[Adopted 9-26-95 by Ord. No. 0-30-95]
The purpose and intent of this Article is to regulate the placement
of utility poles in or upon municipal rights of way.
In an effort to provide a safer environment for the traveling
public, any and all installations of and by utility companies within
or upon rights of way of the Township of Winslow shall not, in any
way, interfere with pedestrian or vehicular traffic in such a way
as to have the potential of causing damages or bodily harm.
Any longitudinal installation of overhead lines on the rights-of-way
in the Township of Winslow shall be limited to single wooden pole
type of construction. The Township of Winslow shall consider requests
to use a non-wooden pole type of construction on a case-by-case basis
only in unusual circumstances in which public safety is not compromised.
A.Â
Utility poles shall be located as close to the right-of-way line
as practical, without in any way interfering with pedestrian or vehicular
traffic in such a way to have the potential of causing damages or
bodily harm.
B.Â
Utility poles shall always be located behind guide rails wherever
same exists, provided such installations do not, in any way, interfere
with pedestrian or vehicular traffic in such a way to have the potential
of causing damages or bodily harm.
The utility company shall be required to execute a hold harmless
agreement in the form on file with the Township Clerk before approval
for the placement of the poles is granted.
