SIDEWALK SALES
A business operator or owner who temporarily peddles any goods, wares or merchandise or food item to promote the business or business district.
No business owner shall sell or provide any goods, wares or merchandise of any food item in front of their place of business without approval of the borough.
Applications for the sidewalk sale permit shall be filed with the Borough Clerk and shall require the applicant to identify the exact location, exact times, person in charge and the goods, wares, merchandise, and/or food item being sold or provided.
The Borough Council shall approve the sidewalk sale after review of said application.
No sidewalk sale permit shall be permitted to extend beyond 9:00 p.m.
It shall be the duty of any police officer of the Borough of Somerville to require any such person conducting a sidewalk sale who does not have a valid permit to enforce provisions of this Article against any person found to be violating same.
The license issued pursuant to this Article may be revoked by the Borough Clerk or designee for any of the following reasons:
A. 
Fraud, misrepresentation or false statements contained in the application for the sidewalk permit.
B. 
Any fraud, misrepresentation or false statements in connection with selling of the goods, wares or merchandise.
C. 
Failure to obtain the other permits required to conduct such sales (i.e., Board of Health, Fire Official, Zoning) if applicable.
