk material which would
endanger the health or safety of any person.
The owner or person in control of any private property shall
at all times maintain the premises free of litter; provided, however,
that this section shall not prohibit the storage of litter in authorized
private receptacles for collection.
All structures and exterior property shall be kept free from
rodent harborage and infestation. Where rodents are found, they shall
be promptly exterminated by approved processes which will not be injurious
to human health. After pest elimination, proper precautions shall
be taken to eliminate rodent harborage and prevent reinfestation.
All exterior surfaces, including but not limited to, doors,
door and window frames, roofs, gutters, cornices, porches, trim, balconies,
decks and fences, shall be maintained in good condition. Exterior
wood surfaces, other than decay-resistant woods, shall be protected
from the elements and decay by painting or other protective covering
or treatment. Peeling, flaking and chipped paint shall be eliminated
and surfaces repainted. All siding and masonry joints, as well as
those between the building envelope and the perimeter of windows,
doors and skylights, shall be maintained weather resistant and water
tight. All metal surfaces subject to rust or corrosion shall be coated
to inhibit such rust and corrosion, and all surfaces with rust or
corrosion shall be coated to inhibit future rust and corrosion. Oxidation
stains shall be removed from exterior surfaces. Surfaces designed
for stabilization by oxidation are exempt from this requirement.
All accessory structures, including detached garages, fences
and walls, shall be maintained structurally sound and in good repair.
A.
Every private swimming pool, regardless of size, shall at all times
comply with the requirements of all authorities having jurisdiction
on the premises, and any nuisance or hazard which may exist or develop
in consequence of or in connection with such swimming pool shall forthwith
be abated and removed by the person in possession of such pool, upon
receipt of notice from the Enforcing Authority identified in this
chapter.
B.
The owner of every pool shall be responsible to maintain their pool
in such condition as to prevent a general nuisance affecting public
health and safety (i.e. stagnant water in which mosquitos breed).
C.
The owner of the property is responsible for maintaining their pool
in a clean and sanitary condition, and in good repair.
D.
Private swimming pools, hot tubs and spas, containing water more
than twenty-four (24) inches in depth shall be completely surrounded
by a fence or barrier at least forty-eight (48) inches in height above
the finished ground level measured on the side of the barrier away
from the pool. Gates and doors in such barriers shall be self-closing
and self-latching. Where the self-latching device is a minimum of
fifty-four (54) inches above the bottom of the gate, the release mechanism
shall be located on the pool side of the gate. Self-closing and self-latching
gates shall be maintained such that the gate will positively close
and latch when released from an open position of six (6) inches from
the gatepost, No existing pool enclosures shall be removed, replaced
or changed in a manner that reduces its effectiveness as a safety
barrier.
