The power of the municipality to adopt ordinances concerning
traffic and parking is contained in R. S. 39:4-197. Various statutory
provisions throughout Title 09 control the manner in which municipalities
may regulate parking and traffic. R. S. 39:4-8 requires that all traffic
and parking ordinances be approved by the Department of Motor Vehicles.
Any words or phrases used in this chapter shall have the same
meanings as those given to them in Subtitle I of Title 39 of the New
Jersey Revised Statutes.
The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other and more
restrictive provisions prohibiting or limiting the stopping, standing
or parking of vehicles contained in N. J. R. S. 39:4-138, any other
New Jersey Statute, or as provided in this chapter.
The parking or storing of automobiles, vehicles, parts, tools
and equipment on any public street of the city for the purpose of
sale or for making repairs except in an emergency, is prohibited.
The chief of police or, in his absence, the ranking police officer
of the police department is authorized to declare an emergency and
direct the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, fires, public celebrations and similar occurrences require
the avoidance of conditions which are hazardous or which interfere
with the free flow of traffic.
Upon the declaration of an emergency, there shall be no parking
upon streets or parts of streets where EMERGENCY NO PARKING signs
are displayed.
Notification that EMERGENCY NO PARKING signs are being or will
be posted shall be given to the operator or owner of any vehicle which
has been parked prior to the posting of the signs.
Pacific Avenue is hereby declared to be an emergency snow route.
Whenever snow has fallen and the accumulation is such that it covers
the street, no vehicle shall be parked on Pacific Avenue and this
prohibition shall remain in effect after the snow has ceased and until
the streets have been plowed sufficiently to the extent that parking
will not interfere with the normal flow of traffic. Permanent signs
reading NO PARKING WHEN ROAD IS SNOW COVERED shall be erected at 200
foot intervals on either side of Pacific Avenue.
Any unoccupied vehicle parked or standing in violation of this
section is declared to be a nuisance, an obstruction to the flow of
traffic and a danger to other vehicles using the highway. Any police
officer may remove such a vehicle or cause it to be removed and the
owner shall pay all expenses incurred in re-moving or storing the
vehicle before regaining possession of it. Removal or storage charges
shall be in addition to any penalty imposed for violation of this
section.
No person shall park a vehicle upon any of the streets or parts
of streets described in Schedule I attached to and made a part of
this chapter.
Parking meter zones are hereby established on the following
described streets and parts of streets within the locations indicated
in Schedule II.
The director of public works shall provide for the installation,
regulation, control, operation and use of parking meters and maintain
them in good working condition. Parking meters installed in parking
meter zones shall be placed upon the curb immediately adjacent to
individual parking spaces. Each parking meter shall be set so as to
show by a signal if the parking space adjacent to the meter is or
is not legally in use. No parking meters shall be in-stalled in any
area where parking is prohibited by the provisions of N. J. R. S.
39:4-138.
The director of public affairs and public safety shall have
lines or markings painted or placed upon the curb or upon the street
adjacent to each parking meter for the purpose of designating the
parking space for which the meter is to be used. Each vehicle parked
next to any parking meter shall park within the lines or markings
indicating the parking space. It shall be a violation of this chapter
to park any vehicle across any line or marking or to park any vehicle
in such a position that it shall not be entirely within the area designated
as a parking space. Vehicles shall be parked in such a manner that
the forward part of the vehicle is nearest to the meter.
When any vehicle is parked in any space adjacent to a parking
meter, the operator of the vehicle shall upon entering the parking
space immediately deposit or cause to be deposited in the parking
meter the proper coin required to operate the meter as designated
by directions on the meter. Failure to deposit the required coin shall
constitute a violation of this section.
Beginning May 15, 2008, the fee required for all parking meters
in the City of Wildwood shall be twenty-five ($.25) cents per 15 minutes
of parking time. Parking meter fees and hours of operation may be
revised by resolution of the governing body.
Parking shall be permitted in all parking areas for not more
than 12 hours.
It shall be a violation of the provisions of this section for
any person to:
It shall be the duty of the police department of the city in
accordance with the instructions issued by the director of public
affairs and public safety to report:
Notwithstanding any of the provisions of this section, there
shall be no duty to deposit any coins in the parking meters within
the city for the period between October 31 and May 15, inclusive.
Failure to deposit the required coins during that time period shall
not constitute a violation of this section. At all other times, failure
to pay or deposit the required fee shall constitute a violation of
this section, unless a valid parking permit or placard is displaced
in the vehicle according to regulations to be issued by the city's
office of parking meter enforcement, or such parking is allowed by
other provision or applicable law.
a.
Notwithstanding other subsections of this section 6-5, the owner of a residential property without a driveway in any parking meter zone shall be entitled to one free parking permit which shall enable the owner or any authorized resident, tenant or visitor to park on the same street the residence is located on. The owner shall obtain the permit from the city office of parking meter enforcement by providing bona fide proof of ownership. The parking permit shall be displayed in the front dashboard of the vehicle, or such other location as the chief of parking enforcement may direct by regulation, and enable the vehicle to park on the street without paying the parking meter charge to park in a valid parking spot. Street for purpose of this subsection is defined as the one block, off or even side of the street that their residence is located on from corner to corner not extending past any intersection or to any cross street. The prior owner shall provide the new owner any permits issued for the year upon a change in ownership.

Each placard will identify the residence of the vehicle it is for,
which shall be visible when displayed in the vehicle.
d.
Parking in front of private residential driveways shall also be permitted
but only whenever the vehicle and the driveway are owned by the same
person or a member of the same household as the owner or authorized
by the owner of the driveway, pursuant to N.J.S.A. 39:4-138.3.
e.
Permits shall be in such form and contain such information as may
be required by law. No replacements will be issued for lost placards,
however, replacements will be issued for a charge of ten ($10.00)
dollars to replace a damaged placard.

Parking by seasonal permit shall be allowed in the parking meter zones established pursuant to section 6-5 and Schedule II or II-A during times when fees are required, to permit holders to park without paying the parking meter charge.
a.
A Class "A" permit shall enable the vehicle to park at any metered
parking spot in the City of Wildwood without paying at the meter.
b.
A Class "B" permit will enable the vehicle to park at any metered
spot in the area bounded by Atlantic Avenue, Cresse Avenue, New Jersey
Avenue and 26th Street without paying at the meter.
c.
A Block permit shall enable the vehicle to park at any metered spot
within the designated block without paying at the meter.
e.
The governing body may amend, revoke, supplement or designate these
or other classes of permits or parking zones, the annual fees for
each class, if any, and whether or not the permits may be transferable,
by resolution as authorized by resolution as authorized by N.J.S.A.
39:4-8. All permits shall be issued by the city office of parking
meter enforcement and bear such other information required by law
or as may be determined to be necessary for enforcement. Unless otherwise
provided, all permits issued pursuant to this section shall be transferable
from one vehicle to another without prior approval or payment of an
additional fee.
a.
A seven day parking permit shall be available at a fee of fifty ($50.00)
dollars which shall allow a vehicle to park at any valid parking meter
spots in the City of Wildwood during times when fees are otherwise
required for seven consecutive days after issuance, but not beyond
the maximum time permitted for a vehicle and further provided that
such permits shall be transferable and shall be issued by the city
office of parking meter enforcement bearing such information required
by law and as may be determined to be necessary for enforcement of
parking meter zones.
b.
This shall not supersede parking otherwise allowed by vehicles with
other types of valid parking permits.
The area located between Spicer Avenue and Youngs Avenue west
of Hudson Avenue in the City of Wildwood is designated as the "bus
parking area" and the "loading and unloading" district.
All passenger transportation buses, commercial trucks and other
vehicles transporting passengers for hire or otherwise, except taxicabs,
are prohibited from parking except at the designated bus parking area.
All passenger transportation buses, commercial trucks and other
vehicles transporting passengers for hire or otherwise, except taxicabs,
that are unloading and loading within the City of Wildwood and parking
other than in the designated parking area must follow the same rules
and regulations as those buses parking at the designated bus parking
area.
The fee for all passenger transportation motor bus, commercial
truck or other vehicle transporting passengers for hire during the
regular season, shall be as follows:
a.
In-season (no parking provided by city): Fifty ($50.00) dollars for
each day or part of a day, from July 1st through September 15th of
each year.
b.
In-season (with parking at city-approved location): One hundred ($100.00)
dollars for each day or part of a day, from July 1st through September
15th of each year.
c.
Off-season (no parking provided by city): Twenty-five ($25.00) dollars
for each day or part of a day, May 1st through June 30th of each year.
d.
Off-season (with parking at city-approved location): Fifty ($50.00)
dollars for each day or part of a day, May 1st through June 30th of
each year.
e.
No permit fee is necessary from September 15th through April 30th
of the following year.
Any individual who, or entity which, fails to comply with the fee requirements set forth in subsection 6-6.3 above shall be required to promptly comply with same and shall be subject to a fine in the amount of fifty ($50.00) dollars per day over and above the cost of the permit fee for each day that the violation occurs.
The board of commissioners may amend the terms and provisions of subsection 6-6.3 by resolution.
No passenger transportation motor bus, commercial truck or other
passenger vehicle transporting passengers for hire shall be parked
in the area designated as the bus parking area unless a bus parking
permit is obtained in advance from the city clerk. All passenger transportation
motor buses, commercial trucks or other vehicles transporting passengers
for hire to the city shall have a permit prominently displayed on
the right side of the front windshield of the vehicle before entering
the city.
All applications for the permit referred to in subsection 6-6.4 shall, in order to be considered, be received in the city clerk's office not later than ten days before the day on which such passenger transportation vehicle or bus, commercial truck or other vehicle transporting passengers for hire is intended to be parked in the bus parking area. The application shall be considered only if there is sufficient available parking space for the vehicle in the area designated in subsection 6-6.1. Such applications shall be made on application forms which will be supplied upon request by the city clerk and shall be accompanied by cash or check in an amount sufficient to meet the requisite fee therefor as required by subsection 6-6.3.
Notwithstanding the provisions of this section, no bus parking
permit shall be required between September 15 through April 30 of
each year, inclusive; provided that any passenger transportation bus,
commercial truck or other vehicle transporting passengers for hire
to the city shall not park on the streets of the city. All other provisions
of this section shall remain in full force and effect.
At all times buses shall turn their engines off when parked,
and while loading and unloading within the city limits.
In accordance with the provisions of N.J.R.S. 39:4-85.1, the
streets or parts of streets described in Schedule III attached to
and made a part of this chapter are designated as one way streets
in the direction indicated.
In accordance with the provisions of N.J.R.S. 39:4-140, the
streets or parts of streets described in Schedule IV attached to and
made a part of this chapter are designated as through streets. STOP
signs shall be installed on the near right side of each street intersecting
the through street, except where YIELD RIGHT OF WAY signs are provided
for in the designations.
Pursuant to the provisions of N.J.R.S. 39:4-140, the intersections
described in Schedule V attached to and made a part of this chapter
are designated as stop intersections. STOP signs shall be installed
as provided in that schedule.
No person shall turn a vehicle or make a right turn when facing
a steady red signal (STOP) indication at any of the locations described
in Schedule VI attached to and made a part of this chapter whenever
an official sign is present prohibiting such a turn on a red signal.
No person shall turn a vehicle to make a right turn when facing
a steady red signal (STOP) indication at any of the locations described
in Schedule VII attached to and made a part of this chapter between
the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday, during
the school days, whenever an official sign is present prohibiting
such turn on a red signal.
No person shall turn a vehicle or make a left-hand turn at any
of the locations described in Schedule VIII whenever an official sign
is present prohibiting such a left-hand turn.

No person shall park a vehicle in a location herein designated
its a bus stop at any of the locations described in Schedule XI unless
said vehicle is a vehicle commonly known as a bus. All locations which
arc indicated as "seasonal - school'' shall he in effect from the
first Monday prior to the start of the school year until the first
Friday after the end of the school year, and signs for such locations
shall be installed and removed accordingly.
No vehicle shall be driven on the boardwalk or its approaches
without a written permit from the commissioner of public affairs and
public safety or the commissioner of parks, public property and public
works, or some other proper authority of the City of Wildwood.
No trailer trucks, trailer tractor trucks or other vehicles
having more than six wheels shall load or unload their contents east
of New Jersey Avenue between the hours of 10:00 a.m. and 11:00 p.m.
between June 1, and September 15 each year. Further, no trailer trucks,
trailer tractor trucks or other vehicles having more than six wheels
shall be permitted to park on public property for a period of more
than 12 hours without being moved.
The use of three-wheeled vehicles known as people-powered vehicles
(P, PVs) and similar vehicles consisting of a low-slung air-craft
type three-wheeled stance shall be hereby prohibited on all public
rights-of-way and .public ground in the City
of Wildwood.

Unless another penalty is expressly provided by Title 39 of
the Laws of the State of New Jersey (Motor Vehicle and Traffic Regulations)
or other express provisions of New Jersey Statutes, any person violating
or failing to comply with any provision of this chapter shall, upon
conviction thereof, be liable for a penalty of not more than $2,000,
and/or provide such community service not to exceed 90 days as is
deemed appropriate, and/or by imprisonment for a term not to exceed
90 days, or by such fine and/or community service and/or imprisonment,
at the discretion of the Court. The continuation of such violation
for each successive day shall constitute a separate offense, and the
person or persons allowing or permitting the continuation of the violation
may be punished as provided above for each separate offense.
In accordance with the provisions of N.J.S.A. 39:4-197(3)b,
the locations described in Schedule IX attached to and made apart
of this chapter are .designed as curb loading
zones.
No person shall park a vehicle for longer than the time limit
shown in Schedule X, Time Limit Parking, attached to and made a part
of this chapter, at any time between the hours, listed in Schedule
X of any day upon any of the streets or parts of streets described
in Schedule X.
In accordance with the provisions of N.J.S.A. 39:4-197(3)a,
the locations described in Schedule XII attached to and made a part
of this chapter are designated as taxi stands.

In accordance with the provisions of N.J.S.A. 39:4-197(3)c,
the locations described in Schedule XIII attached to and made a part
of this chapter are designated parking locations for persons with
disabilities.

a.
There shall be designated parking locations on the street, at an address as indicated in Subsection d herein, restricted for a specific person with a disability residing at a residence at said address who has shown to the Chief of Police or his/her designee the following: (1) Proof of issuance of a windshield placard or wheelchair symbol license plate for a vehicle owned by the person with a disability, or by another occupant of the residence who is a member of the immediate family of the person with a disability, by the New Jersey Motor Vehicle Commission; (2) Proof of ownership of the vehicle which shall be permitted to be parked in the restricted parking zone; and (3) Proof of residency at said address of the person with a disability which shall be a State of New Jersey-issued driver's license or other official identification from the State of New Jersey indicating such address as his/her primary residence. A parking zone restricted pursuant to this section shall only be available for residential properties which do not have available on-site parking. A site inspection by the Chief of Police or his/her designee shall confirm there is no on-site parking at the address.
b.
Upon approval
by the Chief of Police or his/her designee, the Clerk of the City
of Wildwood shall issue a permit, 5 1/2 inches by 8 1/2
inches in size, which shall bear an appropriate certification of authenticity,
which identifies a specific motor vehicle and location it may be parked,
to be displayed prominently within the vehicle when parked so as to
be seen from the middle of the street. Only a motor vehicle for which
a valid permit has been issued and which has been property displayed
shall be permitted to be parked in the restricted parking zone indicated
on such permit. Each designated person shall notify the City Clerk
and Chief of Police of any change in the vehicle and shall provide
a copy of the vehicle registration for any replacement vehicle. The
designated person shall only be permitted to register one vehicle
with the City for such purpose.
c.
Upon approval
by the Chief of Police or his/her designee, the City of Wildwood traffic
department shall determine the exact location of a restricted parking
zone in front of a residence, a sign designating same with appropriate
painted markings, and shall install same. The sign shall be in conformance
with the Manual of Uniform Traffic Control Devices.
d.
The restricted
parking place(s) and permitted user(s) shall be as follows:

a.
Definitions. The word "truck" shall be defined as:
1.
Every vehicle with or without motive power, other than a pole trailer,
designed for carrying persons or property and for being drawn by a
motor vehicle and so constructed that no part of its weight rests
upon the towing vehicle.
2.
Every motor vehicle designed, used, or maintained primarily for the
transportation of property.
3.
Every motor vehicle designed and used primarily for drawing other
vehicles and not so constructed as to carry a load other than a part
of the weight of the vehicle and load so drawn.
4.
Every vehicle without motive power designed to be drawn by another
vehicle and attached to the towing vehicle by means of a reach, or
pole, or by being boomed or otherwise secured to the towing vehicle,
and ordinarily used for transporting long or irregularly shaped loads
such as poles, pipes, or structural members capable, generally, of
sustaining themselves as beams between the supporting connections.
b.
Truck Routes. Pursuant to R.S. 40:67-16.1, the streets or parts of
streets as described in Schedule XIV, attached to and made a part
of this chapter are hereby designated as Routes for Trucks over Four
Tons. All trucks having a total combined gross weight of vehicle plus
load in excess of four tons shall be excluded from all streets except
from those streets which form a part of the system of truck routes.
c.
Truck routes
shall be conspicuously marked by signs which shall designate the weight
of the trucks required to use such truck route(s).

d.
The penalty
for violation of this provision shall be a fine of $250.

The mayor of the City of Wildwood shall be authorized to provide
by regulation for the closing of any street within the City of Wildwood,
or portion thereof, to motor vehicle traffic on any day or days or
during specified hours on any day or days whenever he finds that such
closing is necessary for the preservation of public safety, health
or welfare.
The mayor of the City of Wildwood shall be authorized to promulgate
regulations under this section which shall, as a part of the regulations
so promulgated by the mayor of the City of Wildwood, provide for the
posting of proper warning signs of the closing of any such street
within the City of Wildwood, or portion thereof, during the time the
same is closed, pursuant to this section and pursuant to the regulations
promulgated by the mayor of the City of Wildwood hereunder.
The penalty provided for by section 6-10, Penalty, of the Revised General Ordinances of the City of Wildwood, shall be the penalty which is applicable to any violation of this section or to any violation of any regulation promulgated by the mayor of the City of Wildwood hereunder.
No person shall park a vehicle upon any of the streets or parts
of streets described in Schedule XV attached to and made a part of
this chapter during the periods described in said Schedule XV.
In accordance with the provisions of N.J.S. 39:4-98, the locations
described in Schedule XVI annexed hereto, are designated as areas
which shall have a reduced speed limit as indicated therein.

No person shall engage in exhibition driving within the City
of Wildwood.
"Exhibition driving" shall mean:
a.
The operation of a motor vehicle in a manner that results in:
1.
The excessive, abrupt acceleration or deceleration of the motor vehicle;
2.
The skidding, squealing, burning, or smoking of the tires of the
motor vehicle;
3.
The swerving or swaying of the motor vehicle from side to side while
skidding;
4.
The engine of the motor vehicle producing an unreasonably loud, raucous,
or disturbing noise;
5.
The grinding of the gears of the motor vehicle or the backfiring
of the engine of the motor vehicle; or
6.
Any of the wheels of the motor vehicle losing contact with the ground;
7.
Participating in a race or speed contest; or
b.
The transportation of a passenger on or in an area of a motor vehicle
that is not designed or intended for passenger transport such as the
hood or roof.
