Whenever any relevant words and phrases are used in this Chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this Chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the Borough.

The provisions of this section imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute, or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY-NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY-NO PARKING signs when weather conditions, accidents, fires and public celebration, dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY-NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I attached to and made a part of this Chapter.

No person shall park a vehicle between the hours specified on any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule II attached to and made a part of this Chapter.

a. 
All times. No person shall stop or stand a vehicle at any time on any street in the Borough of Keyport listed in Schedule III attached to and made a part of this Chapter, except as otherwise regulated by this Chapter.
b. 
Certain times. No person shall stop or stand a vehicle between the hours specified on any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule III attached to and made a part of this Chapter.

No person shall park a vehicle for longer than the time limit shown, at any time between the hours listed on any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV attached to and made a part of this Chapter.

No person shall stop, stand or park a vehicle in a roadway other than parallel with the edge of the roadway in the direction of traffic on the right hand side of the road and with the curb side of the vehicle within six inches of the roadway, except upon the streets or parts thereof described in Schedule V attached to and made a part of this Chapter.

No person shall park an omnibus or school bus of over 30 feet in length at any time upon any street in the Borough except as permitted in Schedule VI attached to and made a part of this Chapter.

Any resident of the street or portion of the street designated on Schedule VII attached to and made a part of this Chapter, who has no space or facility to park a vehicle upon their property, may obtain a permit to park such a vehicle on the street or parts thereof, and the vehicle shall not be subject to the parking time limits that would otherwise apply to the streets or parts thereof, provided:
a. 
The vehicle is owned or operated on a regular basis by a resident of that street, or portion thereof, as designated on the attached Schedule VII and the resident demonstrates that such vehicle cannot be parked upon their property; and
b. 
The vehicle has displayed a current residential parking permit on its left rear window or left side window, in such a manner as to be clearly visible to an officer enforcing parking regulations.
c. 
Application for parking permits under this subsection shall be made in writing on forms provided by the Borough Clerk. Permits shall be granted only to persons who are residents on the streets or portions thereof as set forth on the attached Schedule VII and comply with the requirements of this subsection. A permanent permit, valid for one year, shall be issued for every such vehicle owned or principally operated by such persons.
d. 
Expiration date, renewal, fees. All licenses shall expire on December 31 of the year of issue at 12:00 midnight. Applications for renewal of licenses shall be made not later than December 1 of the year of issue. There shall be a fee of $10 for a permit hereunder.
e. 
Vehicle limit.
1. 
Each residential unit shall be limited to two vehicle permits for parking on the street.
2. 
Additional parking permits in excess of those allowed under subsection 7-3.9e1 will be issued for unlimited parking of vehicles by residents in the Division Street parking lot only.

a. 
First Aid members. No person except a first aid member on call or responding to a call and displaying on the vehicle a valid permit or decal issued by the Borough, shall stop or stand a vehicle at any time along the westerly side of Atlantic Street beginning at a point 103 feet northerly of the intersection of Union Street and Atlantic Street running thence 39 feet northerly along the westerly side of Atlantic Street.

a. 
No person shall park any type of trailer, including, but not limited to, boat trailers, tag-along trailers pulled by a motor vehicle or truck, recreational or other detachable non-self-propelled trailer, at any time upon any street in the Borough of Keyport unless same is hooked up to an operable and registered motor vehicle. Exemptions shall be provided to persons utilizing parking for trailers for a period not to exceed 24 hours upon notification to the Police Department in writing.
b. 
No person shall park any type of trailer, regardless of whether same is attached to an operable and registered motor vehicle, at the following locations:

a. 
Whenever snow has fallen and accumulation is such that it covers the street or highway, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof described in Schedule XXII attached to and made a part of this Chapter. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic. Any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

No person except a resident displaying on the vehicle a valid permit issued by the Borough of Keyport for said purpose shall be permitted to park a vehicle on any of the following streets or parts of streets thereof.
Permits shall be issued only to vehicles registered to residences in the applicable areas or to a nonresident family member thereof. Exemptions for work vehicles required to be brought home are to be made to the Police Chief or his designee.
The number of permits issued to a residence, including nonresident family members thereof, is limited to three.
Permits, other than temporary permits, will expire one year after date of issuance.
Temporary permits for visitors are available upon application to the Police Chief or his designee, in advance of an event that requires additional parking. Said permit is of a different color and will specify the dates and times of validity.

a. 
Definitions: Any words or phrases used in this Subsection 7-3.14 shall have the same meanings as those given to them in Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey, and the New Jersey Administrative Code, specifically N.J.A.C. 5:21-1.1 et seq.
DRIVEWAY
A defined paved or improved surface providing vehicular access to a street. A driveway is not a road, street or highway, nor is a driveway a walkway or sidewalk.
FRONT YARD
The area between the street and the front building line of a residential dwelling unit, except for the portions of such area that are improved by a driveway or an improved surface parking area. For a corner property, "front yard" also includes the area from the sideline of the residential dwelling unit to the side property line, except for the portions of such area that are improved by a driveway or an improved surface parking area.
IMPROVED SURFACE PARKING AREA
A parking area for one or more motor vehicles constructed of concrete, asphalt, paving stones or other hard material, exclusive of any walkway or sidewalk.
MOTOR VEHICLE
Every motorized device in, upon or by which any person or property is or may be transported or drawn or moved upon a road, street or highway and shall include any automobile, bus, truck, tractor, motor house, farm machinery, motorcycles, scooters, mopeds, all-terrain vehicles, recreational vehicles, golf carts, go-carts, trailers, fifth wheel trailers, campers, semi-tractor trailers, and mobile homes. This definition does not include nonmotorized bicycles, small engine lawn mowers and devices of similar scale.
b. 
Prohibition. No person shall park any motor vehicle upon any front yard.
c. 
Snow event exception. In the case of a snow event, the prohibition stated in Subsection 7-3.14b above shall be suspended, beginning 12 hours before the event or emergency and ending 24 hours after the event or emergency. If any on-street parking is not immediately available thereafter, the suspension shall remain in effect until 24 hours after such on-street parking becomes available.
d. 
Warnings; summons. For the first 60 days following the adoption of this subsection, the Keyport Police Department is hereby authorized to issue warnings to the registered owner(s) of any and all motor vehicles in violation of this subsection and to affix same to the driver side windshield of any and all motor vehicles. Thereafter, the Keyport Police Department, the Borough Zoning Officer and/or the Borough Property Maintenance Officer shall be authorized to issue summons to the registered owner(s) of any and all motor vehicles in violation of this subsection and to affix same to the driver side windshield of any and all motor vehicles.

e. 
Violation; penalty. Any person violating the provisions of this section shall be subject to a fine not to exceed $100. If the violation is of a continuing nature, each and every day during which it continues will constitute a separate and distinct offense.

Trucks over four tons gross weight and vehicles over the registered gross weight are hereby excluded from the streets or parts of streets described in Schedule VIII except for the pickup and delivery of materials on such streets, Schedule VIII being attached to and made a part of this Chapter.

The streets or parts of streets described in Schedule IX attached to and made a part of this Chapter are hereby designated as one-way streets in the direction indicated.

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule X attached to and made a part of this Chapter are hereby designated as through streets. STOP signs shall be installed on the near right side of each street intersecting the through street except where YIELD signs are provided for in the designations.

Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule XII attached to and made a part of this Chapter are hereby designated as yield intersections. YIELD signs shall be installed as provided therein.

a. 
No operator of a vehicle shall stand or park a vehicle in a loading zone for a period of time longer than is necessary for the loading or unloading of passengers or materials. The maximum time that a vehicle can stand or park in a loading zone is 15 minutes. The locations described in Schedule XIII attached to and made a part of this Chapter are hereby designated as loading zones.
b. 
School zone. In accordance with state statute, N.J.S.A. 39:4-139, the loading or unloading of passengers shall not consume more than three minutes in an alley or at a curb adjacent to the entrance of a school, church, theater, hotel or hospital or any other place of public assemblage during hours designated by official signs.

The locations described in Schedule XIV attached to and made a part of this Chapter are hereby designated as taxi stands.

No person shall make a left turn at any of the locations described in Schedule XVI attached to and made a part of this Chapter.

No person shall make a U-Turn at any of the locations described in Schedule XVII attached to and made a part of this Chapter.

No person shall make a right turn when facing a steady red signal (STOP) indication whenever an official sign is presented prohibiting such turn on the red signal as described in Schedule XIX.

The streets or parts of streets described in Schedule XX attached to and made a part of this Chapter shall have the speed limits designated in such schedule.
Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.

Pursuant to the authority granted to the municipality by N.J.S.A. 39:4-197, the locations described in Schedule XXI are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the Motor Vehicle Commission. No other person shall be permitted to park in this space.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this ordinance or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.
All former traffic ordinances of the Borough covered in this Traffic Chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Chapter.

The provisions of Subtitle One of Title 39 of the Revised Statutes of New Jersey are made applicable to the semi-public roads, streets, driveways and parking lots at the Keyport Plaza located in the Borough of Keyport, County of Monmouth and the following regulations shall be enforceable:

Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil fills, any grassy area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's expense.
f. 
Mid-block crosswalks. The following described locations are hereby established as mid-block crosswalks:

h. 
All signs, posts or other necessary materials shall be installed and paid for by the applicant. All signing shall conform to the current Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
i. 
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this Ordinance or any supplement thereto shall be liable to a penalty of not more than $45 or imprisonment for a term not exceeding 15 days or both.

All vehicular traffic from the northern driveway on Block 80, Lot 1.02 is hereby restricted and limited to ingress only from Broad Street and no vehicular traffic shall exit from the northern driveway on Block 80, Lot 1.02 onto Broad Street within the Borough of Keyport.
