A water-sewer utility is hereby established in and for the Borough of Avon-by-the-Sea.

There is hereby imposed an annual sewer rental charge for use, occupation, maintenance and construction of the sewers and sewerage system and disposal facilities in the Borough of Avon-by-the-Sea, upon the owners of the properties served thereby at the rates hereinafter set forth. An annual minimum charge of three hundred eighty-five dollars ($385) shall be made for each unit. An additional charge of three dollars and forty-five cents ($3.45) for each one thousand (1,000) gallons of water consumption shall be charged to each unit in addition to the basic minimum sewerage charge.
The sewer rental not covered by this Article, where the use of a property is producing a waste material to be discharged into the sewer system, shall be established by the Board of Commissioners of the Borough of Avon-by-the-Sea in such amount as shall be proportionate to its use of the sanitary system.

The total sewer rental shall be payable to the Borough Clerk or such other person appointed by resolution of the Board of Commissioners of the Borough of Avon-by-the-Sea quarterly and billed semi-annually.

All charges for sewer rental are due and payable when bills are rendered, and, if not paid within ten (10) days after the date thereof, interest from the date of said bill shall be charged at the rate of eight percent (8%) on the first one thousand five hundred dollars ($1,500) and eighteen percent (18%) on amounts over one thousand five hundred dollars ($1,500) per annum, and will be added to and collected with such charges.
The Borough Clerk or such other person appointed by resolution of the Board of Commissioners of the Borough of Avon-by-the-Sea shall have charge of all the books and records of the collection of sewer charges and shall bill and make collection of all sewer charges.
When water-sewer service to any property begins after the first day or terminates before the last day of any quarterly period, the charge shall be for that portion of the period during which the individual property is served.

The wastewater contribution of users and user classes, the total costs of operation and maintenance and the approved user charges system shall be reviewed at least every two (2) years and the system revised accordingly.

The discharge of any toxic pollutants which causes an increase in the cost of managing the effluent or the sludge shall subject the user responsible for such discharge to liability for all such cost increase.

At least annually, each user shall be notified at the time of a regular billing of the rate being charged and of the portion of user charges attributable to wastewater treatment services.

The cost of operation maintenance for all flows not directly attributable to users shall be distributed among all users in an equitable manner.

The sewer user charge provides for the payment to the Board of Commissioners and all of the expenses of the operation and maintenance of the Borough utility.

No person shall discharge or cause to be discharged any of the following described wastes to any public sewers:
A. 
Solid or viscous substances in quantities or of such size capable of causing obstruction to the flow in sewers or other interference with the proper operation of the sewage works such as, but not limited to:ashes, cinders, sand, mud, straw, shavings, metal, glass, rags, feathers, tar, plastics, wood, garbage, paper dishes, cups, milk containers and the like.
