"Bill S-378 is divided basically into two parts. The first part of the Bill allows a municipality, if it chooses, to designate reasonable and safe speed limits and to determine the need for Stop and Yield Intersections only on streets under municipal jurisdiction and totally self-contained within a municipality." "Portions of Codifications involving these matters (parking, handicap parking spaces, loading zones, etc.) will not be reviewed by the Department's engineering staff and are to be handled at the local level."
"The second portion of the legislation gives all responsibility for the investigation into the need for, and eventual approval of, almost all parking prohibitions to Municipal governments, without any involvement by the Commissioner of Transportation. This portion of the legislation gives the authority to Counties and Municipalities for all streets under their jurisdictional control, not just those totally self-contained streets as described in the previous paragraphs."
"Subject to the provisions of R.S. 39:4-138 which details statutory parking prohibitions such as in the vicinity of Stop signs, fire hydrants, intersections, crosswalks, etc., in the case of any street under municipal or county jurisdiction, a municipality or county has the authority to investigate the need and eventually approve parking prohibitions without any involvement whatsoever by the Commissioner of Transportation."

Whenever any words and phrases are used in this Chapter, the meaning respectively ascribed to them in N.J.S.A. 39:1-1 shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this Chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the Township.

As used in this Chapter:
Shall mean New Year's Day, Martin Luther King, Jr. Day, Washington's Birthday also referred to as Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day, in accordance with 5 U.S.C.A. § 6103(a), as the days observed as federal Legal Holidays.
Shall mean any mechanical device or meter placed or erected for the regulation of traffic by authority of this section. Each parking meter installed shall indicate by proper legend the legal parking time established by the Township, and when operated, shall at all times indicate the balance of legal parking time, and at the expiration of such period, shall indicate illegal or overtime parking.

a.
The Mayor or, in his/her absence, disability or inability to act, the Chief of Police and, in the event of his/her absence, disability or inability to act, then the ranking officer of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b.
Any regulations promulgated by the Mayor and in accordance with subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c.
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed fifty dollars ($50.00).
d.
Any regulation adopted that mandates the closing of any street for a period greater than forty-eight (48) consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this Chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this Chapter or any supplement thereto shall be liable to a penalty of not more than fifty dollars ($50.00) or imprisonment for a term not exceeding fifteen (15) days or both.

If any part or parts of this Chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this Chapter.

As provided in the Adopting Ordinance for the Revision of the Township of Millburn Ordinances, all former traffic ordinances of the Township are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this Chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Chapter.

The provisions of this Chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon street or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b.
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a.
Whenever snow has fallen and the accumulation is such that it covers the streets or highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated, except where on-street parking is permitted in a declaration of a snow emergency. (See subsection 7-14.1b)
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b.
An unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Purpose of Use of Parking Meters. It is hereby determined and stated that the control of vehicular traffic upon the public streets of the Township will be facilitated and the public safety and general welfare will be enhanced by the use of parking meters as a means of regulation of parking in and for certain areas of such streets, hereinafter designated as metered parking zones.
b.
Parking Meter Zones—Types; Markings; Signs.
1.
Types of Zones. There shall be four (4) kinds of on-street parking meter or paystation zones: The first kind is designated as a one (1) hour meter or paystation zone in which parking shall be permitted for one (1) continuous period of sixty (60) minutes. The second kind is designated as a two (2) hour meter or paystation zone in which parking shall be permitted for up to one (1) continuous period of up to two (2) hours. The third kind is designated as a three (3) hour meter or paystation zone in which parking shall be permitted for up to one (1) continuous period of three (3) hours. The fourth kind is designated as a twelve (12) hour meter zone in which parking shall be permitted for one (1) continuous period of up to twelve (12) hours.
The fees for one (1), two (2) and three (3) hour spaces controlled by a meter shall be a range of fifty cents ($.50) to seventy-five cents ($.75) per hour.
The fee set forth for twelve (12) hour spaces controlled by a meter shall be ten dollars ($10.00).
c.
Twelve Hour Zones. The following named streets or parts thereof are hereby designated as twelve (12) hour zones which require resident stickers:
Chatham Road, along the northerly side, beginning at a point two hundred one (201') feet west of the westerly side line of Woodland Road, if projected, to such northerly side line of Chatham Road and running westerly for a distance of one hundred seventy-six (176') feet; and further beginning at a point fifty (50') feet east of the easterly side line of Forest Drive and running easterly along Chatham Road a distance of two hundred ninety-five (295') feet.

Signs; Installation and Operation of Meters; Manner of Parking. Signs shall be installed in all metered parking zones specifying the time limits during which parking is permitted, which signs shall be in conformity with N.J.S.A. 39:4-183.17. The Chief of Police shall cause lines or markings to be painted or placed upon the curb and street pavement adjacent to each parking meter installed pursuant to the provisions of this section, for the purpose of designating the parking space for which such meter is to be used, and each vehicle parked adjacent to any such meter shall be placed within the lines or markings so delineated. No parking meter shall be installed or placed in any area in which parking is prohibited by the laws of the State.

How Parking Meter and Space to Be Used; Overtime Parking.

Parking spaces in the one (1) hour, two (2) hour, three (3) hour, and twelve (12) hour zones may lawfully be occupied upon depositing in the meter controlling the parking space the proper coins as specified in paragraph b of subsection 7-11.2.

Overtime Parking. If any vehicle shall, as indicated by the meter controlling the parking space, remain parked in any such parking space beyond the parking time limit prescribed in paragraph b of subsection 7-11.2 for the coin deposit made, the person who parked the vehicle in that location, or the registered owner thereof, shall be deemed to have violated the provisions of this section; provided further, however, that no motor vehicle shall occupy the same delineated parking space for more than one (1) period of time for which parking is permitted in such space and any motor vehicle that shall be parked for more than one (1) period for which parking is permitted in such space shall be in violation of this section even though the required parking fee for the additional period or periods has been deposited in the meter controlling the parking space in which the motor vehicle is parked.
When any vehicle remains parked in any parking space beyond the parking time limit prescribed for such space, each such period of time that the vehicle remains in such parking space after the expiration of the initial period of time shall constitute a separate violation irrespective of whether or not payment has been deposited in the meter for the additional period or periods of time.

Use of Slugs in Meters; Tampering with Meters. Depositing or causing to be deposited in any parking meter any slug, device or substitute for the aforesaid United States coin, or defacing, injuring or, without lawful authorization, tampering with, opening or willfully breaking, destroying or impairing the usefulness of any parking meter installed pursuant to this section shall constitute a violation of the provisions thereof, and upon conviction therefor, shall be punished as provided in Chapter 1, Section 1-5.
g.
Hours and Days Meters to Operate. The time limitations and coin deposit requirements specified by this subsection shall be deemed effective between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and Legal Holidays; excepting, however, the east side of Main Street between Taylor Street and Millburn Avenue between the hours of 7:00 a.m. and 9:00 a.m., and 4:00 p.m. and 6:00 p.m. when no parking shall be permitted; and further excepting, the portion of Chatham Road, along the northerly side, beginning at a point two hundred one (201') feet west of the westerly side line of Woodland Road, a distance of one hundred seventy-six (176') feet; and further beginning at a point fifty (50') feet east of the easterly side line of Forest Drive and running easterly along Chatham Road a distance of two hundred ninety-five (295') feet on Saturdays when the meters governing this area shall not be in operation.

No parking along any street shall be permitted between the hours of 2:00 a.m. and 6:00 a.m., except as follows:
a.
Parking along a street or road, other than a street under County jurisdiction and regulation, shall be permitted for not more than twenty-four (24) hours provided the vehicle is inoperable and cannot be moved so as to comply with this subsection or the vehicle cannot be placed in a driveway because the driveway has recently been resurfaced, and provided also that the parking of the vehicle on the street is reported forthwith to the Police Department. In the event the vehicle cannot be placed in a driveway because the driveway has recently been resurfaced, the exemption from this section shall continue until the driveway has stabilized.
b.
Upon the declaration of a weather emergency by the Mayor, the Superintendent of Public Works, the Business Administrator or the Chief of Police and upon notice of such declaration having been communicated to the Police Department, the provisions of this subsection shall be suspended throughout the Township for a twenty-four (24) hour period, but such suspension shall not apply to County roads.

Residents with a valid Residential Parking Zone permit are permitted to park within the Residential Parking Zone in which they reside outside of the posted time restrictions established within this Subsection 7-14.2. Residents are not permitted to park where parking is restricted at all times.
a.
Residents must establish proof of residency within a Residential Parking Zone by applying to the Township of Millburn to receive a resident parking zone permit.
b.
It shall be unlawful to sell, rent, transfer, lease or otherwise allow the use of a residential parking zone permit to any persons that do not reside on the designated streets of any established zone. Any resident of a zone that sells, rents, transfers, leases or otherwise allows for the use of their residential parking zone permit by someone other than a resident of the zone shall have their permit voided and considered invalid for a period of one (1) year.
c.
Residential parking zone permits must be distinguished differently than the general resident permit issued by the Township of Millburn.
d.
