No person or persons shall open,
dig up or excavate any public Street or alley, in the Borough of Avon-by-the-Sea,
with the exception of Main Street, for the purpose of laying any pipe
or connecting any pipe with any water or sewer main or for any other
purpose without first making application to and paying the Borough
Clerk the sum of fifty dollars ($50) and securing permission therefor
from the Borough Clerk, Street Commissioner or Superintendent of Streets.
Said connection with any sewer, water or other main shall be made
under the supervision of the Plumbing Inspector and/or Water Operator.

Any person or persons who shall have
excavated as aforesaid shall refill and tamp such opening to the level
of the surrounding area.

Prior to granting permission for
any excavation under this article, the application shall be reviewed
by the Superintendent of the Water and/or Sewer Departments, as the
case may be, and by the Superintendent of Public Works, who may require
a cash deposit for the necessary restoration work in an amount not
to exceed seven hundred fifty dollars ($750) or a performance bond
for work in excess thereof. In the case of the performance bond, the
applicant shall comply with the procedural requirements of AA 113-52.
In the case of the cash deposit, the same shall be refunded to the
applicant upon completion of the restoration work; if the work is
not completed as required, the Borough may complete the work and deduct
the cost thereof from the cash deposit.

Any person who violates any provision of this article shall, upon conviction thereof, be liable to the penalty provided by Chapter
1, Section
1-15.
