The purpose of this Cluster Overlay District is to recognize the special situations which have been created by revisions to this chapter that have created numerous nonconforming lots and uses in subdivisions which had been previously approved by the Township under previous provisions of this chapter. In order to permit appropriate uses and limited reasonable expansions of existing uses, and in keeping with the character of the existing neighborhoods involved, this Cluster Overlay District is intended to minimize the need for variance requests by permitting controlled limited changes to existing residential uses provided by this district.

The Cluster Overlay District shall comprise the several overlay areas, as shown on the Official Zoning Map, generally comprising the existing subdivisions known as Hidden Valley Farms, Village at Farmington, Penn's Meadow, Spring Ridge Crossing, Traditions at Wild Cherry Knoll, Millbrook Chase, and Harris York.

The uses permitted by right in the Cluster Overlay District shall be identical to those permitted by right in the zoning districts within which the individual subdivisions comprising the Cluster Overlay District are otherwise situated, provided that additions to any residential uses existing as of the effective date of this Cluster Overlay District shall not be deemed nonconforming uses or structures so long as they comply with the requirements of this Cluster Overlay District.

The uses permitted by condition as provided in Part 24 which are permitted in the Cluster Overlay District shall be identical to those permitted by condition in the zoning districts within which the individual subdivisions comprising the Cluster Overlay District are otherwise situated.

The uses permitted by special exception as provided in Part 24 which are permitted in the Cluster Overlay District shall be identical to those permitted by special exception in the zoning districts within which the individual subdivisions comprising the Cluster Overlay District are otherwise situated.

The accessory uses which are permitted in the Cluster Overlay District shall be identical to those accessory uses permitted in the zoning districts within which the individual subdivisions comprising the Cluster Overlay District are otherwise situated.

All new principal buildings within the Cluster Overlay District shall comply with the lot area, lot width, building coverage, minimum yards, and height restrictions imposed by the zoning districts within which the individual subdivisions comprising the Cluster Overlay District are otherwise situated.

All expansions or additions to any principal use existing at on the effective date of this Cluster Overlay District shall comply with setback and buffer yard requirements shown on the recorded subdivision and land development plan.

All structures and uses within the Cluster Overlay District which are in compliance with this Part, but which do not comply with the lot area, lot width, building coverage, minimum yards, and height restrictions imposed by the zoning districts within which the individual subdivisions comprising the Cluster Overlay District are otherwise situated, shall nonetheless not be deemed to be nonconforming structures or uses, provided the structure or use is in compliance with all other provisions of this chapter.

Structures or uses within the Cluster Overlay District that were in compliance with this Part but which do not comply with the lot area, lot width, building coverage, minimum yards, or height restrictions imposed by the zoning districts within which the individual subdivisions comprising the Cluster Overlay District are otherwise situated and which are destroyed in whole or in part by fire or other hazards may be reconstructed within five years of the date of destruction, provided the reconstructed structure shall not exceed the requirements of this Part.
