A.
Fire lanes on private property shall be established in accordance
with N.J.A.C. 5:18-3.3(l) and any amendments thereto. The Fire Official
shall, upon the designation of a fire lane on private property, file
a written description of such fire lane with the Borough Clerk.
B.
Fire lanes on public property shall be established by designation
of such lanes by the Fire Official with the approval of the chief
executive officer of the Fire Department, the Chief of Police, and
the public entity owning the property. The public entity owning the
property shall cause such lanes to be marked. The Fire Official shall,
upon establishment of a fire lane on public property as herein provided,
file a written description of such fire lane with the Borough Clerk.
It shall be the responsibility of the owner of private property
to mark and maintain markings on the fire lanes in accordance with
N.J.A.C. 5:18-3.3(l) and any amendments thereto. The failure of an
owner of private property to comply with the provisions of N.J.A.C.
5:18-3.3(l) shall be a violation of this chapter.
It shall be a violation of this chapter to park a motor vehicle
in, or otherwise to obstruct, a fire lane.
Upon conviction for violation of any provision of this chapter
the maximum penalty shall be one or more of the following: a fine
not to exceed one thousand dollars ($1,000.), imprisonment in the
County Jail for a period not to exceed ninety (90) days, and/or a
period of community service not to exceed ninety (90) days. Each and
every day upon which a violation of any provision of this chapter
exists shall constitute a separate violation.
