Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the Borough.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY-NO PARKING (by Order of Police Department) signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY-NO PARKING signs when weather conditions, accidents, fires, road reconstruction, public celebration, or other circumstances dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
Whenever snow and/or ice has fallen and the accumulation of snow and/or ice is such that it covers the streets or highways, an emergency shall exist and no vehicle shall be parked on any street or highway within the Borough. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b.

No person shall plow, shovel, push, throw or cause to be deposited accumulations of snow or ice which may be deemed to cause or create a traffic safety hazard, or otherwise interfere with the effective removal of snow and ice from the Borough streets by the Department of Public Works, or other entity so employed or empowered by the Borough.

No person shall make a right turn when facing a steady red signal (STOP) indication whenever an official sign is presented prohibiting such turn on the red signal as described below:

a. 
Godwin Avenue between South Rea Avenue and Erie Avenue:

The right lane of Godwin Avenue westbound, west of the intersection of South Rea Avenue shall be for right turns into the parking lot at 80 Godwin Avenue only.
2. 
The center lane of Godwin Avenue westbound, west of South Rea Avenue shall be for westbound through traffic only.
3. 
The left lane of Godwin Avenue westbound, west of South Rea Avenue shall be for left turns into the parking lot at 85 Godwin Avenue only.
b. 
Godwin Avenue and Goffle Road:
1. 
The right lane of the Godwin Avenue eastbound approaching Goffle Road shall be for right turns only.
2. 
The right lane of Goffle Road northbound approaching Godwin Avenue shall be for right turns only.
3. 
The left lane of Godwin Avenue westbound approaching Goffle Road shall be for left turns only.
c. 
Godwin Avenue and Prospect Street:

The right lane on Godwin Avenue westbound, approaching Prospect Street shall be reserved for right turns only.

No person shall park in the street location designated below, unless they have been issued special vehicle identification cards by the New Jersey Motor Vehicle Commission, when using a motor vehicle for which a special vehicle identification card has been issued by the Commission.

a. 
Establishment of Crosswalk. A crosswalk shall be established between Block 26.00, Lot 4.01 and Block 33.00, Lot 7.01 at Greenwood Avenue and Witte Drive which shall be six (6') feet in width dimensioned to the center line of the eight (8") inch thermo plastic line. On the north side of Greenwood Avenue, the crosswalk shall be located two hundred fifty-three and three one hundredths (253.03') feet west of the intersecting northern right-of-way (ROW) of Greenwood Avenue and Witte Drive. The south end of the crosswalk shall be located two hundred thirty-two and fifty-five one hundredths (232.55') feet west of the southern ROW of Greenwood Avenue and Witte Drive. The striping shall cross at an angle from south to north of sixty-six and fifty-six hundredths (66.56) degrees.
b. 
Striping of Crosswalk. The crosswalk described in Subsection a of this section shall be striped with two (2') foot wide thermo plastic striping at a ninety (90) degree angle of the crossing spaced at four (4') foot intervals. The delineated striping for the crossing at Greenwood Avenue shall be eight (8") inches in width.
c. 
Crosswalk Signage. Vehicular traffic signage indicting the approaching crosswalk shall be located at either side of the crosswalk. Such signage shall be placed in accordance with the requirements of the Manual On Uniform Traffic Control Devices.
d. 
Crosswalk Curbing. Concrete curb cuts shall be located at the north and south entries into the crosswalk to permit handicapped (ADA) accessibility between the two (2) properties described in Subsection a of this section.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than one hundred ($100.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.

All former traffic ordinances of the Borough of Midland Park covered in this Traffic Chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

If any part or parts of this chapter are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

This chapter shall take effect immediately upon final passage and publication as provided by law.
