The Mayor shall be chosen at the general election by popular ballot of the eligible voters of the Borough of Somerville. He shall serve for a term of four (4) years.
The Mayor shall have all the powers and duties provided by state statute. He shall, inter alia, see to the faithful execution of the laws of the state and ordinances of the Borough, recommend to the Council those measures he deems necessary or expedient, maintain peace and good order and have power to suppress riots and tumultuous assemblies, all as provided in N.J.S.A. 40:87-31. He shall nominate and, with the advice and consent of Council, appoint all officers in accordance with N.J.S.A. 40:87-16. As provided by N.J.S.A. 40:88-1, he shall preside over meetings of the Council and may, in the event of a tie, cast the deciding ballot. Otherwise, he shall not vote. He may veto ordinances in accordance with the provisions of N.J.S.A. 49:9305. Such veto may be overridden by a two-thirds vote of the Council. His approval of all disbursements is required in accordance with N.J.S.A. 40:87-50, except as set forth in N.J.S.A. 40:87-51.
A. 
If the Mayor is absent from the Borough for three (3) days or is otherwise unable to act, the President of Council shall perform the duties of the Mayor. The Mayor shall notify the President in writing if he intends to be absent for more than three (3) days at any one time, and the President shall become Acting Mayor upon receipt of such notice and continue to act until the Mayor's return.
B. 
In case of the inability of the President to assume the duties of Acting Mayor, the member of the Council having the longest term of service shall act temporarily for the President.
As provided by state statute, the members of the Borough Council shall be chosen at the general election by popular ballot of the eligible voters of the Borough of Somerville. The Council shall consist of six (6) members. Their terms of office shall be for three (3) years beginning at 12:00 noon on January 1 following their election and shall be arranged in such a manner that the terms of two (2) Councilmen shall expire at the end of each year.
Compensation for the Mayor and Councilmen shall be fixed by vote of a majority of the members of the Council in accordance with N.J.S.A. 40:87-58 and shall be governed by the provisions of N.J.S.A. 40A:19-165 and 40:88-3.1.
A. 
The Tax Collector is appointed by the Mayor with the advice and consent of the Council. The Tax Collector is subject to the provisions of law relating to tenure of office and removal from office. The Tax Collector shall receive such compensation as prescribed by the Salary Ordinance,[1] shall devote full time and attention to the duties of the office and shall give bond for the faithful performance of the Collector's duties, to be paid for by the Borough.

B. 
The Tax Collector shall:
(1) 
Perform the functions of a collector of taxes, including without limitation thereto the rendering of bills for property taxes and the conducting of tax sales.
(2) 
Receive and collect all current and delinquent real and personal property taxes and tax sale fees and charges and receive penalties and interest thereon.
(3) 
Deposit to the credit of the Borough all moneys receive in the depositories selected by the Borough Council within the time prescribed by law.
(4) 
Maintain full and complete records and accounts of all sums collected and received under the supervision of the Borough Auditor and in accordance with the standards and requirements of the Division of Local Finance in the Department of Community Affairs of the State of New Jersey.
(5) 
Report to the Borough Council at least once a month all receipts and deposits made, and in such report, account for all moneys for which the Collector is responsible.
C. 
The Tax Collector shall provide to any party entitled to redeem a Tax Lien Certificate pursuant to N.J.S.A. 54:5-54 et al., two (2) calculations of the amount required for redemption within a calendar year at no cost. For each subsequent calculation requested from the Tax Collector, there shall be a fifty dollar ($50) fee. A request for a redemption certificate calculation shall be made in writing to the Tax Collector.
In accordance with N.J.S.A. 54:5-97.1, the Tax Collector shall charge a lien holder of a tax lien fifty dollars ($50) for the calculation of the amount due to redeem the tax lien. Any requests for a redemption calculation shall specify the date to be used for the calculation which shall be the date of notice. Neither the Tax Collector nor Borough shall be liable for an incorrect calculation. The fee paid to the Borough shall not become part of the lien and shall not be passed to any party entitled to redeem pursuant to N.J.S.A. 42-5:54.

The Tax Assessor is appointed by the Mayor with the advice and consent of the Council. The Tax Assessor is subject to the provisions of law relating to tenure of office and removal from office. The Tax Assessor shall receive such compensation as prescribed by the Salary Ordinance[1] and shall devote his full time and attention to the duties of his office unless otherwise regulated by the Borough Council.

B. 
The Tax Assessor shall have, perform and discharge all functions, powers and duties prescribed for assessors by rules and regulations prescribed for assessors by rules and regulations prescribed by the Director of the Division of Taxation in the Department of the Treasury of the State of New Jersey and the Somerset County Board of Taxation, and shall:
(1) 
Value all real and personal property in the Borough for the purposes of assessments and taxation, except when the Borough Council hires an appraisal firm.
(2) 
Prepare the tax lists and duplicate and maintain adequate assessment records of each and every parcel of real property assessed or exempted.
(3) 
Have custody of and maintain an up-to-date Borough Tax Map and provide for the recording thereon of all changes in ownership or character of property assessed.
