[1982 Code § 15-1; New]
There shall be a Municipal Court in the Borough pursuant to the provisions of N.J.S.A. 2B:12-1 et seq., to be known as the "Municipal Court of the Borough of Little Ferry." The Municipal Court shall have a seal bearing the impress of the name of the court. The court shall be held in the Borough Hall of Little Ferry or such other place as the Borough Council shall designate from time to time, and shall exercise all of the functions, powers, duties and jurisdiction conferred upon municipal courts by the provisions of N.J.S.A. 2B:12-1 et seq.

There shall be a Judge of the Municipal Court appointed by the Mayor with the advice and consent of the Borough Council, who shall serve for a term of three (3) years from the date of appointment and until a successor shall be appointed and qualified. The Judge of the Municipal Court shall have and possess the qualifications and shall have, possess and exercise all of the functions, duties, powers and jurisdiction conferred by N.J.S.A. 2B:12-1 et seq., or by general law or ordinance.

a. 
There shall be an Administrator of the Municipal Court who shall be appointed by the Mayor and Borough Council and who shall perform such functions and duties as shall be prescribed for him/her by law, the rules applicable to municipal courts and by the Municipal Judge. His/her duties shall include but not be limited to:
1. 
Carrying out the rules, regulations, policies and procedures relating to the operations of the court.
2. 
Interviewing and speaking to prospective complainants, receiving complaints and dispensing information relating to court matters.
3. 
Maintaining the financial records of the court.
4. 
Attending court, taking minutes of the trials, and entering them in the docket, arranging trial calendars, signing court documents and preparing and issuing warrants and commitments.
5. 
Taking and preparing bail bonds, making inquiry as to their sufficiency and equity and receiving and accounting for fines and costs.
6. 
Interviewing persons on informal police matters to determine if there is a basis for formal action and, if necessary, issuing summonses requiring court appearances in this regard; and maintaining and classifying records and files.
b. 
Other necessary employees for the Municipal Court shall be appointed by the Mayor and Borough Council pursuant to N.J.S.A. 2B:12-10.
c. 
Tenure of Office. Tenure for Municipal Court Administrators shall be in accordance with N.J.S.A. 2A:8-13.1.

There shall be a Municipal Public Defender who shall be appointed for a term of one (1) year by the Mayor with the consent of the Borough Council. He or she shall be an attorney at law of New Jersey but need not be a resident of the Borough.

The Municipal Public Defender shall receive such compensation as may be determined by the Mayor and Borough Council.

The Municipal Public Defender shall have such powers and duties as provided for by State statutes, general laws and Borough Ordinances and shall attend all Municipal Court sessions in and for the Borough of Little Ferry.

In the event that a person appearing before the Municipal Court of the Borough of Little Ferry applies for representation by a Municipal Public Defender, it shall be a requirement for such appointment that any such person applying for representation by a Municipal Public Defender shall pay an application fee of not less than fifty ($50.00) dollars nor more than two hundred ($200.00) dollars to the Municipal Court of the Borough of Little Ferry. The Municipal Court may waive any required application fee, in whole or in part, if the Court determines, in its discretion, that the application fee represents an unreasonable burden to the person seeking representation.

a. 
There shall be a Municipal Prosecutor who shall be appointed for a term of one (1) year by the Mayor with the consent of the Borough Council. He or she shall be an attorney at law of New Jersey but need not be a resident of the Borough.
b. 
Compensation. The Municipal Prosecutor shall receive such compensation as may be determined by the Mayor and Borough Council.
