There is hereby created and established the office of Superintendent of Public Works of the Borough of Avon-by-the-Sea. The Superintendent of Public Works will hold office for a term of three (3) years.
The Superintendent of Public Works shall be solely responsible for:
A. 
All matters relating to the construction, management, maintenance and operation of the physical properties of the Borough of Avon-by-the-Sea.
B. 
The operation and maintenance of all parks, recreation areas, playgrounds and facilities thereof.
C. 
The repair and maintenance and uses of all city streets.
D. 
The efficient collection and disposal of garbage in the Sanitation Department.
E. 
The performance of such other duties as may be assigned to him from time to time by the Director of Public Works.

The Superintendent of Public Works shall be paid a salary at a range to be established from time to time by the Board of Commissioners. The salary shall be in lieu of any and all overtime or holiday pay.
The Superintendent of Public Works shall be entitled to a vacation leave as specified by the applicable ordinance.[1]

A person holding office, position or employment as full-time Superintendent of Public Works who has held the office, position or employment continuously for five (5) years or more shall continue to hold the office, position or employment, notwithstanding that he is serving for a fixed term, during good behavior and efficiency and shall not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Municipal Clerk and after a public, fair and impartial hearing; provided however, that such person may be retired when he shall have attained seventy (70) years of age.
