The definitions set forth in N.J.S.A. 4:19-15.1 et seq., are
hereby adopted and incorporated by reference into this chapter, as
if set forth fully herein.

Pursuant to N.J.S.A. 4:19-1.9, any person who shall reside in
the Township and who shall own, keep or harbor a dog of licensing
age shall, in the month of January, apply for and procure from the
Municipal Clerk or other official designated by the Township Committee
a license and official metal registration tag for each dog so owned,
kept or harbored, and shall place upon each dog a collar or harness
with the registration tag securely fastened thereto.

The Municipal Clerk or other official designated by the Township
Committee to license dogs shall not grant any such license and official
metal registration tag for any dog unless the owner provides evidence
that the dog to be licensed and registered has been inoculated with
a rabies vaccine as specified in N.J.S.A. 4:19-15.2 and other state
and federal laws and regulations concerning rabies vaccination.

No dog shall be permitted off the premises of the owner or the
person keeping or harboring the dog, except on a leash, or on private
property with the permission of the owner of such private property.

No person shall keep, harbor or maintain any dog which habitually
barks or cries.

Any person appointed for the purpose of animal control by the Township
Committee shall take into custody and impound or cause to be taken
into custody and impounded, and thereafter destroyed or disposed of
as provided in N.J.S.A. 4:19-15.16 and other applicable laws and regulations
of the State of New Jersey.

If the owner or person keeping or harboring the dog shall claim the
dog at the time of its detention, he/she shall pay to the Township,
in addition to the maximum maintenance fees set forth in the Statute,
a pick-up fee of $15 to cover the cost of the apprehension and transportation
of each dog.

This chapter is enacted pursuant to "An Act for the Uniform
Control and Licensing of Dogs and Kennels to Aid In Preventing the
Spread of Rabies, etc." N.J.S.A. 4:19-15.1 through 4:19-15.29, as
amended and revised, and State rules and regulations promulgated by
the State Department of Health pursuant thereto, and other applicable
State laws, rules and regulations.

Except as otherwise provided in state statutes, any person who
violates or who fails or refuses to comply with this chapter or the
rules and regulations promulgated by the State Department of Health
shall be liable to a penalty of not less than $5 nor more than $50
for each offense, to be recovered by and in the name of the Board
of Health of the Township of Union or by and in the name of the Township,
as the case may be, except that for the first offense in cases of
violations, the penalty shall be not less than $1 nor more than $50,
to be recovered in the same manner.

Any person appointed for the purpose by the Township Committee
shall biannually cause a canvass to be made of all dogs owned, kept
or harbored within the limits of the Township and shall report, on
or before May 1 biannually, to the Municipal Clerk or other person
designated to license dogs in the Township, to the local Board of
Health, and to the State Department of Health the results of the canvass
in accordance with N.J.S.A. 4:19-15.15.

a.
Any
person who keeps or operates or proposes to establish a kennel, a
pet shop, a shelter or a pound in the Township shall apply to the
Municipal Clerk or other official designated to license dogs for a
license entitling him/her to keep or operate such establishment, in
accordance with N.J.S.A. 4:19-15.8. License fees shall be as set forth
in N.J.S.A. 4:19-15.9.

In
accordance with N.J.S.A. 4:19-15.1, the following definitions shall
apply:

Any establishment wherein or whereon the business of boarding
or selling dogs or breeding dogs for sale is carried on, except a
pet shop.
Any place of business which is not part of a kennel, wherein
animals, including, but not limited to, dogs, cats, birds, fish, reptiles,
rabbits, hamsters or gerbils, are kept or displayed chiefly for the
purpose of sale to individuals for personal appreciation and companionship
rather than for business or research purposes.
An establishment for the confinement of dogs or other animals
seized either under the provisions of this act or otherwise.
Any establishment where dogs or other animals are received,
housed and distributed.
c.
Operation
of the above facilities shall be in conformity with Subchapter 1,
"Sanitary Conduct and Operation of Kennels, Pet Shops, Shelters and
Pounds," N.J.A.C. 8:23-1.1 to 13, and with other applicable state
laws and regulations.
