There is hereby established in the Borough of Avon-by-the-Sea a Board of Recreation Commissioners consisting of seven (7) members, pursuant to N.J.S.A. 40:12-1 et seq., to be known as the Board of Recreation Commissioners of the Borough of Avon-by-the-Sea.
The Board of Recreation Commissioners shall have authority over the Borough's playgrounds and recreation places and shall have all powers and authorities with respect thereto pursuant to N.J.S.A. 40:12-1 et seq.

The seven (7) members of the Board shall be appointed by the Board of Commissioners of the Borough of Avon-by-the-Sea. The members first appointed shall be appointed for terms of one (1), two (2), three (3), four (4), and five (5) years respectively and thereafter all appointments shall be for the term of five (5) years.

Two (2) alternate members of the Board shall be appointed by the Board of Commissioners of the Borough of Avon-by-the-Sea as defined in N.J.S.A. 40:12-1.1.
The term for an alternate shall be five (5) years.
Vacancies shall be filled as soon as possible for the unexpired term only by the Board of Commissioners of the Borough.
Members of the Board of Recreation Commissioners shall receive no compensation for their services.

There is hereby established the position of Recreation Director (part time). The person so appointed to said position shall hold the same for a period of one (1) year and the appointment shall be made each year by the Board of Commissioners at such compensation as they may deem appropriate.
The Board of Commissioners shall also determine and fix the term and conditions of such employment and the duties of the position.

The Board of Recreation Commissioners shall hold at least one (1) public meeting each month for the transaction of such business as may come before it. It may hold such additional meetings as may be necessary. Three (3) members shall constitute a quorum.
Recreation Commission members not attending three (3) consecutive meetings in one (1) year shall be brought to the attention of the Board of Commissioners for review and shall constitute grounds for dismissal.
The Board of Recreation Commissioners may charge and collect fees and service charges for admission and use of facilities as provided by N.J.S.A. 40:12-5.
The Board of Recreation Commissioners shall adopt suitable rules and regulations for the use of premises under its control and authority and for the conduct of persons using the same. Such rules and regulations shall have the force of law as provided by N.J.S.A. 40:12-6.
The Board of Recreation Commissioners shall have an office at Borough Hall or at such other suitable place as the Board of Commissioners may determine.
Pursuant to N.J.S.A. 40:12-7 and 40:12-8, the Board of Commissioners of the Borough of Avon-by-the-Sea shall raise the funds necessary for the functions and duties of the Board of Recreation Commissioners by taxation in the same manner as other taxes and may issue bonds as provided thereunder. All monies received by the Board of Recreation Commissioners shall be kept in a special fund to be used as permitted by law.
The Board of Recreation Commissioners shall prepare in a form satisfactory to it, an "Application and Agreement for Use of Facilities" and shall require the same to be completed and submitted for its approval of any request for use of premises under its control and authority in accordance with such further rules and regulations as it may deem necessary and appropriate.

No person or group of persons shall use Harry B. Crook Field without having first obtained a permit therefor from the Board of Recreation Commissioners pursuant to § 39-11 of the Borough Code. No fee shall be required.
