The office of the Township Clerk shall be an appointed position and, unless otherwise provided by law, the term of office shall be three (3) years and shall commence on the date of appointment. The salary of the Township Clerk shall be as established in the Salary Ordinance.

There is hereby established the Office of Township Clerk. The Township Clerk shall have those duties and responsibilities as prescribed in N.J.S.A. 40:145-4, and such other duties and responsibilities as may be assigned to the Township Clerk by the Township Committee.

The Township Clerk shall comply with and be subject to the provisions of the laws of the State of New Jersey relating to tenure in office, removal from office and certification to meet the requirements of examination and certification in accordance with the provisions of N.J.S.A. 40A:9-133 through 40A:9-134, inclusive. The Township Clerk shall obtain the requisite Certificate as prescribed in N.J.S.A. 40A:9-133.3. No person shall be appointed as Township Clerk in the Township of Maurice River unless such person holds a certification of Registered Municipal Clerk, or complies with the provisions relating to examination and certification of Municipal Clerks in accordance with N.J.S.A. 40A:9-133.2.

The Township Clerk shall:
a. 
Perform all of the functions required of municipal clerks by the General Election Law (Title 19 of the Revised Statutes) and any other State law or Township ordinance, and receive the fees prescribed therefor for the use of the Township.
1. 
Serve as the Chief Administrative Officer in all elections held in the Township, subject to the requirements of Title 19 of the Revised Statutes.
2. 
Serve as Chief Registrar of Voters in the Township, subject to the requirements of Title 19 of the Revised Statutes.
b. 
Until such time as a separate Alcoholic Beverage Control Board may be established pursuant to law, issue such licenses as may be authorized by the Township Committee pursuant to the State Alcoholic Beverage Control Law (N.J.S.A. 33:1-1 et seq.) and ordinances of the Township.
c. 
Keep all records, resolutions, ordinances and minutes of the meetings of the Township Committee.
d. 
Issue all licenses required by law or ordinance, faithfully make all reports required by law or ordinance to the Township Committee and account monthly for all fees received by the Office of the Township Clerk.
e. 
See to it that all ordinances and notices of the Township of Maurice River are properly advertised.
f. 
Take care of all correspondence of the Township and of the Township Committee.
g. 
Administer oaths.
h. 
Have such other, different and additional functions, powers and duties as may be prescribed by law, ordinance or regulation.

a. 
Pursuant to N.J.S.A. 40A:9-135, the Township Committee hereby creates the office of Deputy Municipal Clerk for the Township.
b. 
The Deputy Municipal Clerk shall serve under the direction of the Municipal Clerk, and the Deputy Municipal Clerk shall, in conjunction with the Municipal Clerk, perform any duties relative to the position as the Municipal Clerk may so direct. The Deputy Municipal Clerk shall also act as Municipal Clerk and have the powers and duties of the Municipal Clerk during the absence or disability of the Municipal Clerk.
c. 
The term of office for the Deputy Municipal Clerk shall be for one (1) year, and shall commence on January 1, at 12:00 noon.

a. 
There shall be appointed by the Township Committee a Chief Financial Officer, also known as Treasurer, who shall meet all qualifications as required by N.J.S.A. 40A:9-140.10, and shall hold office for a term of four (4) years. In addition to the duties prescribed by Statute, the Chief Financial Officer shall perform such other duties as may be prescribed by ordinance or resolution of the Township Committee.
b. 
Salary. The annual salary of the Chief Financial Officer shall be established in the Salary Ordinance.

Pursuant to N.J.S.A. 40A:9-141 et seq., the Mayor and Township Committee shall appoint the Tax Collector who shall be charged with the duty of collecting taxes upon real property in the Township.

The Tax Collector shall hold office for a term of four (4) years from January 1 next following his appointment. Vacancies other than those due to expiration of term shall be filled by appointment for the unexpired term.

No person shall be appointed or reappointed as Tax Collector unless he or she shall hold a Tax Collector Certificate issued by the Director of the Division of Local Government Services.

A Tax Collector Certificate shall be obtained upon qualification and successful completion of the examination given by the Director of the Division of Local Government Services. Qualifications for certification shall be in accordance with N.J.S.A. 40A:9-140.4 and N.J.S.A. 40A:9-145.4. Revocation or suspension of any Certificates shall be in accordance with N.J.S.A. 40A:9-140.8, N.J.S.A. 40A:9-140.9 and N.J.S.A. 40A:9-145.5.

There is hereby established the office of Tax Assessor of the Township. The Tax Assessor shall be nominated by the Mayor subject to the confirmation of the Township Committee pursuant to N.J.S.A. 40A:9-146.

The Tax Assessor shall be qualified and hold a Tax Assessor's Certificate as set forth in N.J.S.A. 54:1-35.25 as same may be amended.

The Tax Assessor shall hold office for a term of four (4) years from July 1 next following his appointment to the office.

The compensation of the Tax Assessor shall be determined in the Salary Ordinance.

The Tax Assessor shall perform the duties required of the holder of such office pursuant to Title 54 of the New Jersey Statutes and such regulations as may be promulgated by the New Jersey Division of Taxation and the Monmouth County Board of Taxation.
a. 
Have, perform and discharge all the functions, powers and duties prescribed by law for a Municipal Assessor.
b. 
Maintain adequate assessment records of each separate parcel of real property assessed or exempted.
c. 
Maintain a current tax map of the Township as a public record and cause to be recorded thereon all changes in ownership or character of the real property assessed, employing for that purpose the facilities of other Departments as provided by the Code.
d. 
Report to the Township Committee as to equalization proceedings and other matters involving the County Tax Board and make recommendations as to action to be in that regard.

In accordance with N.J.S.A. 40A-139 there is hereby created by the Township of Maurice River the position of Municipal Attorney.

The Municipal Attorney shall be a duly licensed Attorney-at-Law of the State of New Jersey.

The Municipal Attorney shall be appointed by the Township Committee and shall hold such position for a term of one (1) year from January 1 of the year in which the appointment is made.

a. 
The Attorney shall serve as legal advisor to the Township Committee and to the Township Officers and employees on matters pertaining to their duties, to represent the Township in litigations except where the Township Committee directs otherwise, to draft all contracts, ordinances or other documents needed by the Township and to render such other legal services as may be required by the Township Committee.
b. 
It shall be the duty of the Attorney to see to the full enforcement of all judgments or decrees rendered or entered in favor of the Township and of all similar interlocutory orders.
c. 
It shall be the duty of the Attorney to see to the completion of all special assessment proceedings and condemnation proceedings.

The Municipal Attorney shall be paid an annual retainer as provided by agreement or as provided for in the Salary Ordinance of the Township and such other reasonable compensation for additional services performed only if authorized by the Township Committee.
This retainer shall be full compensation for the following; attending all regular Township meetings and any and all advisory services in connection therewith. For any services not covered by the retainer, the Attorney shall receive such compensation as may be authorized by the Township Committee.

There is hereby created by the Township the position of Municipal Court Prosecutor.

The Municipal Court Prosecutor shall be a duly licensed Attorney-at-Law of the State of New Jersey.

The Municipal Court Prosecutor shall be appointed by the Mayor and confirmed by the Township Committee for the term of one (1) year effective January 1 of each year and until December 31 of the same year and until the appointment and qualification of his successor.

The Municipal Court Prosecutor shall be paid an annual salary as provided by agreement or as provided in the Salary Ordinance of the Township and such other reasonable compensation for additional services performed only if authorization of the Township Committee is first secured.

The Municipal Court Prosecutor shall, under the supervision of the Township Attorney, appear in the Municipal Court in the Township of Maurice River on behalf of the State of New Jersey or the Township of Maurice River in any case therein pending on request of the Judge of the Municipal Court, and upon directive of the Township Committee.
The Prosecutor shall exercise such powers and duties as are assigned to such office by the Statutes of New Jersey and such other authority as may be assigned by the Township Committee.

The Office of Public Defender for the Maurice River Township Municipal Court is hereby established. The Township Committee shall appoint a New Jersey licensed attorney to the said position annually at the Township Reorganization Meeting in January of each year for a one (1) year term. The compensation for the Public Defender shall be established by resolution of the Township Committee.

The Public Defender shall, in the manner prescribed by law, except in the case of conflict of interest, provide for the legal representation of any indigent defendant seeking legal representation charged with a disorderly person's offense or with the violation of any law, ordinance or regulation of a penal nature where there is a likelihood that the person so charged, if convicted, shall be subject to imprisonment, or in the opinion of the Municipal Court Judge, and any other penalty of consequence of magnitude.

The Municipal Court Judge shall have the right to assign a private New Jersey licensed attorney to represent an indigent defendant in the Municipal Court in those instances where the defendant would otherwise be entitled to the legal services of the Public Defender, but where the Public Defender is unable to provide legal representation because of recognized conflict of interest, or the long term unavailability of the Public Defender because of illness or injury.

The Municipal Court Judge shall assess a fee of two hundred ($200.00) dollars for each application made by each indigent defendant for the legal services of the Public Defender or of assigned private counsel when the Public Defender is not available. The Municipal Court Judge in accordance with guidelines promulgated by the New Jersey Supreme Court may waive the required application fee, in whole or in part, if the said Judge determined upon a clear and convincing showing by the applicant, that the application fee represents an unreasonable burden on the person seeking said representation. The Municipal Court Judge and the Municipal Court Administrator shall set up the necessary procedure for collection of the said application fees and for processing of the said applications for indigent defendants.

Funds collected pursuant to this section shall be deposited in a dedicated fund administered by the Chief Financial Officer of the Township. The funds shall be used exclusively to meet the costs incurred in providing the services of the Municipal Public Defender including, when required, expert and lay investigation and testimony. In the case where a private attorney has been appointed to represent an indigent client because of the unavailability of the Public Defender, then a fee of one hundred ($100.00) dollars shall be paid to that private attorney for representation of the indigent defendant before the Maurice River Township Municipal Court upon presentation and approval of a voucher for said legal services rendered.

The Township Engineer shall be appointed by the Township Committee for a maximum term of three (3) years from the first day of January in the year in which he is appointed. The Engineer shall be a duly licensed engineer and land surveyor of the State of New Jersey and shall receive such compensation as may be provided by the Township Committee.

The Township Engineer shall perform such duties as are prescribed by general law and ordinance and in addition shall:
a. 
Prepare or cause to be prepared plans, designs and specifications for public works and improvements undertaken by the Township.
b. 
Provide and maintain surveys, maps, plans, specifications, estimates and control records with respect to public works and facilities owned or operated by the Township or to be acquired or built.
c. 
Provide technical and engineering advice, estimates and review of plans and assistance to other Township Departments as needed.
d. 
Attend meetings of the Township Committee, Planning Board and Zoning Board as needed.
e. 
All papers, documents, memoranda, reports and other materials relating to the administration of engineering duties of the Township Engineer shall be and remain the property of the Township. Upon the termination of his services with the Township, the Township Engineer shall forthwith surrender to any successor all such property.

Whenever the Township Committee determines that the interest of the Township requires additional engineering services, consulting engineers may be retained for one (1) or more projects or to render assistance to the Township Engineer.
