a. 
No person shall construct a fence on a public highway or park, within a public right-of-way, or other public place within the Borough without written permission from the Governing Body of the Borough of Rockleigh.
b. 
The extensive use of fencing, particularly the perimeter fencing of a property for purely decorative purposes should be avoided.
c. 
The following fences, fence size, and fence style guidelines shall be utilized for particular uses unless Borough of Rockleigh Historic Preservation Commission or the Rockleigh Historic Guidelines recommendations states otherwise:
1. 
Split rail fencing shall be utilized for a corral or animal pen.
2. 
Picket-type fencing shall be utilized for gardens and planting areas.
3. 
Cedar and pine are appropriate materials for split-rail fences and picket fences.
4. 
Split-rail fences shall either consist of two rails between posts or three rails between posts using eleven-foot long rails (allowing for overlap) so that fences measure a minimum of 10 feet from center to center of posts.
5. 
Two-rail fences shall be three feet high utilizing five-and-a-half- foot long posts.
6. 
Three-rail fences shall be four feet high utilizing seven-foot-long posts.
7. 
Colonial-style split-rail fences shall be four feet high utilizing a minimum of six-foot-long posts.
8. 
Board fences shall be constructed utilizing four boards with a maximum height of four feet.
9. 
Fence posts shall be spaced six to eight feet apart for corral fences.
10. 
In some cases, wrought-iron fencing might be appropriate, but it is more closely associated with institutional and urban locations.
11. 
Also permitted in conjunction with the installation of split rail fencing is hardware cloth or galvanized mesh, similar to chicken coop wire, directly behind a split-rail fence in order to keep small animals and livestock within the yard.
12. 
Contemporary fence materials, such as chain link (except for swimming pool protection), cedar sapling, basketweave, and other nontraditional designs and materials, are prohibited.
If the fence(s) requested are not as depicted as acceptable in § 34-45, plans depicting the fence location, size, and style shall be supplied to the Borough of Rockleigh Historic Preservation Commission for review and approval. If no relief/variance is required, application to the Borough of Rockleigh Planning Board is not required for acceptable fencing per this section. The Construction Official can issue a permit provided no zoning relief is necessary.
d. 
Except as may be prohibited by Subsection e hereof, if the subject site is located in a Zoning District permitting fences, fences within the front yard shall be no more than four feet in height above grade level. Fences located within the side and rear yard shall be no more than six feet in height above grade.
e. 
At a street intersection, no fence over 30 inches in height above street level shall obstruct the view diagonally across a corner as observed from any point along the street property line within 40 feet from the corner unless stipulated otherwise by another jurisdiction, not limited to Bergen County.
f. 
All fence construction within the Borough of Rockleigh requires application review and approval from the Borough of Rockleigh Planning Board unless it satisfies the requirements set forth in Subsection g within this section.
g. 
Fences are permitted to be constructed upon receipt of written permission from the Borough of Rockleigh Construction Code Official subject to the following:
1. 
The property at which the fence is to be constructed is located within the A One Family Residential 2 Acres Zone and is utilized for residential purposes.
2. 
The fencing satisfies the requirements set forth within this § 34-45.
3. 
The fencing does not require any relief from the Borough of Rockleigh Ordinances.
4. 
The fencing to be constructed satisfies and follows all recommendations supplied by the Borough of Rockleigh Historic Preservation Commission and the Rockleigh Historic Guidelines and does not require Planning Board approval.
If the above requirements are not satisfied, an application(s) for the necessary reviews must be submitted with the Borough of Rockleigh Planning Board for review and approval prior to any construction of said fence.

a. 
No person shall construct a wall on a public highway or park, within a public right-of-way, or other public place within the Borough without written permission from the Governing Body of the Borough of Rockleigh.
b. 
Walls shall be constructed of natural stone or brick or as recommended by the Borough of Rockleigh Historic Preservation Commission. Structural walls shall have a brick or stone veneer as recommended by the Borough of Rockleigh Historic Preservation Commission.
c. 
No person shall construct walls of contemporary materials. Contemporary materials would include but not be limited to manufactured block and concrete and such other materials as are precluded by the Rockleigh Historic Guidelines or as recommended by the Borough of Rockleigh Historic Preservation Commission unless the retaining wall is a structural wall. A structural wall shall not have exposed facing without an approved veneer.
d. 
At a street intersection, no wall over 30 inches in height above street level shall obstruct the view diagonally across a corner as observed from any point along the street property line within 40 feet from the corner unless stipulated otherwise by another jurisdiction not limited to Bergen County.
e. 
All retaining wall construction within the Borough of Rockleigh requires application review and approval from the Borough of Rockleigh Planning Board unless it satisfies the requirements set forth in Subsection f of this § 34-46.
f. 
Walls are permitted to be constructed upon receipt of written permission from the Borough of Rockleigh Construction Code Official subject to the following:
1. 
The property at which the wall is to be constructed is located within the A One Family Residential 2 Acres Zone and is utilized for residential purposes.
2. 
The wall to be constructed is not a structural wall.
3. 
The wall to be constructed does not exceed two feet in height.
4. 
The wall satisfies the requirements set forth within this § 34-46.
5. 
The wall does not require any relief from the Borough of Rockleigh Ordinances.
6. 
The wall to be constructed satisfies and follows all recommendations supplied by the Borough of Rockleigh Historic Preservation Commission and the Rockleigh Historic Guidelines and does not require Rockleigh Planning Board approval.
If the above requirements are not satisfied, an application must be submitted to the Borough of Rockleigh Planning Board for review and approval prior to any construction of said wall.
