As used in this chapter:
a.
AIRPORT – shall mean the Firebaugh municipal airport.
b.
AIRPORT MANAGER – shall mean the airport manager appointed
by the city council of Firebaugh or a duly authorized representative
thereof.
c.
AIRCRAFT" – shall mean any contrivance, now known or hereafter
invented, used, or designed for the navigation or for flight in the
air.

The airport shall be open for public use subject to the restrictions
contained herein, and to such restrictions due to inclement weather,
the conditions of the landing area, and like causes as shall be determined
by the airport manager to be in the interest of safety.

All aeronautical activities at the airport shall be conducted
in conformity with the current pertinent provisions of the Federal
Aviation Agency regulations, copies of which are attached hereto.

Those areas of the airport open to public traffic are as set
forth on that certain map, copies of which are located in the city
clerk's office and in airport manager's office and by this
reference incorporated herein as if set forth in full. The map also
contains traffic regulations applicable to said areas open to public
traffic, a violation of which is subject to the penalties set forth
elsewhere in this code.

When the airport manager determines that public safety or convenience
so requires, he may designate any area on the airport as a restricted
area and post appropriate signs. No person shall enter any restricted
area without the express permission of the airport manager.

The operation of any motor vehicle, motorcycle, or bicycle inside
the fenced area of the airport is prohibited unless authorized by
the airport manager and subject to the following conditions:
a.
When authorized, vehicles will enter and exit through either gate.
b.
All vehicles coming through either gate shall yield right-of-way
to any aircraft.
c.
No vehicle shall be parked in any taxi-way, runway or tie-down area.
d.
No vehicle shall be parked in place of any airplane in any tie-down
area.
e.
Parking next to an airplane to load, unload, or perform minor maintenance
will be allowed if the driver of the vehicle is present.
f.
No vehicle will be driven on a runway or taxi-way unless to authorized
by the airport manager.
g.
Automobiles may be parked in place of an airplane in hangers, or
airplane shelters when the airplane is being used.

No pedestrian shall be upon any landing area of the airport
without first having obtained a signed permit from the airport manager,
except persons engaged as mechanics or who, by necessity, are required
to be there.

The aircraft traffic patterns applicable to the airport shall
be as follows:
Left hand pattern when landing on runway 300.
Right hand pattern when landing on runway 120.
On takeoff no right turn until past Davis Drier on the north
or past high school football stadium on the south.
All takeoffs and landing of aircraft shall conform to the aircraft
traffic patterns.

Takeoffs from or landings on the airport shall be subject to
the following provisions:
a.
All cockpit and engine checks shall be made prior to taxiing into
position for takeoff.
b.
Before taxiing an aircraft into position on the runway for takeoff,
the runway base legs and final approach legs shall be clear.
c.
All takeoffs and landings of aircraft shall be made on the runway
only.
d.
Aircraft landings at the airport shall make the landing runway available
to others by leaving the line of traffic as promptly as possible.
e.
There shall be no U-turns on the runway.
f.
Low flying within the confines of the traffic patterns, except in
emergencies or when necessary to climb to the designated pattern altitude
or descended to a landing, is prohibited.

Pilots shall taxi their aircraft slowly and display extreme
caution at all times subject to the following provisions:
a.
In any hanger, shelter or tie-down area airplanes shall be taxied
at speeds not exceeding five mph using minimum engine rpm without
the application of brakes to control speed.
b.
Taxiing in and out of hangers is prohibited.
c.
No airplane shall be operated on the ground so as to create a dust
problem or injury to other persons or property.

Parking of aircraft at the airport shall be accomplished in
accordance with the following provisions:
a.
Privately owned aircraft shall be parked only in a tie-down area
or in a hanger or shelter.
b.
Transient aircraft shall be parked in the tie-down area in places
designed by the airport manager.
c.
Flying school and rental aircraft shall be parked only in the flight
lines assigned to them by the airport manager.
d.
At the direction of the airport manager, the owner or pilot of any
aircraft on the airport shall move the aircraft from the place where
it is parked or stored to any place designated on the airport. If
the operator refuses to comply with directions, the airport manager
may tow the aircraft to such place at the operators expense and without
liability for damage that may result from such moving.
e.
It shall be the duty of the operator of any airplane using the airport
to tie down his airplane at all times.
f.
No airplane shall be stopped or parked in any area of the airport
that is so posted or marked by the airport manager.

a.
No persons shall attempt to crank or start an engine of any airplane
unless a licensed pilot or mechanic is at the controls of said airplane
or aircraft is tied down.
b.
No aircraft shall be started or run unless the aircraft is in such
a position that the propeller blast will clear all buildings or groups
of people.

Operators of agricultural aircraft shall observe the following
regulations at all times.
a.
Airplanes shall be loaded and unloaded only in areas designed by
the airport manager.
b.
No pesticides or emptied containers thereof shall be dumped or left
unattended at any place on the airport where they are likely to present
a hazard to persons, animals, crops, or properties. All emptied containers,
sacks, barrels, etc. are to be removed, disposed of or stored in a
proper and safe manner immediately after use.
c.
Night operations by agricultural aircraft shall be limited to taking
off and landing when the operation is completed. All operations shall
be flown from satellite strips and there shall be no continuous flying
to and from the airport at night.
d.
Agricultural flying operators who wish to use the airport strip continuously
during the day time when satellite fields are unusable, shall be required
to secure permission to do so from the police department. Such operators
shall submit to the police department the number of planes that will
so use the strip, and a receipt shall be signed. "Daytime", for purposes
of this section, shall mean the hours between "sunup and sundown".

a.
Negligent Operation. No aircraft shall be operated on the surface
of a landing area, ramp, apron area, or aircraft parking or storage
area, at any speed or in a manner which endangers persons or property.
b.
Noisy Operation. No aircraft shall be operated on the ground or in
the air in such a manner as to cause unnecessary or objectionable
noise.
c.
Federal Regulations. No aeronautical activity shall be conducted
at the airport except in conformity with the current Federal Air Regulations.
d.
Removal of Damaged Aircraft. Every aircraft owner, his pilot and/or
agents, severally, shall be responsible for the prompt removal after
approval of and by the direction of the Airport Manager and a representative
of the Federal Aviation Agency, of wrecked or damaged aircraft.
e.
Unattended Aircraft. No aircraft shall be left unattended unless
properly secured or within a hanger.

Permission shall be obtained from the airport manager before
dangerous materials such as explosives, etc. are flown to or from
the airport.

a.
Firearms. No person except peace officers, duly authorized, or members
of the Armed Forces of the United States on official duty, shall carry
any firearms, including B-B guns, explosives, bows and arrows, or
flammable materials on the airport without the written permission
of the airport manager. Such permission may be granted by the airport
manager for an indefinite period when circumstances warrant. All persons
other than the accepted classes shall surrender all such objects in
their possession to the airport manager.
b.
Animals. Animals shall not be permitted on the airport unless leashed,
or restrained in such a manner as to be under control at all times.
c.
Intoxicated Persons. No aircraft shall be operated on the surface
of the landing area, ramp, apron area, or aircraft taxi-way or aircraft
parking or storage area while the pilot or any persons aboard controlling
and part of the operation thereof is under the influence of intoxicating
liquor or any narcotic or habit forming drug.
No person under the influence of intoxicating liquor shall approach
closer than 50 feet to any aircraft parking or storage area, landing
or taxiing area.
d.
Business or Commercial Activities. No person shall engage in any
business or commercial activity of any nature on the airport property
except in conformance with a valid lease granted by the city and in
conformance with appropriate licenses and permits as required by law
and under such terms and conditions as may be prescribed therein by
the city.
e.
Experimental Demonstrations. No experimental ground or air demonstrations
shall be conducted on the airport without the express approval of
the airport manager.
f.
Rubbish. Rubbish or trash shall not be thrown, deposited or allowed
to be scattered on the airport. Rubbish and trash shall be deposited
in waste receptacles provided for that purpose.
g.
Signs and Advertisings. No person shall post, distribute or display
signs, advertisements, circulars, printed or written matter of any
kind at the airport without permission of the airport manager.

a.
Smoking or lighting of open flames shall be prohibited within 50
feet of fueling facilities and at such other places as the airport
manager may designate and post signs.
b.
No person shall start an open fire on the airport without permission
of the airport manager.
c.
Oily waste rags and other similar inflammable materials shall be
stored in closable metal containers.
d.
Aircraft engines shall not be run in any hanger.

No person may enter the airport at night between the hours of
sunset and sunrise without properly identifying himself and stating
his business when so requested by the airport manager or any police
officer.

The owners of all aircraft based on the airport, all tenants
and all operators storing aircraft on the premises shall be required
to register the aircraft with the airport manager and shall change
the registration at any time a change in ownership or operator shall
occur.

a.
Set by City Council. Aircraft parking, hanger, shelter, tie-down
and landing fees are hereby established at such rates as are set by
appropriate resolution of the city council.
b.
Refusal of Clearance. The airport manager may refuse clearance to
any aircraft until all charges for storage and other services rendered
by the city have been paid.

The City of Firebaugh, its agents or employees operating the
airport, assumes no responsibility for damage to properties stored
thereon, or property thereon of persons using the airport facilities,
by reason of fire, theft, vandalism, windstorm, flood, earthquake,
and/or collision, nor does it assume any liability by reason of injury
to persons while on the airport or while using the facilities of same.

No person shall drive any vehicle or animal, nor stop, park
or leave standing any vehicle or animal, whether attended or unattended,
upon the runways or taxiways of the Firebaugh municipal airport.

Employees of the city who are engaged in maintaining, repairing,
or additional construction upon the airport, on city duty and duly
authorized by the city manager or the airport manager, shall be exempt
from this section. Peace officers of the State of California who are
engaged in the enforcement of State Law or this or any ordinance of
the city shall likewise be exempted from the provisions of this chapter.
