The Township of Frelinghuysen Environmental Commission is hereby
established pursuant to Chapter 245 of the Laws of 1968 (N.J.S.A.
40:56A-5), as amended by Chapter 35, P.L. 1972.

a. The Environmental Commission shall consist of five members to be
appointed by the Mayor, one of whom shall also be a member of the
Land Use Board and all of whom shall be residents of the Township.
The members shall serve without compensation except as hereinafter
provided. The Mayor shall designate one of the members to serve as
Chairman and presiding officer of the Commission. The terms of all
Commissioners shall be three years and until the appointment and qualification
of their successors.
b. There shall be, in addition to the five Commissioners appointed,
two alternate Commissioners to serve on the said Commission. The terms
of all alternate Commissioners shall be two years and until the appointment
and qualification of their successors.
c. The Mayor or Township Committee may remove any member of the Commission
for cause, on written charges served upon the member and after a hearing
thereon at which the member shall be entitled to be heard in person
or by counsel. A vacancy on the Commission occurring otherwise than
by expiration of a term shall be filled for the unexpired term in
the same manner as an original appointment.

The Commission is established for the protection, development
or use of natural resources, including water resources, located within
the territorial limits of the Township. The Commission shall have
power to conduct research into the use and possible use of the open
land areas of the Township and may coordinate the activities of unofficial
bodies organized for similar purposes, and may advertise, prepare,
print and distribute books, maps, charts, plans and pamphlets which
in its judgment it deems necessary for its purposes. It shall keep
an index of all open areas, publicly or privately owned, including
open marshlands, swamps and other wetlands, in order to obtain information
on the proper use of such areas, and may recommend to the Planning
Board, plans and programs for inclusion in the Master Plan and the
development and use of such areas.

The Environmental Commission may, subject to the approval of
the Township Committee, acquire property, both real and personal,
in the name of the Township by gift, purchase, grant, bequest, devise
or lease for any of its purposes and shall administer the same for
such purposes subject to the terms of the conveyance or gift. Such
an acquisition may be to acquire the fee or any lesser interest, development
right, easement (including conservation easement), covenant or other
contractual right (including a conveyance on conditions or with limitations
or reversions), as may be necessary to acquire, maintain, improve,
protect, limit the future use or otherwise conserve and properly utilize
open spaces and other land and water areas in the Township.

The Environmental Commission shall keep records of its meetings
and activities and make an annual report to the Township Committee.

The Commission may appoint such clerks and other employees as
it may require, providing the same shall be within the limits of funds
appropriated to it by the Township Committee.

The Environmental Commission shall hold public meetings in accordance
with the Open Public Meetings Act. A total of six meetings shall be held per year, on alternate
months, provided that special meetings may be held as necessary and
according to law.

There is hereby established in the Township a Recreation Committee,
which shall have the duties and powers hereinafter more particularly
set forth, the members of which shall be appointed by the Township
Committee in accordance with the provisions of this section.
a. The Recreation Committee shall be comprised of not less than five
nor more than seven members, who shall be citizens and residents of
the Township of Frelinghuysen. All appointments shall be for a term
of three years, and all vacancies shall be filled for the unexpired
term only. One member of the Township Committee, appointed by the
Mayor, shall serve as an ex-officio member of the Recreation Committee
but shall have no vote unless he/she shall also be formally appointed
as a member of the Recreation Committee. The Township Committee may
appoint up to two alternate members, who shall be designated as "Alternate
No. 1" and "Alternate No. 2." Of the alternates first appointed, Alternate
No. 1 shall be appointed for a two-year term, and Alternate No. 2
shall be appointed for a one-year term. Alternate members may participate
in discussions but shall not vote except in the absence or disqualification
of a regular member. In the event that an alternate member is permitted
to vote, he/she shall vote in the following order: Alternate No. 1,
and then Alternate No. 2.
b. In the event that any member or alternate member fails to attend
three consecutive meetings without being excused by a majority of
the authorized members, the seat of that member or alternate member
shall be deemed vacant effective immediately.
c. In order to foster community participation in the Township's recreational
activities and to encourage citizens to participate in the planning,
coordinating and management of said activities, the Frelinghuysen
Township Recreation Committee may, at its discretion, annually assign
volunteers to help to participate in the planning, coordinating and
management of said approved activities. Any volunteers assigned under
this subsection shall be permitted to participate in discussions that
pertain to said activity but may not vote and will not be considered
members of the Recreation Committee. The term of an assigned volunteer
under this subsection shall expire 10 days after said activity is
completed.
a. The Township Committee shall cooperate with the Recreation Committee
to coordinate recreational activities in the Township in order to
plan a balanced recreation program for the citizens of the Township
and in order to provide maximum use of recreational facilities.
b. The Recreation Committee here established shall not be or be deemed
to be a Recreation Commission pursuant to N.J.S.A. 40:12-1 et seq.
and shall not have the power or authority to purchase land or hold
title to any real property.
c. The Township Committee shall annually appropriate in its budget funds
that may be used by the Recreation Committee to provide for a balanced
recreation program. The Recreation Committee may accept additional
financial support from fees, gifts, donations or other sources.
d. Neither the Recreation Committee nor any member or members thereof
shall have any power or right, express or implied, to bind or obligate
the Township of Frelinghuysen or the Township Committee directly or
indirectly.
The primary purpose of the Recreation Committee shall be to
provide advice to the Township Committee with respect to the initiation
and coordination of recreational programs for the citizens of the
Township. In addition, the Recreation Committee shall perform such
other duties as the Township Committee may prescribe to it concerning
recreation within the Township.
The Recreation Committee may organize as it sees fit, choosing
a Chairman from among its members and such other officers as it may
deem advisable; adopt rules and bylaws for the proper administration
of its functions; and formulate committees for the administration
and handling of its programs.
a. The Recreation Committee shall organize within 30 days after the
appointment of its total membership for the remainder of the current
calendar year, and thereafter, annually, during the first nine days
of January, by the selection of one of its members as Chairman, one
as Vice Chairman and one as Secretary/Treasurer. Such officers shall
perform the duties usually associated with such offices. They shall
keep minutes of its meetings, as well as complete and detailed records
of its activities, and certified copies of the minutes and records
of its activities shall be submitted to the Township Committee for
filing with the body.
b. The Frelinghuysen Mayor, Deputy Mayor and Township-appointed liaison
cannot serve as Chairman, Vice Chairman or Secretary/Treasurer. Only
upon the occurrence of a temporary vacancy of Chairman, Vice Chairman
and/or Secretary/Treasurer shall any elected Frelinghuysen Township
official be allowed to fill said positions on a temporary basis with
the approval of The Frelinghuysen Township Committee.
In order to provide funds, in whole or in part, necessary to
improve, maintain and police the playgrounds or recreation places
within the Township, the Recreation Committee may arrange and provide
for the giving of outdoor exhibitions, concerts, games and contests
and may use and employ such playgrounds or recreation places for the
purpose of giving thereon outdoor exhibitions, concerts, games and
contests. It may charge and collect a reasonable admission fee therefor.
All funds raised by the Recreation Committee shall be accounted for
and placed in a special Township fund or account. These funds shall
only be spent in connection with the duties and activities of the
Recreation Committee as hereinbefore defined.
a. Outside entities, such as, but not limited to, booster clubs, sponsorship
committees, and athletic/recreational organizations, that are looking
to support, fund, promote or participate in conjunction with the Frelinghuysen
Recreation Committee, its programs and/or events are subject to approval.
Prior to any such approval being granted, any such group seeking approval
shall provide the Recreation Committee with the following for review:
2. Proof of liability insurance in a form and amount satisfactory to
the Recreation Committee, which insurance shall be maintained in full
force and effect;
3. Proof that such group is a 501(c)(3) organization under the Internal
Revenue Code, is organized so that all donations are deductible from
federal income taxation, and is duly incorporated under the laws of
the State of New Jersey, which statuses shall be maintained in full
force and effect.
b. No member of the Frelinghuysen Township Committee or Recreation Committee
shall be a member of any booster club, sponsorship committee, athletic/recreational
organization or like organization that is looking to support, fund,
promote or participate in any Recreation Committee program or event.
c. Any equipment or other items purchased or obtained by any such group
for use at Frelinghuysen Township facilities shall be deemed to have
been donated by such group to the Township of Frelinghuysen.
d. Copies of any documents filed by such group with the federal or state
government shall be provided to the Recreation Committee at the time
of filing.
e. Any programs and/or events in support of the Frelinghuysen Recreation
Committee must be approved, in writing, by the Frelinghuysen Recreation
Committee.
f. All notices, marketing materials and/or advertising in support of,
or participating with, the Frelinghuysen Recreation Committee and
its programs and/or events must be approved, in writing, by the Frelinghuysen
Recreation Committee.
a. The Recreation Committee shall have control over Rydell Field and
the recreation fields and facilities associated with the Bear Creek
Greenway, and control of any recreation fields or facilities for active
recreation use which are designated and approved in the Forestry and
Use Plan for the FFP North adopted by the Township, and may adopt
such suitable rules, regulations and bylaws for the scheduling and
use of same as it may deem necessary, subject to the review and approval
of the Township Committee. The Township Committee retains the ability
to schedule maintenance fees, and control over all areas not used
for active recreation purposes set forth above.
b. For these purposes, the term "active recreation" means and is intended
to include any organized recreational activity.
c. For these purposes, the term "passive recreation" includes recreation
activities that are usually quiet and not rigorously athletic and
have a low impact on the surrounding environment. These activities
may include walking, hiking, fishing, bird watching, and quiet picnicking.
Parks that provide passive recreation may include trails, public gardens
or memorial parks, open areas, and picnic areas. Passive recreation
parks tend to be larger than active recreation facilities and may
have natural or scenic significance, containing a stream, woodland,
or historically significant resource. County or state facilities are
primarily designed for passive recreation and may require a further
distance to travel. Examples include: astronomy, bird/wildlife observation,
kite flying, group meetings, conservation activities, hiking, trail
walking, open-air theater, orienteering, photography, picnics, and
indoor meetings.
d. All control of hunting, fishing or trapping is reserved exclusively
to the Township Committee.
Subject to the approval of the Township Committee, the Recreation
Committee may hire custodians, supervisors and assistants for the
purpose of preserving order and observance of its rules, regulations
and bylaws at the facilities under its full control.
a. Any person violating any provisions of this section or violating
any of the rules and regulations or bylaws of the Township Committee
or Recreation Committee shall be subject to penalties as follows:
1. For a first offense: a fine in the amount of $200, and, in the discretion
of the Judge of the Municipal Court before whom the cause shall be
heard, imprisonment for a period of 30 days.
2. For a second offense: a fine in the amount of $500 and, in the discretion
of the Judge of the Municipal Court before whom the cause shall be
heard, imprisonment for a period of 30 days.
3. For at third or additional offense: a fine in the amount of $1,000,
and, in the discretion of the Judge of the Municipal Court before
whom the cause shall be heard, imprisonment for a period of 30 days.
b. Each day that a violation is permitted to exist shall constitute
a separate offense.

Pursuant to N.J.S.A. 26:2BB-9, there is hereby created and established
an Ad Hoc Advisory Committee of the Township Committee to be known
as "Frelinghuysen Township Municipal Alliance against Drug and Alcohol
Abuse," hereinafter referred to as "FTMA."

The FTMA shall consist of an unlimited number of members to
be appointed by the Township Committee. There shall be a minimum of
seven (7) members, one (1) from each of the following five (5) classes
or categories of people: (1) a member of the Township Committee; (2)
a person who is a member of the Township Board of Education or the
Township Superintendent of Schools or designee or a teacher or guidance
counselor from the Township school system; (3) a representative of
a local civil organization; (4) a representative of the local Parent
Teachers Association; (5) an individual who has been directly affected
by their own or family member's abuse or addiction. Any number of
additional members may be appointed from among the aforesaid classes
or groups of people or from among the following classes or groups:
Township school students; teacher associations, public or private
organizations or individuals involved in treatment of alcohol and
drug related problems; civil youth organizations, representative of
a local religious group; the media or any interested citizen.

The Township Committee may remove any member of the FTMA with
cause. A vacancy on the FTMA occurring otherwise than by expiration
of a term of a member may be filled for the unexpired term in the
same manner as the original appointment.

a. The FTMA, in consultation with the local (County) Advisory Committee
on Alcoholism and Drug Abuse shall identify alcoholism and drug prevention,
education and community needs.
b. The FTMA shall implement the Alliance programs formulated pursuant
to N.J.S.A. 26:2BB-8.
c. The FTMA may apply for funding through the procedures described in
N.J.A.C. 17:40-1.1 et seq.
d. The FTMA shall be responsible for:
1. Organizing and coordinating efforts involving schools, law enforcement,
business groups and other community organizations for the purpose
of reducing alcoholism and drug abuse;
2. In cooperation with local school districts, developing comprehensive
and effective alcoholism and drug abuse education programs in grades
K-12;
3. In cooperation with local school districts, developing procedures
for the intervention, referral to treatment and discipline of students
abusing alcohol or drugs;
4. Developing comprehensive alcoholism and drug abuse education support
and outreach efforts for parents in the community;
5. Developing comprehensive alcoholism and drug abuse community awareness
programs;
6. Creating a network of community leaders, private citizens, and representatives
of public and private human service agencies who make a comprehensive
and coordinated effort to promote and support drug and alcohol prevention
and education programs and related activities with an emphasis on
youth;
7. Conducting an assessment of their community to determine the needs
of the community in relation to alcoholism and drug abuse issues;
8. Identifying existing efforts and services acting to reduce alcoholism
and drug abuse;
9. Coordinating projects within the municipality to avoid fragmentation
and duplication;
10. Developing programs to be implemented at the municipal level or participating
in regionally developed programs that accomplish the purposes of the
Alliance effort and of the FTMA;
11. Assisting the Township in acquiring funds for Alliance programs including
the establishment of a permanent, standing subcommittee on fund raising;
12. The FTMA shall keep such records and provide such information to
the Governor's Council as may be required for fiscal audit;
13. The FTMA shall cooperate with the Governor's Council on alcoholism
and drug abuse and the Alliance Steering Subcommittee of the County
Local Advisory Committee on Alcoholism and Drug Abuse to provide municipal
data, reports or other information which may be required for the County
Alliance Plan or needed to assist the Alliance effort.

The FTMA shall meet promptly after appointment and shall elect
a Chairperson and Co-Chairperson. The FTMA shall hold quarterly meetings.
Minutes shall be kept of all FTMA meetings and a quorum shall be required
for action to be taken by the FTMA.

Before the FTMA receives DEDR (Drug Enforcement and Demand Reduction
penalties described by N.J.S.A. 2C:35-15 et seq.) funds from the Governor's
Council, the FTMA shall develop a comprehensive plan to provide matching
funds equivalent to the amount of the grant award. The comprehensive
plan for providing matching funds may include but is not limited to,
the following:
a. The donation of the use of municipal property at a fair market value
to the project.
b. Time, as reflected by salary and wages, of the municipal and private
sector employers who perform services in accordance with the project.
c. Complimentary (public service) advertising on local media, such as
newspapers, radio and cable television, above the level of standard
public service requirements.
d. Organized community benefits focused on the Alliance which utilize
celebrities, sports figures or experts in the field of addictions,
who donate their services.

Periodic reports shall be submitted to the Township Committee
by the FTMA respecting progress in obtaining matching funds, and shall
include as well, on a form prescribed by the Governor's Council, a
progress report detailing the progress made on accomplishing the purposes
of the grant. The Township shall submit to the Governor's Council
on forms prescribed: 1) detailed and accurate accountings of all expenditures
made under the grant; 2) periodic reports of the progress made in
accomplishing the purposes of the grant; 3) at the end of each fiscal
year in which any grant falls, the Township must submit an audited
financial statement explaining its use of funds and provide such other
information as may be prescribed by the Governor's Council. The form
of the within submissions must be consistent with the requirements
of N.J.A.C. 17:40-3.4. In no event shall any funds from the grant
be used to undertake any activity which is not in accordance with
the purpose of the grant as approved by the Governor's Council.

All actions of the Township Committee and the Township of Frelinghuysen
heretofore recognizing the "Frelinghuysen Township Municipal Alliance"
endorsing grant applications and supporting the Frelinghuysen Township
Municipal Alliance Committee are hereby ratified and affirmed.
