There shall be a Department of Law, the head of which shall be the Township Attorney. He or she shall be appointed by the township committee for a term of one (1) year and until his or her successor has been appointed. The Township Attorney shall be an independent contractor who shall be compensated for the services he or she renders to the Township on a basis to be agreed upon between the Township Attorney and the Township Committee and approved as part of the budget annually adopted by the Township Committee. The Township Attorney shall not be an employee of the township and therefore shall be paid only for his or her professional services. The Township Attorney shall not be eligible for any of the benefits accruing to employees of the Township, such as, but not limited to payments into the retirement system, unless otherwise agreed to by the Township Committee.

The Township Attorney shall be the legal advisor to the Township Committee and to all departments except those handled by the Township Prosecutor, the Board of Adjustment Attorney and the Planning Board Attorney. He shall prosecute or defend actions and proceedings by and against the Township and every Department thereof. In furtherance of these general powers, and without limitation thereto, the Township Attorney shall:
a. 
Advise the Township Committee as to the form and sufficiency of all ordinances and resolutions prior to their passage.
b. 
Review and approve all contracts, deeds, documents and instruments prior to the execution thereof by or on behalf of the Township.
c. 
Conduct or defend appeals from orders, decisions or judgments affecting any interest of the Township, as Township Attorney may in his discretion determine to be necessary or desirable or as directed by the Township Committee.
d. 
Subject to the approval of the Township Committee, have power to enter into any agreement, compromise or settlement of any litigation in which the Township is involved.
e. 
Render opinions in writing upon any question of law submitted to the Township Attorney by the Township Committee with respect to their official powers and duties or the powers and duties of any Officer of the Township.
f. 
Maintain a record of all actions, suits, proceedings and matters which relate to the Township's interest and report thereon as the Township Committee may require.

There shall be a Department of Finance, the head of which shall be the Chief Financial Officer.

There is hereby created the position of Chief Financial Officer of the Township of Frelinghuysen. The Chief Financial Officer shall be appointed by the Township Committee for a one (1) year term commencing on January 1 of the year in which is appointed. The Township Committee may appoint such Assistant or Deputy Municipal Finance Officers as it sees fit. The salaries of the Chief Financial Officer and any Assistants or Deputies appointed hereunder shall be set by the Township Committee by ordinance. The Chief Financial Officer shall be subject to the provisions of the laws of the State of New Jersey relating to tenure of office, removal from office, and certification in accordance with N.J.S.A. 40:9-140 1 et seq. Commencing January 1, 1991 no persons shall be appointed Chief Financial Officer in the Township unless person holds a Municipal Financial Officers Certificate and complies with the provisions of N.J.S.A. 40A:9-140 et seq.

The Chief Financial Officer shall be a resident of the Township of Frelinghuysen, shall receive such compensation as prescribed by the salary ordinance and shall give bond for the faithful performance of his duties. This bond is to be paid for by the Township. However, if no person is so qualified from within the Township, then the Township Committee may appoint someone from without the Township.

Compensation for the Chief Financial Officer shall be established by ordinance. When the Township Treasurer is appointed to simultaneously serve as Chief Financial Officer, such person shall receive no additional compensation for serving as Chief Financial Officer, beyond the salary established by Ordinance for the Treasurer position.

Any temporary appointment as Chief Financial Officer of the Township shall be for a period not to exceed two (2) years.

The Chief Financial Officer shall:
a. 
Receive funds entrusted, received or under the control of any department and deposit all funds received by him in depositories authorized by the Township Committee by resolution.
b. 
Have custody of all investments and invested funds of the Township or in possession of the Township in a fiduciary capacity, except as otherwise provided by law, and keep such funds and all moneys of the Township not required for current operations safely invested or deposited in interest-bearing accounts.
c. 
Have the safekeeping of all bonds and notes of the Township and the receipt and delivery of Township bonds and notes for transfer, registration or exchange.
d. 
Keep a full account of all cash receipts and disbursements of the Township and at least once a month, or oftener if the Township Committee requires, furnish the Township Committee with a statement of all moneys received and expended by him.

The Tax Collector shall be an appointed position as provided by law and shall be the Official charged with the duty of collecting taxes within the Township.

The Tax Collector shall perform the function of a Collector of Taxes under general law, including, without limitation thereto, the preparation and mailing of the tax bills, enforcements of tax collections by tax sales and otherwise and the maintenance of tax accounting records in such matter as may be prescribed or approved pursuant to ordinances, and in furtherance thereof, install and administer tax bill forms which include a bill for the first two (2) quarters of each year with the bill for the final half of the preceding year.

The Township Committee shall appoint by resolution a Tax Assessor and such Deputy Tax Assessors as it may determine necessary.

The Tax Assessor and any Deputy Tax Assessor shall hold office for a term of four (4) years from the first day of July next following the appointment. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.

The Township Tax Assessor shall hold a Tax Assessor's Certificate provided for in Public Laws 1967, ch. 44 (C. 54:1-35 et seq.). The Tax Assessor shall:
a. 
Have, perform and discharge all the functions, powers and duties prescribed by law for a Municipal Assessor.
b. 
Maintain adequate assessment records of each separate parcel of real property assessed or exempted.
c. 
Maintain a current tax map of the Township as a public record and cause to be recorded thereon all changes in ownership or character of the real property assessed, employing for that purpose the facilities of other Departments as provided by the Code.
d. 
Report to the Township Committee as to equalization proceedings and other matters involving the County Tax Board and make recommendations as to action to be in that regard.

As authorized by N.J.S.A. 40:55D-3 the Tax Assessor is hereby designated as the administrative officer authorized to issue certifications of lists of adjoining property owners pursuant to N.J.S.A. 40:55D-12(c), being a portion of the Municipal Land Use Law.

The Township Engineer shall be appointed by the Township Committee for a term of one (1) year and until his or her successor has been appointed. The Township Engineer shall be a duly licensed engineer and land surveyor of the State of New Jersey. The Township Engineer shall be an independent contractor who shall be compensated for the services he or she renders to the Township on a basis to be agreed upon between the Township Engineer and Township Committee and approved as part of the budget annually adopted by the Township Committee. The Township Engineer shall not be an employee of the township and therefore shall be paid only for his or her professional services. The Township Engineer shall not be eligible for any of the benefits accruing to employees of the Township, such as, but not limited to payments into the retirement system, unless otherwise agreed to by the Township Committee.

The Township Engineer shall perform such duties as are prescribed by general law and ordinance and in addition shall:
a. 
Prepare or cause to be prepared plans, designs and specifications for public works and improvements undertaken by the Township.
b. 
Provide and maintain surveys, maps, plans, specifications, estimates and control records with respect to public works and facilities owned or operated by the Township or to be acquired or built.
c. 
Provide technical and engineering advice, estimates and review of plans and assistance to other Township Departments as needed.
d. 
Attend meetings of the Township Committee, Planning Board and Zoning Board as needed.
e. 
All papers, documents, memoranda, reports and other materials relating to the administration of engineering duties of the Township Engineer shall be and remain the property of the Township. Upon the termination of his services with the Township, the Township Engineer shall forthwith surrender to any successor all such property.

Whenever the Township Committee determines that the interest of the Township requires additional engineering services, consulting engineers may be retained for one (1) or more projects or to render assistance to the Township Engineer.

The Department of Public Works is hereby established in the Township.

The Department of Public Works shall be under the immediate control and direction of the Township Committeeman in charge of public works, who shall be designated "Director of Public Works" and who shall be subject and subordinate to the ultimate control and direction of the Township Committee.

a. 
The Department of Public Works shall consist of the Director of Public Works, who shall be the head of the Department, the Road Foreman and all other officers and employees assigned thereto. All officers and personnel of the Public Works Department shall be appointed by the Mayor, with the advice and consent of the Township Committee.
b. 
The duties of the Director of Public Works shall include the following:
1. 
Management of work order requests for road repair and maintenance;
2. 
Development of weekly work schedules, in conjunction with the Road Foreman;
3. 
Ordering materials needed for road repair and maintenance; and
4. 
Such other duties as the Director of Public Works may prescribe concerning road repair and maintenance within the Township.
c. 
A work log and time sheets for employees of the Department of Public Works shall be maintained by the Township Clerk.

The Department of Public Works shall have charge of and supervision over the care, maintenance and construction of all streets, sidewalks, alleys and public ways; the construction, operation and maintenance of all storm-water and sanitary sewers, and all street gutters and drains, and the appurtenances thereto. In addition, the Department of Public Works shall be responsible for the removal of snow, cleaning of streets, trash disposal and such other duties as may be imposed upon it by the Township Committee.

All physical properties of the Township, including the parks, playgrounds, municipal buildings and utilities not assigned to some other Department or Officer are hereby assigned to the Department of Public Works. In addition, the Director of Public Works shall be custodian of all tools, equipment and other personal property belonging to the Township and not assigned to the care of another Municipal department, employee or other public officer.

a. 
There is hereby created the position of Purchasing Agent for the Township of Frelinghuysen.
b. 
The Purchasing Agent shall be appointed by the Mayor, with the advice and consent of the Township Committee. The term of office for the Purchasing Agent shall be one year.
c. 
The Purchasing Agent is required to possess a valid Qualified Purchasing Agent certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.

The Purchasing Agent shall have, on behalf of the Township of Frelinghuysen, the authority, responsibility and accountability for the purchasing activity pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.); to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forms and procedures promulgated by State regulatory agencies; and conduct any activities as may be necessary or appropriate to the purchasing function of the Township of Frelinghuysen.
