As used in this chapter, the following definitions shall have
the following meanings indicated:
PERSON
Includes any person, persons, corporation, partnership or
firm or other owner or tenant of the subject property.
Where it shall be necessary and expedient for the preservation
of the public health, safety, general welfare or to eliminate a fire
hazard, an owner or tenant of real property, sidewalks and adjacent
grass plots within the Township of Plumsted shall remove from such
lands, brush, weeds, dead and dying trees, stumps, roots, obnoxious
growth, filth, garbage, trash and debris within ten (10) days after
notice to remove the same from the designated official of the Township
of Plumsted.
If an owner or tenant, who has received notice in accordance with the provisions of §
5-2 hereof, fails to remove from said lands the brush, weeds, dead and dying trees, stumps, roots, obnoxious growth, filth, garbage, trash and debris for which said person was cited, within ten (10) days of the notice to remove the same, then the Township shall have the right to provide for the removal of the same by or under the direction of an officer of the municipality.
In all cases where any brush, weeds, dead and dying trees, stumps,
roots, obnoxious growth, filth, garbage, trash and debris are removed
from any lands by the Township under the provisions of this chapter,
the municipal officers of the municipality in charge of the removal
of said material shall certify the cost thereof to the governing body.
Upon receipt of the certificate of cost, the governing body shall
examine the same and if found correct shall cause the cost as shown
thereon to be charged against the property from which said material
was removed. The amount so charged shall become a lien upon such lands
and shall be added to and become and form part of the taxes next to
be assessed and levied upon said lands and shall bear the same interest
rate as taxes and shall be collected and enforced by the officers
of the municipality in the same manner as taxes.
Bushes, shrubs, fences and other obstructions which are within
ten (10) feet of a roadway and twenty-five (25) feet of an intersection
cannot exceed two point five (2.5) feet in height. This requirement
is intended to prevent sight obstruction which could cause automobile
accidents.

A. Definitions.
As used in this section, the following definitions shall have the
following meanings indicated:
INVASIVE PLANTS
These plants may damage trees, vegetation, or structures.
Examples include, but are not limited to, invasive bamboo.
B. Control of
growth. All persons must control the growth of invasive plants. Failure
to control the spread of such vegetation beyond the boundaries of
a resident's property is a violation of this section.
C. Inspections.
All places and premises in the Township of Plumsted shall be subject
to inspection by the enforcing officer. Such inspections shall be
performed by such person, persons or agency duly authorized and appointed
by the Township of Plumsted, which is including, but not limited to,
the Ocean County Master Gardeners, and Rutgers Cooperative Extension
of Ocean County. Such inspection shall be made if that official has
reason to believe that any section of this section is being violated.
D. Violations
and penalties.
(1) Whenever
an invasive plant as defined by this section is found to have spread
beyond the boundaries of a property, a violation shall be given to
the owner of the property from which the invasive species has spread,
in writing, to abate the same within 30 days. The cost of all remedies
shall be borne by the property owner.
(2) Any person
violating the provisions of this section shall, upon conviction, be
punishable by a fine of not less than $100 nor more than $1,000, or
community service not to exceed 90 days, as determined by the Municipal
Court. The continuation of such violation for each successive day
shall constitute a separate offense, and the person or persons allowing
or permitting the continuation of such violation may be punished as
provided above for each separate offense.
(3) Notwithstanding
any other penalty or fine which may be imposed under this section,
if an owner fails to comply with the abatement of invasive bamboo,
the Township may thereafter remove or otherwise abate the planting
and thereafter recover the costs of such removal or abatement from
the property owner by placing a lien against the property.
E. Plantings
of invasive bamboo are prohibited. All new in-ground plantings of
invasive bamboo are strictly prohibited.

safety and welfare, and to prescribe penalties for the failure to
comply.
B. Definitions.
For the purpose of this section, the following terms, phrases, words,
and their derivations shall have the meanings stated herein unless
their use in the text of this section clearly demonstrates a different
meaning. When not inconsistent with the context, words used in the
present tense include the future; words used in the plural number
include the singular number; and words used in the singular number
include the plural number. The word "shall" is always mandatory and
not merely directory.
CONTAINERIZED
The placement of yard waste in a trash can, bucket, bag or
other vessel, such as to prevent the yard waste from spilling or blowing
out into the street and coming into contact with stormwater.
PERSON
Any individual, corporation, company, partnership, firm,
association, or political subdivision of this state subject to municipal
jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive,
or other way, which is an existing state, county, or municipal roadway,
and includes the land between the street lines, whether improved or
unimproved, and may comprise pavement, shoulders, gutters, curbs,
sidewalks, parking areas, and other areas within the street lines.
C. Prohibited
conduct. The owner or occupant of any property, or any employee or
contractor of such owner or occupant engaged to provide lawn care
or landscaping services, shall not sweep, rake, blow or otherwise
place yard waste, unless the yard waste is containerized, in the street.
If yard waste that is not containerized is placed in the street, the
party responsible if it can be determined for placement of yard waste
must remove the yard waste from the street or said party shall be
deemed in violation of this section.
D. Enforcement.
This section shall be enforced by the Police Department or the Construction
Code Official or the Code Enforcement Officer of the Township of Plumsted.
E. Violations
and penalties. Any person(s) who is found to be in violation of the
provisions of this section shall be subject to a fine of not to exceed
$100.

waste collection. Sweeping, raking, blowing or otherwise placing yard
waste that is not containerized at the curb or along the street is
only allowed during the seven days prior to a scheduled and announced
collection, unless on owner's property, and shall not be placed
closer than 10 feet from any storm drain inlet. Placement of such
yard waste at the curb or along the street at any other time or in
any other manner is a violation of this section. If such placement
of yard waste occurs, the party responsible for placement of the yard
waste must remove the yard waste from the street or said party shall
be deemed in violation of this section.
D. Enforcement.
The provisions of this section shall be enforced by the Police Department
or the Construction Code Official or the Code Enforcement Officer
of the Township of Plumsted.
