The purpose of the Public Arts Commission is to review and consider applications for the creation of public art within the Town.

The Public Arts Commission shall be composed of the following seven regular members:
(a) 
Class 1: one representative from the Town Council;
(b) 
Class 2: the Mayor or his/her designee;
(c) 
Class 3: the Town Historian or his/her designee;
(d) 
Class 4: one representative from the Board or staff of the Downtown Westfield Corporation; and
(e) 
Class 5: three residents of the Town of Westfield who hold no other municipal office, position, or employment.

(a) 
All members of the Public Arts Commission shall serve without compensation and shall be appointed by the Mayor, subject to approval by the Town Council. The Downtown Westfield Corporation shall be permitted to make recommendations to the Mayor and Council for the appointment of a member to the Public Arts Commission; however, such recommendations shall not be binding upon the Mayor and Council. The Commission shall designate one of its members to serve as Chair and presiding officer on an annual basis.
(b) 
Appointments to the Public Arts Commission shall be as follows: Class 1, 2 and 3 members shall each be appointed for one-year terms. Class 4 and Class 5 members shall be appointed for two-year terms. Notwithstanding the forgoing, the initial terms of Class 5 members shall be one, two, and three years respectively. Any vacancy occurring other than by the expiration of a term shall be filled for the unexpired term only, in the same manner as the original term.
(c) 
Two alternates may be appointed by the Mayor, with the approval by the Town Council. Alternate members shall be designated at the time of appointment as "Alternate No. 1" and "Alternate No. 2." Each alternate member shall serve for a two-year term. If a vacancy occurs other than by expiration of a term, the seat shall be filled by the Mayor, with the approval of the Town Council, for the unexpired term only.

Any member of the Public Arts Commission may be removed by the Mayor and Council for cause, on written charges served upon the member and after a hearing thereon, at which the member shall be entitled to be heard in person or by counsel.

(a) 
The Public Arts Commission shall establish rules of procedure and design guidelines, which shall be submitted to the Mayor and Council for adoption by resolution. Once adopted, the rules of procedure and design guidelines shall be filed with the Town Clerk.
(b) 
The Public Arts Commission shall meet on an as-needed basis. There shall be a quorum required to act at Commission meetings, which is a majority of the full, regular members of the Commission.
(c) 
All Public Arts Commission meetings shall be subject to the New Jersey Open Public Meetings Act,[1] including the requirement of posting and notification of all meetings. Minutes of all meetings shall be maintained, and Commission-approved minutes shall be submitted to the Town Clerk for appropriate recordkeeping.

The Public Arts Commission shall have the following powers:
(a) 
The power to schedule meetings on an as-needed basis, to be called by the Chairperson, in accordance with the New Jersey Open Public Meetings Act.[1]

(b) 
The power to hear and review applications for the creation of public art within the Town, including the erection, painting and/or installation of murals, and the power to render decisions regarding the issuance or denial of permits therefor.
(c) 
The power to advise the Mayor and Council, the Planning Board, and the Board of Adjustment regarding matters which affect the creation of public art within the Town, including the erection, painting, and/or installation of murals or streetscapes.
(d) 
The power to create a nonexclusive list of spaces that are eligible and appropriate for the potential location and siting of murals and public art within the Town.
(e) 
The power to undertake any other duties or activities that may be assigned by the Mayor.
