This chapter shall be known and may be cited as the "Environmental Control Regulations of the Township of Woodbridge" and is herein referred to as the "Environmental Control Regulations".

The purpose of this chapter is to protect the public health, safety and welfare of the citizens of the Township through the establishment of comprehensive environmental regulations designed to prevent environmental damage from air, water, noise and land pollution; minimize risks from hazards; and preserve and improve the quality of the environment.

The scope of this chapter includes environmental regulations relating to air and water quality, noise levels,[1] protection of land resources, and prevention of flood hazards and may be expanded as necessary to include whatever additional environmental regulations are required to preserve and improve the quality of the environment. This chapter shall be considered as supplementary and amendatory to the existing ordinances and the existing ordinances shall remain intact unless otherwise provided herein.

The provisions of this chapter shall apply, as appropriate, to the construction, operation and maintenance of all buildings and property within the Township.

For purposes of this chapter the following general terms shall have the meaning indicated in this section. In addition, terms relating to specific Articles or sections within an Article shall be defined within the specific Article or sections and shall be interpreted in the manner defined with respect to that Article or sections of the Article. Words used in the present tense include the future; words used in the masculine gender include the feminine and neuter; the singular number includes the plural and the plural the singular.
ENVIRONMENTAL REGULATIONS
Shall mean regulations controlling the physical environment including, but not limited to air pollution control regulations, water pollution control regulations, noise control regulations, land pollution control regulations and hazard prevention regulations.
MUNICIPAL COUNCIL
Shall mean the governing body of the Township of Woodbridge.
TOWNSHIP
Shall mean the Township of Woodbridge in the County of Middlesex, State of New Jersey and any corporate successor thereof.

The provisions of this chapter shall be administered and enforced as specified within each Article of this chapter.

Any person who violates any provision of an ordinance of the Township of Woodbridge shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, Section 1-5, provided however, that when the maximum penalty fixed by an applicable State statute is less, by force of the statute or by judicial construction, then the penalty fixed herein, the limitations of the statute shall be applicable. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
