a.
Supervision. All parks and recreational areas in the Township shall
be operated and maintained under the supervision of the Director of
Parks and Recreation and the Director of Public Works.
b.
Employees. The Director of Public Works shall have supervision over
all employees concerned in the maintenance of such parks and recreational
areas, and they shall perform their duties under his or her supervision.
c.
Enforcement of Ordinances. The Director of Parks and Recreation shall
see to the enforcement of all ordinances relating to the parks and
recreational areas. He or she shall enforce all rules relating to
the use of the park.
d.
Compliance with Regulations Required. It is unlawful for any person
to violate any regulation governing conduct in the Township parks
or recreational areas which regulation has been approved by the Council
of the Township.

Whenever any group, association or organization desires to use
the park facilities for a particular purpose, such as picnics, parties
or theatrical or entertainment performances, a representative of said
group, association or organization shall first obtain a permit from
the Director of Parks and Recreation for such purposes.

The Director of Parks and Recreation shall grant the application
if it appears that the group, association or organization will not
interfere with the general use of the park or recreational area by
the individual members of the public and if the group, association
or organization meets all other conditions contained in the application.
The application may contain a requirement for an indemnity bond to
protect the Township from any liability of any kind or character and
to protect the Township property from damage and shall contain such
a provision if the swimming pool is to be utilized by the group.

No person shall engage in, participate in, aid, form or organize
any assembly or group of people or make any speeches or conduct any
musical program or festivals in any park or recreational area unless
a permit has been obtained from the Director of Parks and Recreation,
and unless such permit is carried by the person heading or leading
such activity; provided, however, that the provisions hereof shall
not apply to students' work when constituting a part of their educational
activities under the immediate direction and supervision of the proper
school authorities, nor to any governmental agency within the scope
of its functions.

Applications for a park permit shall be filed with the Director
not less than twenty (20) days nor more than one hundred eight (108)
days before the date on which it is proposed to conduct any such activity.
Such application shall be sworn to and shall state:
a.
The name of the person or organization wishing to conduct such activity;
b.
If the activity is proposed to be conducted for, on behalf of or
by an organization, the name, address and telephone number of the
headquarters of the organization and of the authorized and responsible
head of such organization;
c.
The name, address and telephone number of the person who will be
the chairman of such activity and who will be responsible for its
conduct;
d.
The name, address and telephone number of the person or organization
to whom the permit is desired to be issued;
e.
The date when such activity is to be conducted;
f.
The park, recreational area or portion thereof for which such permit
is desired;
g.
An estimate of the anticipated attendance;
h.
The hour when such activity will start and terminate;
i.
Whether such activity will include the sale or distribution by a
nonprofit organization of alcoholic beverages pursuant to a valid
special permit from the New Jersey Division of Alcoholic Beverage
Control. In the event that such activity will include the sale or
distribution of alcoholic beverages by a nonprofit organization, the
applicant for a picnic permit shall pay (in addition to any other
fees required to be paid) a nonrefundable fee of twenty-five ($25.00)
dollars which shall be paid simultaneously with the picnic permit
application. No alcoholic beverages shall be permitted unless the
applicant shall first provide evidence that a valid special permit
has been obtained from the New Jersey Division of Alcoholic Beverage
Control. Notwithstanding the above, the sale or distribution of alcoholic
beverages shall be limited to the confines of the following three
(3) parks (excluding buildings situated thereon):

The Director of Parks and Recreation shall grant and issue such
park permit if:
a.
The proposed activity or use of the park or recreational area will
not unreasonably interfere with or detract from the general public
enjoyment of the park;
b.
The proposed activity and use will not unreasonably interfere with
or detract from the promotion of public health, welfare, safety and
recreation;
c.
The facilities desired have not been reserved for other use at the
day and hour required in the application;
d.
The conduct of such activity will not substantially interrupt the
safe and orderly movement of traffic;
e.
The conduct of such activity will not require the diversion of so
great a number of police officers of the Township to properly police
such activity and the areas contiguous thereto as to prevent normal
police protection to the Township;
f.
The conduct of such activity is not reasonably likely to cause injury
to persons or property or incite violence, crime or disorderly conduct;
g.
Such activity is not to be held for the sole purpose of advertising
any product, goods or event and is not designed to be held purely
for private profit.

a.
The Director of Parks and Recreation shall act upon the application
for a park permit within five (5) days after the filing of the same.

Each person, firm or corporation using the public parks, recreational
areas and grounds shall clean up all debris, extinguish all fires
when such fires are permitted and leave the premises in good order
and the facilities in a neat and sanitary condition.

It is unlawful for any person, firm or corporation using such
parks or recreational areas to either perform or permit to be performed
any of the following acts:
a.
Willfully mark, deface, disfigure, injure, tamper with or displace
or remove any building, bridges, tables, benches, fireplaces, railings,
paving or paving material, waterlines or other public utilities, or
parts or appurtenances thereof, signs, notices or placards, whether
temporary or permanent, monuments, stakes, posts or other boundary
markers or other structures or equipment, facilities or park property
or appurtenances whatsoever, either real or personal;
b.
Throw, discharge or otherwise place or cause to be placed, in the
waters of any fountain, pond, lake, stream, bay or other body of water
in or adjacent to any park or recreational area or in any tributary,
stream, storm sewer or drain flowing into such waters, any substance,
matter or thing, liquid or solid, which will or may result in the
pollution of these waters;
c.
Bring in or dump, deposit or leave any bottles, broken glass, ashes,
paper, boxes, cans, dirt, rubbish, waste, garbage or refuse or other
trash. No such refuse or trash shall be placed in any waters in or
contiguous to any park or recreational area or left anywhere on the
grounds provided; where receptacles are not so provided, all such
rubbish or waste shall be carried away from the park or recreational
area by the person responsible for its presence and properly disposed
of elsewhere;
d.
Disturb the peace or use any profane, obscene or blasphemous language;
e.
Endanger the safety of any person by any conduct or act;
f.
Commit any assault or battery or engage in fighting;
g.
Carry, possess or drink any alcoholic liquor in any park or recreational area, other than in those three (3) parks identified in subsection 24-2.4 and only for nonprofit organizations who have obtained a special permit from the New Jersey Division of Alcoholic Beverage Control and have also obtained a picnic permit from the Director of Parks and Recreation pursuant to subsection 24-2.4;
h.
Violate any rule for the use of the park or recreational area, or
any of its facilities, or interfere with such use in compliance with
this section and the rules applicable to such use;
i.
Swim, bathe or wade in any waters or waterways in or adjacent to
any park or recreational area, except in such waters and at such places
as are provided therefor and in compliance with such regulations as
are herein set forth or may be hereafter adopted;
j.
Appear in bathing costume at any place in the parks, except within
the limits of designated bathing places or areas, and all bathing
costumes shall conform to commonly accepted standards;
k.
Dress or undress on any beach or in any vehicle, toilet or other
place, except in such bathing houses or structures as may be provided
for that purpose;
l.
It is unlawful for any person to engage in ballplaying or the use
of a frisbee or an activity of like kind which may endanger the safety
of others, from 10:00 a.m. to 6:00 p.m. from May 15 to September 30
of each year, in any of the locations to be determined from time to
time by the Director of Parks and Recreation. Signs shall be posted
at each such location as follows: "No ball or frisbee playing from
10:00 a.m. to 6:00 p.m. from May 15 to September 30;"
m.
Amusement for Gain. No amusement for gain or for which a charge is
made can be conducted in a park or recreational area without the consent
of the Governing Body of the park or recreational area, and such amusement
must be conducted in accordance with any ordinance pertaining thereto.
n.
It is unlawful to engage in special activities, including flying
model airplanes, golf practice, ice skating, games and picnics, except
at locations specifically designated for such activities by the park
commissioners. Areas for such activities may be reserved by groups
for use at specified times.
o.
Automobiles and Other Vehicles.
1.
It is unlawful to drive or park any automobile or motorcycle on a
street, driveway or parking lot in any park or recreation area or
to park or leave any such vehicle in any place other than one established
for public parking.
2.
It is unlawful to ride, drive or use a minibike or moped except on
a street, driveway or path in any park or recreation area, except
where otherwise designated.
p.
Animals.
1.
It is unlawful to bring any dangerous animal into any park or recreation
area, and it shall be unlawful to permit any dog to be in any park
or recreation area unless such dog is on a leash not more than six
(6) feet long.
2.
It is unlawful to ride a horse except on designated bridle trails
where permitted. Horses shall be thoroughly broken and ridden with
due care and shall not be allowed to graze or go unattended, nor shall
horses be hitched to any rack, tree or shrub.
q.
Sales. It is unlawful for any person, other than employees and officials
of this park district acting on behalf of this district, to vend,
sell, peddle or offer for sale any commodity or article within any
park or recreation area.
r.
Alcoholic Beverages. It is unlawful for any person to have in his
or her possession, custody or control any alcoholic beverage of any
kind whatsoever.
s.
Signs. It is unlawful for anyone to paste, glue, tack or otherwise
post any sign, placard, advertisement or inscription whatever, nor
shall any person erect or cause to be erected any sign whatever on
any public lands or highways or roads adjacent to a park or recreation
area, provided that these provisions shall not apply to any properly
authorized government official.

a.
The park or recreational area shall be opened daily to the public
during the hours of sunrise to sunset, except for those facilities
and/or activities which require artificial lighting after sunset.
Notwithstanding the hours of operation aforesaid, the playing of basketball
shall be prohibited in any park or outdoor recreation facility prior
to 9:00 a.m. on weekends and 8:00 a.m. on weekdays. It is unlawful
for any person or persons, other than Township personnel conducting
Township business therein, to occupy or to be present in said park
or recreation area during any hours in which the park is not open
to the public.
b.
Any section or part of the park or recreational area may be declared
closed to the public by the Parks and Recreation Director or Public
Works Director at any time and for any interval of time, either temporarily
or at regular or stated intervals.

The Director of Parks and Recreation may conduct or permit a
winter ice skating program. In such event, the Director of Parks and
Recreation may permit the park or recreation area to be open during
reasonable hours.

a.
No person in park or recreation area shall picnic or lunch in a place
other than those designated for that purpose. Attendants shall have
the authority to regulate the activities in such areas when necessary
to prevent congestion and to secure the maximum use for the comfort
and convenience of all. Visitors shall comply with any directions
given to achieve this end.
b.
No person in a park or recreation area shall use any portion of the
picnic area or any of the buildings or structures therein for the
purpose of holding picnics to the exclusion of other persons, nor
shall any person use such areas and facilities for an unreasonable
time if the facilities are crowded.

The Township reserves the right, with respect to any or all
of the public park and recreation areas and any facilities located
therein, to enter into any agreement with the Board of Education of
the Township concerning the control and use thereof and, anything
contained in this section to the contrary notwithstanding, any use
of the premises or facilities by the Board of Education pursuant to
any agreement with the Township Council or the Department of Parks
and Recreation.

In addition to the other provisions of this section the following
use regulations shall apply specifically to the Skate Park:
a.
The park is to open to skateboards, in-line skates and BMX bicycles
only.
b.
No skating, rollerblading or bike racing will be permitted when equipment
is wet and/or icy.
c.
The following safety equipment is required when using the facility:
Helmets, Knee Pads, Elbow Pads — approved by national standards,
must be worn at all times. Failure to wear such equipment shall be
cause for immediate eviction from the facility.
d.
Only equipment installed by the Township of Edison may be used within
the facility.
e.
Rules and regulations shall be posted at the entrance to the facility.
f.
Additional rules and regulations may be promulgated by the Business
Administrator as deemed necessary to ensure the safe and appropriate
use of the facility.

a.
No person shall operate any roller skates, skateboard, scooter or
razor scooter on any property open to the public or used by the public
for roller skating, skateboarding or riding a scooter or in any public
park, playground or recreational area unless that person is wearing
a properly fitted and fastened helmet which meets the standards of
the American National Standards Institute (ANSI Z90 4 bicycle helmet
standard), the Snell Memorial Foundation's 1990 Standard for Protective
Headgear for Use in Bicycling, the American Society for Testing and
Materials (ASTM) Standard or other such standard, as appropriate.
b.
A person who violates the provisions of paragraph a. above by failing
to wear an approved helmet shall be warned of the violation by the
enforcing official and directed to leave the public property. Any
person who violates the provision of this section after having been
warned may be fined a maximum of twenty-five ($25.00) dollars for
the first offense and a maximum of one hundred ($100.00) dollars for
a subsequent offense.
c.
There shall be posted within each public park, playground or recreational
area a sign which reads as follows:
"Roller skating, skateboarding, or riding a scooter or razor
scooter without helmet on this property is a violation of State law
and the Code of the Township of Edison. Violators are subject to a
maximum fine of $100.00 dollars."

In the event the Township sponsors a class/program offered by
an outside professional, the professional will be required to pay
to the Township 10% of any and all fees they have collected from running
a class/program with a maximum length of 8 weeks per session or $200,
whichever is greater. The minimum $200 is due prior to the first class
and the balance due, if any, must be paid no later than two weeks
from the last class of the session. This fee shall be in lieu of the
fees set forth above for non-Township sponsored events. In the event
the professional fails to pay to the Township the money owed, the
professional will be precluded from performing such services for the
Township in the future.

Any person violating any of the provisions of Sections 24-1 through 24-5 or any rule or regulation promulgated pursuant hereto shall, upon conviction, be subject to the replacement, repair or restoration of any damaged park or recreation area property and shall be liable to the penalty stated in Chapter I, Section 1-5, and a period of community service as follows:

Fees are payable to the Supervisor of Licenses and Permits of
the Township. Residents must show satisfactory proof of residence
to the Supervisor of Licenses and Permits before the issuance of a
resident municipal boat basin tag. The Supervisor of Licenses and
Permits, upon receipt of the proper fee, shall issue an Edison boat
basin tag which shall be firmly attached to the passenger side front
of the boat trailer.

In the further interest of providing adequate recreational facilities
at the municipal boat basin, the Township may lease, rent or enter
into contracts with private concessionaires for the selling of goods
or services, all as may be permitted by law.

Any person who violates the provisions of this section and any boat user or private concessionaire who makes use of the Edison municipal boat basin without first complying with the rules and regulations as established by this section shall, upon conviction thereof, be liable to the penalty stated in Chapter I, Section 1-5.

As used in this section, the following words shall have the
following meanings:
Shall include all public parks, playgrounds, ball fields,
publicly owned or leased by the Township of Edison and all property
owned or leased by the Township of Edison upon which the public is
invited or upon which the public is permitted and where individuals
gather for recreational activities, including all areas adjacent to
such facilities, including, but not limited to, any parking area,
driveway or drive aisle.
The burning of, inhaling from, exhaling the smoke from, or
the possession of a lighted cigar, cigarette, pipe or any other matter
or substance which contains tobacco or cannabis any other matter that
can be smoked, or the inhaling or exhaling of smoke or vapor from
an electronic smoking device.

Smoking shall be prohibited in all public parks and recreation
facilities owned or leased by the Township of Edison and all property
owned or leased by the Township of Edison upon which the public is
invited or upon which the public is permitted and where individuals
gather for recreational activities, including all areas adjacent to
such facilities, including, but not limited to, any parking area,
driveway or drive aisle, which have been designated with no-smoking
signs. No-smoking signs or the international no-smoking symbol (consisting
of a pictorial representation of a burning cigarette enclosed in a
red circle with a diagonal red line through its cross section) shall
be clearly, sufficiently and conspicuously posted in all areas regulated
by this section. The signs shall be clearly visible to the public
and shall contain letters or a symbol which contrasts in color with
the sign, indicating that smoking is prohibited at the designated
area. The sign shall also indicate that violators are subject to a
fine.

The enforcement authority of this section shall be the Police
Department, Fire Department, Recreation Department, Public Works Department
and Health Department of the Township of Edison.

Any person who violates any provision of this chapter shall
be subject to a fine of not less than $250 for the first offense,
$500 for the second offense and $1,000 for each subsequent offense.
Any municipal employee found in violation of this section may also
be subject to discipline in accordance with the provisions of the
Township of Edison’s policies and procedures.

The Township, the Borough of Metuchen and Middlesex County together
created an off-leash dog area for use by local residents at the existing
Whitman Avenue Park located at 125 Whitman Avenue (Block 199.A, Lot
31.B1) in Edison (the "Dog Park").
In connection with the public's use and enjoyment of the Dog
Park, the Township desires to adopt and implement a set of rules and
regulations (the "Rules and Regulations"), which may be amended from
time to time, and which will govern the use of the Dog Park.
