[1999 Code § 2.100.010]
It is determined by the Township Council that:
a. 
State Statutes (N.J.S.A. 40A:10-1 et seq.) permit a local unit of local government to provide for insurance against loss by either insuring with any insurance company authorized to do business in the State of New Jersey or through the creation of various insurance funds;
b. 
A combination of both methods results in the best opportunity to provide coverage at the lowest cost to the Township of Edison; and
c. 
Said statutes referenced above require the establishment of insurance funds where coverages are to be retained and administered by the local unit of government.

There is established an insurance fund in accordance with the provisions of N.J.S.A. 40A:10-6, and for the reasons set forth therein, and to:
a. 
Insure against any loss or damage, however caused, to any property, motor vehicles, equipment or apparatus owned by it or owned by or under the control of any of its departments, boards, agencies or commissions;
b. 
Insure against liability resulting from the use or operation of motor vehicles, equipment or apparatus owned by or controlled by it or owned by or under the control of any of its departments, boards, agencies or commissions;
c. 
Insure against liability for its negligence and that of its officers, employees and servants, whether or not compensated or part-time, who are authorized to perform any act or services, but not including an independent contractor within the limitations of the New Jersey Tort Claims Act (N.J.S.A. 59:1-1 et seq.).
d. 
Provide contributory or noncontributory self-funded, or partially self-funded, health benefits to employees or their dependents, or both, in accordance with rules and regulations of the Director of the Division of Local Government Services in the Department of Community Affairs.

The Municipal Council may designate the maximum or minimum amount of the insurance fund and, from time to time, provide for the disposition of any excess over and above the maximum amount fixed or of the interest or profits arising therefrom when the fund shall have reached the maximum limit.

a. 
There is established an Insurance Fund Commission consisting of three (3) commissioners.
1. 
The Commissioners shall be officials of the Township and shall hold office for periods of two (2) years or for the remainder of their terms of office as officials, whichever shall be less, and until their successors have been duly appointed and qualified. To the extent that any Commissioner serves for a lesser period of time, an interim appointment shall be made for the balance of that Commissioner's term.
2. 
The Commissioners shall serve without compensation.
3. 
The Mayor shall appoint the Commissioners.
b. 
The Commission shall elect a chairperson and shall promulgate such rules and regulations as it deems necessary to carry out its function.
c. 
Commission Secretary.
1. 
There shall be established the position of secretary to the Board of Insurance Commissioners. The secretary shall be appointed by the Commission and shall serve at the pleasure of the Commission. The Commission secretary shall have the obligation to take and maintain accurate minutes of Commission meetings and to maintain accurate records of each and every claim filed against the Township, whether a general liability claim or a worker's compensation claim.
2. 
The annual salary of the Commission secretary shall be established by ordinance.

a. 
The Commissioners shall have the following powers and authority:
1. 
Employ necessary clerical assistants, whose compensation shall be fixed and paid by the Governing Body of the local unit in the same manner as is that of other employees of the municipality;
2. 
Invest the fund and all additions and accretions thereto in such securities as they shall deem best suited for the purpose of this chapter;
3. 
Adopt rules and regulations for the control and investment of the fund;
4. 
Keep on hand at all times sufficient money, or have the same invested in such securities as can be immediately sold for cash, for the payment of losses to any buildings or property of the local unit, or liability resulting from the operation of publicly owned motor vehicles, equipment or apparatus;
5. 
Fix reasonable rates of premium for all insurance carried by the insurance fund and shall effect all insurance in the insurance fund or with any insurance company or companies authorized to do business in this State. All group insurance as authorized by N.J.S.A. 40A:10-16 et seq. for employees of the Township shall be placed and effected by the Commissioners subject to the approval of the Township of any contracts in accordance with the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
b. 
Premiums for insurance, whether carried in the insurance fund or placed with insurance companies, shall be paid to the Commissioners by the board, commission, department, committee or officer having charge or control of the property insured.
c. 
All insurance upon property owned or controlled by a local unit or any of its departments, boards, agencies or commissions shall be placed and effected by the Commissioners.
d. 
If provided by the rules and regulations of the Commission, the secretary to the Insurance Fund Commission shall be entrusted with the daily operation of the insurance fund and shall submit a report to the Commissioners at least once a month.

a. 
There shall be established the title of administering agency and risk manager for the purpose of handling liability and workers' compensation claims filed against the Township. The administrating agency and risk manager shall be designated from time to time by the Township and shall serve and be compensated in accordance with a written contract with terms and conditions mutually agreed upon by the parties and, in any event, to be subject to the provisions of N.J.S.A. 40A:5-17 and as otherwise set forth herein. Any such contract shall be negotiated by the Mayor and presented to the Commission for its approval prior to the granting of final approval by the Council. In no event shall any one (1) contract with the administering agency or the risk manager be for more than a three-year period, although any given contract may be extended for additional periods not to exceed three (3) years per extension.
b. 
The risk manager shall have the sole right of approval as to any claim not to exceed an amount to be fixed by the Commission on an annual basis.

a. 
The risk manager shall submit a voucher on the form prescribed by the Township on all claims, of whatever amount, and will, by signature, approve all vouchers and countersign said vouchers in the same manner as any other department head of the Township. With respect to all other claims exceeding the amount established pursuant to the terms of subsection 2-122.6b, said claims are to be submitted by the risk manager to the Insurance Commission for approval, together with the appropriate voucher on a monthly bill list. Payments will be made on all vouchers by checks signed by the appropriate signatory of the Township, countersigned by the designee of the risk manager.
b. 
In determining claim amounts, when dealing with weekly temporary disability benefits and/or medical payments in workers compensation claims, each said claim is to be construed as a separate claim in determining whether or not the same equals or exceeds the dollar limit hereinabove referred to in subsection 2-122.6b.

Pursuant to the discretionary authority contained in N.J.S.A. 40A:10-12 et seq., the worker's compensation insurance fund is established.

No insurance company shall pay any claim in excess of two thousand five hundred ($2,500.00) dollars for fire damages on any real property located within Edison Township pursuant to any fire insurance policy issued or renewed after the adoption of this section and its filing with the State Commissioner of Insurance, except as follows:
a. 
The insured individual or entity submits an official certificate of search for municipal liens pursuant to N.J.S.A. 54:5-12 certifying that all taxes, assessments or other municipal liens or charges, levied and assessed and due and payable against said property have been paid in full; and
b. 
The insured person or entity has submitted a certification acknowledged by a notary public commissioned in the State of New Jersey that all demolition costs have been paid or that demolition is not required; or
c. 
The Township provides the insurer with a certified Resolution pursuant to which the Township has entered into an agreement with the owner of the fire-damaged property to pay in full all delinquent taxes, assessments or other municipal liens by installments pursuant to N.J.S.A. 54:5-19 for the redemption of any tax sale lien by installment payments pursuant to N.J.S.A. 54:5-65, et seq., or the payment by installment of any anticipated costs of demolition.

Any request for an official certificate of search for municipal liens pursuant to this Section shall specify that the search concerns fire-damaged property.

The Township's claim made in accordance with the provisions of this section shall be paramount to any other claims on the proceeds of the fire insurance policy. However, notwithstanding the provisions of this section, an insurance company may pay proceeds of a fire insurance policy to a holder of a purchase money mortgage held as a first mortgage or an institutional lender which is a holder of a mortgage on the fire damaged property, where the fire insurance policy at the time of the loss listed the mortgagee as a holder of an insurable interest; provided the payment may not be in an amount which exceeds that due and payable to the mortgagee under the mortgage contract.

In the event that an appeal is taken on the amount of any lien or charge, other than an appeal based upon the assessed valuation of real property pursuant to N.J.S.A. 54:3-21, the insurance company issues a draft payable to the court of record, to be held by the court in an interest bearing escrow account in a banking institution or savings and loan association in New Jersey, in an amount totaling seventy-five (75%) percent of the full amount of the lien or charge being contested but not to exceed the proceeds payable under its insurance policy, and the insurance company shall issue a draft payable to the municipality for the remaining twenty-five (25%) percent of the lien or charge being contested, with the full amount paid by the insurance company to the court and the municipality not to exceed the proceeds payable under its insurance policy pending termination of all proceedings.

If any section, subsection, sentence, clause, phrase or portion of this section is for any reason held invalid or unconstitutional by any court or Federal or State agency of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.

a. 
Authorization. The Township of Edison is authorized to become a Government Aggregator of electric generation service and electric service for residential and nonresidential customer's electric power on behalf of its residential and nonresidential citizens.
b. 
Township to Use Option Two. The Township will follow the Government-Private Aggregator Option Two of the BPU Government-Private Aggregator Program pursuant to the rules and regulations of the New Jersey State Board of Public Utilities.
c. 
Submission of Documentation. The Mayor and Chief of Staff are hereby authorized to take any and all steps to submit the necessary documentation to the New Jersey Board of Public Utilities and to provide any and all notices to residential customers to opt-out of the Program and to nonresidential customers to opt-in to the Program.
d. 
Selection of Energy Provider. The Township is a member of the Middlesex Regional Education Services Commission and the Commission has followed the Fair and Open process to select an energy service provider, Good Energy, L.P., to perform the New Jersey BPU aggregation program adopted by N.J.A.C. 14:4-6 et seq., for the Commission and its members.
e. 
Extension of Service Agreement. The term of the agreement shall require the Municipal Council to approve by resolution the extension of the service agreement annually up to no more than five (5) renewals.

The Municipal Council hereby authorizes the Mayor to request from such persons about to lawfully enter into the matrimonial relation or civil union, at a ceremony presided by the Mayor, a voluntary contribution of two hundred ($200.00) dollars to be paid directly to a recognized 501(c)(3) tax-exempt charity of such persons' choosing. The contribution solicited shall be entirely voluntary, and the performance by the Mayor of officiating duties shall not be contingent upon the payment of a voluntary contribution.

All fees authorized by this chapter shall be collected by the Division of Revenue and Collection of the Department of Finance.

a.
Use of Police Department pistol ranges (indoor and outdoor ranges) and training/safety course instruction:

Training fees with certified instructor to meet New Jersey carry permit mandates:

Retired Law Enforcement Officers: fifty ($50.00) dollars per session.

Retired Edison Division of Police: Free of charge.
2.
The fee for the use of the range by any law enforcement agency other than Edison Township shall be two hundred fifty ($250.00) dollars per session.

Fees for Firearms Familiarization and Safety Course(s) for Edison Township residents only:

All persons (other than active officers in the Edison Division of Police) using the pistol range shall, prior to such use, execute an indemnification agreement in the form approved by the Township Attorney and the Township's insurer.

f.
General Fees. Unless fees are otherwise specified in this chapter or State statute, all Township departments of the Township of Edison shall be authorized to charge for making available to the public copies of all other public records at the following rate:
1.
The public records of the Township of Edison shall be accessible for examination and copying in accordance with N.J.S.A. 47:1A-1 et seq., upon the terms and conditions herein provided. Such inspection shall be made only at reasonable times during the business hours and without interference with the conduct of the affairs of the office or other place where such records are kept or maintained.
2.
Prior to allowing access to any government record, the custodian thereof shall redact from that record any information which discloses the social security number, credit card number, unlisted telephone number, or driver's license number of any person, in accordance with N.J.S.A. 47:1A-5 and redact any personal information or information otherwise protected by law.
3.
A copy or copies of a government record may be purchased by any person upon payment of the following fees:
$0.05 per letter size page or smaller
$0.07 per legal size page or larger
4.
If the Township can demonstrate that its actual costs for duplication of a government record exceed the foregoing rates, the Township shall be permitted to charge the actual cost of duplicating the record. The actual cost of duplicating the record, upon which all copy fees are based, shall be the cost of materials and supplies used to make a copy of the record, but shall not include the cost of labor or other overhead expenses associated with making the copy except for a special service charge as provided herein, if applicable.
5.
Special Service Charges. Whenever the nature, format, manner of collation, or volume of a government record embodied in the form of printed matter to be inspected, examined, or copied pursuant to this subsection is such that the record cannot be reproduced by ordinary document copying equipment in ordinary business size or involves an extraordinary expenditure of time and effort to accommodate the request, the Township may charge, in addition to the actual cost of duplicating the record, a special service charge of twenty-five ($25.00) dollars per hour. A deposit of the estimated special service charge shall be required prior to the request being processed and the full amount of the actual special service charge shall be paid prior to the release of the documents. The requestor shall have the opportunity to review and object to the estimated special service charge prior to it being incurred.
6.
Mailing charges for any of said items shall be the actual postage charge incurred by the Township.
7.
Access to electronic records and nonprinted materials shall be provided free of charge, but the public agency may charge for the actual costs of any needed supplies such as computer discs.
g.
Handling of Tax Sale Certificates.
1.
Discharge or Cancellation of Record of Tax Sale Certificates. Upon redemption of a Tax Sale Certificate, the Tax Collector shall send the certificate to the Middlesex County Clerk for cancellation of record. The Township shall impose a charge of thirty dollars ($30.00) to handle, process and mail the cancelled certificate to the County. The Tax Collector shall collect the charge for each Tax Sale Certificate redeemed or when service requested at any time after the redemption occurred.
2.
Certificate of Redemption. In the event that an original redeemed Tax Sale Certificate, already signed for cancellation by the Lien Holder, is lost and needed to be replaced to prove payment, and/or for processing of cancellation of record, the Tax Collector shall issue a notarized certificate of redemption and impose a charge of twenty-five dollars ($25.00) due upon the issuing.
h.
Returned Checks.
1.
A service charge fee in the amount of twenty ($20.00) dollars shall be charged to any resident, corporation, group, nonprofit group or other legal entity ("payor") who tenders a check or other written instrument and it is returned to the Township for insufficient funds. In accordance with N.J.S.A. 40:5-18(b), the Tax Collector is authorized to include the twenty ($20.00) dollar charge onto the Township's Tax Sale list for any taxpayer who is delinquent in paying property taxes or special tax assessments.
2.
Any payor who has tendered insufficient funds to the Township will be required, in the Director of Finance's discretion, to make any and all future payments to the Township either cash, certified or cashier's check.
3.
Township volunteers, Township sponsored organizations and senior citizens are not exempt from the provisions of this section.

a. 
Notwithstanding the provisions of any ordinance to the contrary, the following defined residents of the Township shall not be required to pay any municipal fee established by the Township:
1. 
Any resident of the Township who shall have attained the age of sixty-five (65) years old; or
2. 
Any resident of the Township who is an active member of the following volunteer first aid squads:
(a) 
Edison First Aid Squad No. 1,
(b) 
Edison First Aid Squad No. 2,
(c) 
Clara Barton First Aid Squad,
(d) 
Raritan Engine Company No. 1,
(e) 
Edison Volunteer Fire Company No. 1,
(f) 
Raritan Engine Company No. 2,
(g) 
H.K. Volunteer Fire Company and
(h) 
Oak Tree Volunteer Fire Company.
3. 
Any resident of the Township of Edison who is an active member of the Edison police auxiliary.
4. 
Disabled persons as defined in Chapter XIV, Building and Construction, of the Code of the Township of Edison.
5. 
The spouse or dependent children of a Township resident serving on active duty in the Armed Forces of the United States as defined in N.J.S.A. 38A:1-1.
b. 
The Director of Finance shall promulgate rules and regulations to effectuate the purpose of this section and shall file with the Township Clerk, and post within the Municipal Complex, a list of fees to which this section shall apply.
c. 
The waiver of Township fees provided in this section is subject to the following general restrictions and conditions:
1. 
Fees for group activities are waived for groups which include only residents who are the subject of this fee chapter.
2. 
No fee imposed in connection with a penalty enforcement or judicial proceeding shall be waived.
3. 
This section shall not apply to any bond or surety required to ensure the faithful performance of a public obligation or repair to a public facility.
4. 
This section shall not apply to any commercial or business activity.
5. 
This section shall not apply to any land use or development fee imposed in conjunction with a Planning Board or Board of Adjustment application or any construction code fee under Section 14-1.10 of this Code for the construction of a new dwelling, except with regards to the alteration of any existing residence within the Township occupied by a resident covered by this section.
6. 
For the purpose of this section, the term "active member" shall be those members who:
(a) 
Provide services on an ambulance at least one (1) night a week or an equivalent forty (40) hours a month during weekdays or weekends;
(b) 
Attend at least fifty (50%) percent of all regularly scheduled and special drills/training exercises (not less than twelve (12) a year) averaging two (2) hours each;
(c) 
Recertify every other year for CPR;
(d) 
Complete forty-eight (48) hours of New Jersey State approved continuing education credits every three (3) years;
(e) 
Attend annual refresher courses in hazardous material, infectious disease control and ambulance safety;
(f) 
Attend an EMT-D refresher course every two (2) years;
(g) 
Attend at least twenty-five (25%) percent of all regularly scheduled and special meetings of the squad, missing no more than three (3) in a row.
d. 
All individuals covered by this section shall be entitled to obtain an Edison Township identification card which shall be presented at the time of payment to validate the entitlement to the fee waiver. The identification card shall remain the property of the Township and shall be subject to forfeiture in the event it is used or attempted to be used for any purpose in violation of this section. It shall be the responsibility of each of the first aid squads listed in this section to supply, on or about January 1st of each year and from time to time with any changes, a certified list of all active members in their respective first aid squads.
