There is hereby established in the City of Summit, pursuant
to N.J.S.A. 2B:12-1-3, as amended and supplemented, a Municipal Court
which shall be entitled the "Municipal Court of the City of Summit."

The Municipal Court shall have a seal which shall bear the impress
of the name of the Court.

The Judge of the Municipal Court shall be appointed by the Mayor
with the advice and consent of the Common Council. The Judge of the
Municipal Court shall serve for a term of three (3) years from the
date of his appointment and until his successor is appointed and qualified.
Any appointment to fill a vacancy caused other than by expiration
of term shall be made for the unexpired term only. With the written
consent of the Superior Court of New Jersey Assignment Judge of Union
County, a Temporary Judge of the Municipal Court may be appointed
by the Mayor with the advice and consent of the Common Council to
meet a special need of limited duration for a term not to exceed one
(1) year.

The Municipal Court shall have, possess and exercise all the
functions, powers, duties and jurisdiction, both territorial and subject
matter, in such matters as conferred upon the Court pursuant to N.J.S.A.
2B:12-1, et seq., as amended and supplemented, and by any other Acts
of the State Legislature.

The salary of the Judge of the Municipal Court shall be an annual
salary as established by the Salary Ordinance.

The Council shall provide for a Municipal Court Administrator,
Deputy Court Administrator, and any other necessary clerical and other
assistants as may be required for the Municipal Court. Compensation
for the Municipal Court Administrator, Deputy Court Administrator
and other Court personnel shall be established by the Salary Ordinance.

The Municipal Prosecutor shall appear at all Court sessions
and prosecute all complaints presented by the Police Department of
the City of Summit, and any other complaints as required by law.

The salary of the Prosecutor shall be his annual salary as established
by the Salary Ordinance.

a. Any person applying for representation by the City Public Defender or Court Approved Counsel shall pay to the City Municipal Court an application fee of not more than the fee stated in Chapter
A Schedule of Fees Appendix, see Municipal Public Defender. The Municipal Court may waive the application fee, in whole or in part, if the Court determined, in its discretion, that the application fee represents an unreasonable burden on the person seeking representation.
b. The application fees so paid shall be deposited by the Municipal
Court and turned over to the City Treasurer on a monthly basis.
