The purpose of this section is to establish handicapped parking spaces in Millburn Township on public and private property which opens to the public or to which the public is invited. This section is enacted in accordance with N.J.S.A. 40:28-2-46, which confers upon the Township the right to establish handicapped parking spaces in order to preserve and safeguard the public health, safety, morals and welfare.

As used in this section:
Shall mean, in the case of a restricted parking zone, a permit issued by a municipality under the authority granted by N.J.S.A. 39:4-197.7 and, in the case of a restricted parking space, a placard or wheelchair symbol license plate issued by the New Jersey Division of Motor Vehicles under N.J.S.A. 39:4-206.
Shall mean a handicapped person who is the holder of an identification card issued by the New Jersey Division of Motor Vehicles under Section 2 of P.L. 1949, c. 280 (N.J.S.A. 39:4-205), or by a municipality under the authority granted by N.J.S.A. 39:4-197.7.
Shall mean to park a motor vehicle in a restricted parking space or a restricted parking zone if a motor vehicle does not display appropriate identification.
Shall mean a parking space which the State or a local government has established for the exclusive use of a handicapped person, but shall not include a restricted parking zone established under N.J.S.A. 39:4-197.6.
Shall mean a parking zone in front of the residence of a handicapped person which a municipality has established for the use of that handicapped person under the authority granted by N.J.S.A. 39:4-197.6.

In accordance with the provisions of N.J.S.A. 39:4-197, the following on-street locations are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special vehicle identification cards or plates or placards by the New Jersey Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

Such spaces are for use by persons who have been issued special vehicle identification cards, plates or placards by the Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.

Such spaces are for use by persons who have been issued special vehicle identification cards, plates or placards by the New Jersey Division of Motor Vehicles or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.
Each handicapped parking space shall be marked by a vertical sign indicating that it is a handicapped parking space and shall contain the penalty for violation in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways, adopted March 20, 1973, and filed with the New Jersey State Department March 21, 1973:

In accordance with the provisions of N.J.S.A. 39:5A-1, the following off-street parking yards are designated as handicapped parking areas. Such spaces are for use by persons who have been issued special identification cards, plates or placards by the New Jersey Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual of Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.

a.
An eligible handicapped person may request a law enforcement officer to arrange for the removal and storage of a motor vehicle which is parked unlawfully in a parking space or zone which is restricted for use by a handicapped person. It shall be the obligation of the owner of the motor vehicle to pay the reasonable costs for the removal and for any storage which may result from the removal, as regulated by this Code in Chapter 4, Section 4-39, as supplemented by any resolution regulating fees for such towing.
b.
The assessment of removal and storage costs against a person under this section shall be in addition to any other penalty assessed against the person.

The penalty for violation of this section shall be a fine of two hundred fifty dollars ($250.00) for the first offense and, for subsequent offenses, a fine of at least two hundred fifty dollars ($250.00) and up to ninety (90) days community service on such terms and in such form as the Municipal Court shall deem appropriate, or any combination thereof.
