As used in this chapter, the following terms shall have the
meanings indicated:
Any individual person, group of persons, partnership, corporation,
firm, association or any other entity in ownership or possession of
a vehicle as defined herein.
Any mode of transportation, trailer or vessel, including,
but not limited to, motorcycles, motorbikes, automobiles of any type,
sport utility vehicles (SUVs), recreational vehicles of any size whether
self-propelled or trailered, trucks of any size, tractors, farm equipment,
construction equipment, campers including pop-up campers, trailers
of any type including house, construction, utility and boat trailers,
boats, jet skis and two- or three-wheeled vehicles of any type.
No person shall park, leave, or store any vehicle or trailer
of any kind on any public lands or premises for more than 48 hours,
except in the case of active construction on public property or in
the event of an emergency.
A.
No person shall park, leave, store or maintain any inoperable or
unregistered vehicle or trailer of any kind for a period of more than
30 days within any one calendar year upon any private lands or premises.
B.
No more than two registered and operable boats per property shall
be allowed on a regular basis unless City Council shall approve otherwise.
C.
Except as may have been previously approved by the City prior to
the adoption of this chapter, registered tractor trailer bodies, shipping
containers, storage containers and pods may be utilized for storage
on private properties for a period of no more than 60 days within
a calendar year without a permit, and any extension beyond such period
shall be subject to the discretion of the City Council after an application
and hearing before the governing body.
D.
No vehicle of any kind in a state of major disassembly, disrepair,
removed from its chassis or wheels, or in the process of being stripped
or dismantled, shall be left outside (i.e., not within a fully enclosed
structure) on any private lands or premises for any period of time.
E.
Outdoor painting of a vehicle is prohibited unless conducted inside
a previously approved spray booth temporarily placed upon a property
for a single use.
F.
Any applications to City Council under the provisions of this chapter
for approval of vehicles on private lands and premises as provided
herein shall be accompanied by a $25 fee. Any approvals granted by
City Council shall be submitted to the Zoning and Code Enforcement
Officer for monitoring and enforcement.
Farm tractors and farming equipment in good operating condition
shall be permitted at all times on any property where there is an
active farming operation or where such equipment is a reasonable use
associated with the maintenance and landscaping of a property. Construction
equipment reasonably necessary for a fully approved construction project
with all lawful required permits in full force and effect shall also
be permitted upon any property while active construction is taking
place.
This chapter shall not apply to vehicles located or stored in
garages or other fully enclosed buildings, nor to commercial operations
where vehicles are permitted under zoning as defined in this Code.
Under special circumstances, City Council shall have the discretion
to allow the storage of vehicles otherwise prohibited herein provided
that they are completely screened from view of adjacent properties
and public roads.
A.
The imposition of a penalty for any violation of this chapter shall
not excuse the violation or permit the violation to continue, and
all such persons shall be required to correct or remedy such violations
within a reasonable time as determined in the sole discretion of the
Municipal Court Judge. If such penalties are not corrected or remedied
within such reasonable time, then every 10 days or any part thereof
that such prohibited conditions shall continue will constitute an
additional offense.
