The Uniform Fire Safety Act, (P.L. 1983, c. 383) was enacted for the purpose of establishing a system for the enforcement of minimum fire safety standards throughout the State of New Jersey; and the New Jersey Department of Community Affairs has promulgated minimum fire safety standards which have been made part of the Uniform Fire Code (N.J.A.C. 5:70.1 et seq.). The Uniform Fire Safety Act authorizes municipalities to provide for local enforcement of these standards and to establish local enforcement agencies for that purpose. It is in the best interest of the Township of Maurice River to have the Uniform Fire Code enforced locally. The local fire service has agreed to the plan, which is set forth herein, for the administration and enforcement of the Uniform Fire Code.

Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983 c. 383), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.) shall be locally enforced in the Township of Maurice River.

The local enforcing agency shall be the Bureau of Fire Prevention (hereafter "Bureau") which is hereby created therein.

a. 
The Bureau shall enforce the Uniform Fire Code in all buildings, structures, and premises within the established boundaries of the Township of Maurice River other than one and two unit owner-occupied dwellings used exclusively for dwelling purposes and buildings, structures, and premises owned or operated by Federal government, interstate agencies or the State.
b. 
The Bureau shall faithfully comply with all the pertinent requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

a. 
The Bureau shall be under the direct supervision and control of the Fire Official who shall report to the designated member of the Township Committee.
b. 
The Bureau shall have at least one paid inspector.

a. 
Appointment and Qualifications of the Fire Official. The Fire Official shall be certified by the State and appointed by the Township Committee.
b. 
Appointment and Qualifications of Inspectors and Other Employees. Inspectors and other employees of the Bureau may be appointed by the Township Committee upon recommendation of the Fire Official. All life hazard use inspectors shall be certified by the state.
c. 
Assistance of Legal Counsel. The Solicitor of the Township shall assist the Bureau in the enforcing of the Uniform Fire Code.
d. 
Term of Office. The Fire Official shall serve for a term of a minimum of one (1) year. Any vacancy shall be filled for the unexpired term.
e. 
Discipline/Removal from Office. The Fire Official, inspectors and other employees of the Bureau shall be subject to discipline up to and including removal by the Township Committee for just cause pursuant to the applicable rules and regulations of the New Jersey Department of Personnel.

The Bureau shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

In addition to the registrations required by the Uniform Fire Code, the nonlife hazard uses set forth in Schedule A[1] attached hereto and incorporated by reference shall register with the Bureau. These uses shall be inspected once per year and pay an annual fee. The fee is not to be used for life hazard uses as defined in the Uniform Fire Code.

a. 
The application fees for the permits shall be as set forth and in accordance with the New Jersey Uniform Fire Code.
b. 
The cost for the issuance of a Certificate of Fire Code Status shall be $35.00.
c. 
In addition to the registration of life-hazard uses, certain activities and uses are required to be regulated only with permits. The permits are currently classified into five (5) types with application fees for each. The local enforcing agency shall review these applications, activities and uses as required by State law. The permit fees shall be as set forth and in accordance with the New Jersey Uniform Fire Code.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by an action of the Bureau shall have the right to appeal to the County Construction Board of Appeals.

Enforcement, violations and penalties shall be managed in conformity with the Uniform Fire Safety Act, the Uniform Fire Code and all other laws of the State of New Jersey.

Nonlife Hazard use buildings on the same premises as registered life hazard uses shall be inspected with the Life Hazard use but may not be assessed a fee at the discretion of the Fire Official.

a. 
Pursuant to the authority given under N.J.S.A. 39:4-197, a fire zone and no parking zone is hereby established at the Maurice River Township Elementary School located in Port Elizabeth. The fire zone and no parking zone is to constitute an area as shown on the attached Sketch Plat, designated as a fire zone and no parking zone by signs and/or other visible means.
b. 
The Police Authority of Maurice River Township, along with the Port Elizabeth Volunteer Fire Company, are directed to proceed and shall designate the fire zone and no parking zone pursuant to this section and to maintain same as a fire zone and no parking zone.
c. 
Any person who shall violate any term or provision of this section shall, upon conviction, be subject to imprisonment for a term of not more than fifteen (15) days nor a fine not to exceed fifty ($50.00) dollars or both, in the discretion of the Judge of the Municipal Court before whom such conviction is had. Furthermore, the vehicle involved in the violation shall also be subject to being towed from the zone at the cost of the owner of the vehicle. Each violation of any provision of this section shall constitute a separate offense.

Established. There is hereby confirmed a Fire District in Maurice River Township to be known as Fire District No. 1, established pursuant to New Jersey Statutes Annotated 40A:14-70 et seq.
b. 
Description of Fire District No. 1. The description of Fire District No. 1 is as follows:

BEGINNING at a point in the West Creek at its termination into the Delaware Bay (Cape May County/Cumberland County line); thence, north along the centerline of West Creek being the boundary line between Cape May County and Cumberland County to its intersection with Mosslander Road; thence, northeastwardly along the boundary line between Cape May County and Cumberland County to the boundary's intersection with the Eldora Road; thence, northwardly along the boundary line between Cape May County and Cumberland County to its intersection with the Leesburg-Belleplain Road; thence, westwardly along the centerline of the Leesburg-Belleplain Road to its intersection with Old Stagecoach Road; thence, south on Old Stagecoach Road approximately 359 feet to a point; thence, in a straight line from that point to Delsea Drive at Pole Creek; thence, south along the centerline of Delsea Drive to its intersection with Riggins Creek; thence southwardly along the centerline of Riggins Creek to the Delaware Bay; thence, eastwardly along the Delaware Bayshore to the point of beginning at West Creek.
c. 
No person shall hereafter become a member of any Fire Department organized in Fire District No. 1 located in Maurice River Township or any unit thereof, unless above the age of eighteen (18) years and not over the age of forty (40) years, a citizen of the United States of good moral character, a resident of the Township of Maurice River, County of Cumberland for upwards of one (1) year. He or she shall be physically fit to perform the duties of a Firefighter evidenced by a certificate to that effect by a practicing physician of the State of New Jersey, after physical examination for that purpose.
d. 
Every member of the Fire Department shall, in each and every year, perform at least sixty (60%) percent of duty to be composed of actual attendance and duty at fires and drills and a record shall be kept of such attendance and duty by the Chief of the Fire Department and reported to the Board of Fire Commissioners annually.
e. 
Every person seeking to join the Fire Department shall make application to the company or unit which he or she desires to join, and upon his or her election to membership by vote of a majority of the unit present and voting, he or she shall become a member in good standing of the Fire Department after approval of his or her membership by the Chief and confirmation by the Board of Fire Commissioners and his or her name shall be entered on a roll of Firefighters kept by the Board of Fire Commissioners.
f. 
This section shall not affect the term or tenure of office of any present Fire Commissioner or other officers of the Fire District, nor shall it prejudice in any manner the obligations, if any, of such Fire District.

BEGINNING at a point in the center line of Delsea Drive, State Highway No. 47 at its intersection with the Mauricetown Causeway, County Road No. 15; thence, westerly along the center line of County Road No. 15 in the center of the Maurice River; thence, northerly along the banks of the Maurice River to the center of its intersection with Menantico Creek thence easterly along the center of the Menantico Creek to its intersection with the Pennsylvania Railroad bed; thence, southerly along the center of the Pennsylvania Railroad bed to Jones Mill; thence, northwesterly along the upper reaches of the Muskee Creek to its intersection with Middle Branch; thence, easterly in a straight line to the County Boundary line at Hunters Mill at the intersection of Hunters Mill Road and State Highway No. 49; thence, southwesterly along the County boundary line to its intersection with the old Pennsylvania Railroad bed; thence, northwesterly along the old Pennsylvania Railroad bed until its intersection with Hunters Mill Road; hence, southwesterly along the center line of Hunters Mill Road until its intersection with Old Cape Road (Old Stagecoach Road) County Road No. 78; thence, northwesterly along the center line of Old Cape Road until its intersection with Delsea Drive and the place of Beginning.

Established. There is hereby established a Fire District in Maurice River Township to be known as Fire District No. 4 under the Statutes of the State of New Jersey governing the establishment of such districts.
b. 
Description of Fire District No. 4. The description of Fire District No. 4 is as follows:
BEGINNING at a point in the center of The Pennsylvania Railroad and bed and at its intersection with the Menantico Creek; thence southerly along the centerline of the Pennsylvania Railroad bed to Jones Mill; thence northwesterly along the upper reaches of Muskee Creek to its intersection with the Mill Branch; thence easterly in a straight line to the County boundary line at Hunters Mill at the intersection of Hunters Mill Road and State Highway No. 49; thence northerly along the County Line where the Maurice River Township line and the City of Vineland line meet; thence in a southerly direction following the Maurice River Township line to the point of beginning at the Pennsylvania Railroad bed.

Pursuant to Ordinance No. 575, Sections 2-4, all funds, debts and equipment of dissolved Fire District No. 5 shall be transferred to adjoining Fire District No. 1 and Fire District No. 2.
